Plaintiff has filed a civil complaint against you. DETAILED SUMMARY OF THE MATTER THAT PLAINTIFF SEEKS TO VALIDATE:
The California Department of Water Resources (Department) operates facilities which conserve, store, transport and deliver water to urban and agricultural water agencies throughout the State. Since 1960, the Department has approved, planned and constructed a system of water storage and transportation and power generation facilities (the State Water Project). Currently, State Water Project water is conveyed across the Sacramento-San Joaquin Delta through the natural channels of the Delta formed by the confluence of the Sacramento and San Joaquin Rivers, as those channels have been modified over the past 150 years.
The Department has undertaken to develop a comprehensive plan for the effective delivery of State Water Project water across the Delta. The Department is currently undertaking planning and design activities regarding potential new Delta conveyance facilities. The facilities under review would transport water from new intake points on the Sacramento River at the northern edge of the Delta through an underground tunnel running below the natural waterways of the Delta to State Water Project export facilities at or below the southern edge of the Delta. These facilities would be a further modification of the Feather River Project authorized pursuant to the Central Valley Project Act, Water Code sections 11100 et seq.
The Department has established a proposed revenue bond financing to finance the cost of the environmental review, planning, engineering and design, and if and when appropriate, the acquisition and construction of Delta conveyance facilities. On January 6, 2025, the Department adopted a bond resolution authorizing the issuance of revenue bonds for those purposes. Under the bond resolution, bonds for construction cannot be issued unless specific conditions precedent are satisfied, which include regulatory and statutory requirements regarding the physical and environmental aspects of approving, constructing, and operating Delta conveyance facilities.
On January 7, 2025, the Department filed a validation action to confirm the legal validity of the Department’s proposed bond financing. A validation action is a judicial proceeding in which a governmental agency, like the Department, can confirm the validity of a proposed financial transaction before it commits to or undertakes the transaction. The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code. The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City. A copy of the resolution is on file at the Office of the City Clerk. Actual wage schedules are available at Construction Management Office, 747 R Street, 2nd Floor, Fresno, California 93721, (559) 621-5600.
Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting bids.
All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager. A Bid Deposit, which can be provided separately, in the amount of TEN PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount. CONTRACTOR’S LICENSE(S):

REQUEST FOR INFORMATION (“RFI”):

BONDS AND INSURANCE:
Each Bid shall be accompanied by a Bid Bond as bid security secured from a California admitted surety company the form provided by the District in the Contract Documents (“Bid Security”). The amount of the Bid Security shall be at least ten percent (10%) of Bidder’s Total Bid Price, made payable to the State Center Community College District. The Bid Security shall be provided as a guarantee that within five (5) working days after the District provides the successful Bidder the Notice of Award, the successful Bidder will enter into a contract and provide the necessary bonds and certificates of insurance. The successful bidder will forfeit the Bid Security if the Bidder fails to comply. No interest will be paid on funds deposited with District.
The successful Bidder will be required to furnish a Performance Bond and a Labor and Material Payment Bond, from a California admitted surety company and, on the forms, provided in the Contract Documents, each in an amount equal to one hundred percent (100%) of the Contract Price.
Pursuant to Section 22300 of the Public Contract Code of the State of California, the successful Bidder may substitute certain securities for funds withheld by District to ensure its performance under the contract.
DEPARTMENT OF INDUSTRIAL RELATIONS (“DIR”):
The successful Bidder and all Bidder’s Subcontractors must pay all workers on work performed pursuant to a contract for the Project not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by the Director of the Department of Industrial Relations, State of California (“DIR”), for the type of work performed and the locality in which the work is to be performed, pursuant to sections 1770 et seq. of the Labor Code. Copies of the general prevailing rates of per diem wages for each craft, classification, or type of worker needed to execute the Contract, as determined by Director of the DIR, are on file at the District’s administrative office. Prevailing wage rates are also available from the District or on the internet at (http://www.dir.ca.gov).
Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. No Bid will be accepted nor any contract entered into without proof of the contractor’s and subcontractors’ current registration with the Department of Industrial Relations to perform public work. The Project is subject to compliance monitoring and enforcement by the DIR. The successful Bidder must post job site notices, as prescribed by regulation. The successful Bidder must comply with all requirements of Labor Code section 1771.4, except the requirements that are exempted by the Labor Commissioner of California (“Labor Commissioner”) for the Project. BID NO. NC-2026-01: STUDENT TRANSPORTATION SERVICES
NOTICE IS HEREBY GIVEN that FCSS will receive bids for student transportation services beginning on February 5, 2025, until and including June 23, 2025, from interested bidders in accordance with this Notice Inviting Bids and other documents (collectively “Bid Packet”). The requirements for student transportation services are in the Bid Packet and the Contract. Before the award of the Contract, FCSS reserves the right to modify any dates stated below.
1. BID PACKET. The Bid Packet, including the Contract, will be available starting 02/05/2025 and may be obtained or reviewed by contacting the Contact Person listed above.
2. BID SECURITY. Each Bid must be accompanied by a bid bond, cashier’s check, certified check, or other security acceptable to FCSS in the amount not less than $100,000 and made payable to the Fresno County Superintendent of Schools. If a bid bond is used, it must be issued by an admitted surety insurer (an insurance organization authorized by the California Insurance Commissioner to transact surety insurance in California during this calendar year). The bid security shall be given as a guarantee that the bidder will execute the Contract with FCSS if awarded the Contract and will be forfeited, paid to, and retained by FCSS as liquidated damages if the bidder refuses or fails to execute the Contract and provide the required performance bond and insurance. FCSS reserves the right to approve or reject the surety that bidder selects and to require bidder to obtain the bond from a surety satisfactory to FCSS.
3. PRE-BID CONFERENCE. An optional pre-bid conference to acquaint prospective bidders with this Bid, the Contract, and the required services will be held at 10:00 a.m. (PDT) on 6/13/2025 in Conference Room, Sixth Floor of Towers Building at the address listed above. Whether or not a bidder attends the conference, which may include dissemination of information in response to questions, the bidder shall be deemed to have notice of all information disseminated at the conference.
4. BID LOCATION. All bids shall be submitted at the Front Desk at the address listed above.
5. QUESTIONS. Questions regarding the Bid Packet, Contract, or required Services shall be submitted in writing to, and received by, the Contact Person at the above email before 3:00 p.m. (PDT) on 6/16/2025.
6. BID DEADLINE. All bids to this Bid shall be submitted on 6/23/25, no later than 3:00 p.m. (PDT).
