SUMMARY OF ORDINANCE

On January 9, 2020, the Fresno County Planning Commission recommended approval (8 to 0, one absent) to change the boundaries of certain zones and the zoning district of property thereby affected in accordance with the provisions of the Zoning Division of the Ordinance Code of Fresno County, and to amend the zone map established by said division accordingly and further described as Parcel 3 of Parcel Map No. 2338, in the County of Fresno, State of California, according to the map thereof recorded in Book 15 Page 31 of Parcel Maps, Fresno County Records which heretofore has been classified in the R-R (Rural Residential) Zone District, located on the north side of Auberry Road approximately 350 feet northeast of its intersection with Morgan Canyon Road, within the unincorporated community of Prather, is hereby changed to the C-6(c) (General Commercial) Zone District subject to certain limitations and conditions. Although the proposed rezone will reduce the inventory of land identified in the Housing Element of the General Plan for the above moderate-income population by 8.46 acres, a surplus of the inventory of land for above moderate-income residential use will continue to be maintained and the rezone meets findings A and B of Government Code Section 65863(b)(1).

In accordance with Government Code Sections 25123, 25131, and 65854-65857, this Ordinance, designated as Ordinance No. R-490-3821 shall take effect thirty days after its passage.
