The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code.  The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City.  A copy of the resolution is on file at the Office of the City Clerk.  Actual wage schedules are available at Construction Management Office, 1721 Van Ness Avenue, Fresno, California 93721, (559) 621-5600.

Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting bids.

All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager and must be accompanied by a Bid Deposit in the amount of TEN PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount.  All Bid Deposits will be held until a Contract has been executed with the successful Bidder or all bids have been rejected.  Copies of Bid Deposits may be submitted electronically with the exception of a cashier’s check, which must be brought to the Purchasing Managers office and labeled accordingly with bid number.

Bidders are advised that, as required by federal law, the State of California has established a statewide overall DBE goal.  City of Fresno federal-aid contracts are considered to be part of the statewide overall DBE goal and the City is required to report to the California Department of Transportation (Caltrans) on DBE participation for all Federal-aid contracts each year so that attainment efforts may be evaluated. 

Bidders are advised that, as required by federal law, the City of Fresno is implementing new Disadvantaged Business Enterprise requirements for Disadvantaged Business Enterprises (DBE).  The DBE goal for this Project is  NINETEEN PERCENT (19%).   DBE participation shall be calculated on the basis of the Total Net Bid Amount and on all possible combinations of the Base Bid plus Add Alternate(s), if applicable.

NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to, construction/reconstruction of concrete curb ramps, curbs, gutters, valley gutters, and sidewalks at various locations within the City boundary.

A Mitigated Negative Declaration has been completed for Project Item No. 1, pursuant to Section 15070 of CEQA.  Recommendation of a proposed Mitigated Negative Declaration does not necessarily mean this project will be approved.  Hard copies and electronic copies of the proposed Mitigated Negative Declaration for this project may be reviewed and/or obtained at the City of Clovis Planning Division, 1033 Fifth Street, Clovis, California, Monday through Friday, between 8:00 a.m. and 3:00 p.m.

The City has determined that Item No. 2 is exempt from CEQA pursuant to CEQA Sections 15162 given that no major revisions will be required to the Initial Study Mitigated Negative Declaration previously prepared for the associated Project (GPA2019-001, R2019-003, and TM6263).  A Notice of Exemption has been completed during the preliminary review, and is kept for public review with the project file during the processing of the project application.  Staff will file the notice with the County Clerk if the project is approved.

Item No. 3 was evaluated under a Focused Environmental Impact Report (EIR) certified by the City Council on July 9, 2018 (State Clearinghouse Certification No. 2017041010). No major revisions will be required with the adopted Focused EIR to accommodate the proposed project, therefore, subject to CEQA Sections 15162 and 15182, no further environmental review is required for this project. PROJECT LOCATION: The project site is in unincorporated Fresno County, approximately 2 miles east of Interstate 5 (I-5) and approximately 13 miles east of Coalinga. Lassen Avenue (California State Route [SR] 269) borders the eastern side of the property and is the only paved road adjacent to the project site. Trinity Avenue, Tractor Avenue, and Phelps Avenue intersect the project site, but are not improved roads. Nearby communities include Huron (1.5 miles north), Avenal (9 miles south), Kettleman City (12 miles southeast), and Coalinga (13 miles west). The project site is approximately 1,600 acres and comprises the following 12 Fresno County Assessor Parcel Numbers:

PROJECT DESCRIPTION: The RWE Solar Development, LLC (formerly known as EC&R Solar Development, LLC) (Applicant) has applied to the Fresno County Department of Public Works and Planning for three Unclassified Conditional Use Permits (CUPs) (CUP Application Nos. 3562, 3563, and 3564) to construct, operate, maintain, and decommission a 150-megawatt (MW) solar photovoltaic (PV) generation facility, an up to 20-MW solar PV generation facility, and an up to 100-MW energy storage facility. The Fifth Standard Solar Facility Project Complex (proposed project) includes PV electricity-generating facilities, a battery storage facility, and associated infrastructure. The proposed project is located on twelve contiguous parcels (project site), totaling approximately 1,600 acres in unincorporated Fresno County. A new generation-tie (gen-tie) line would be constructed to connect the solar and storage components of the proposed project to Pacific Gas and Electric’s (PG&E’s) adjacent Gates Substation (point of interconnect). The anticipated lifetime of the proposed project would be 35 years and would be decommissioned once operations of the facility cease. The final lease agreement is anticipated to occur by 2022 with a lease term of 35 years. The CUP would tentatively have an end date of August 2057. The lease agreement would include an option for renewal, in which case a new land use permit subject to the County’s review and approval would need to be obtained.

The proposed project includes three separate components:

·         Unclassified CUP Application No. 3562 Fifth Standard Solar Facility: a 150-MW PV solar energy generation facility that is anticipated to require up to 1,400 acres of the site. A 230-kilovolt (kV) project gen-tie line would be constructed from the southwest portion of this site to the point of interconnect. The gen-tie line would consist of a 0.3-mile aboveground power line.

·         Unclassified CUP Application No. 3563 Stonecrop Solar Facility: a 20-MW PV solar energy generation facility that would be located adjacent to the Fifth Standard Solar Facility and would require less than 200 acres of the site.

·         Unclassified CUP Application No. 3564 Blackbriar Battery Storage Facility: an up to 100-MW battery storage facility that would be located adjacent to the Fifth Standard Solar Facility and the Stonecrop Solar Facility and would require less than 5 acres of the site.

SIGNIFICANT ENVIRONMENTAL EFFECTS: The County of Fresno has prepared a Draft Environmental Impact Report (EIR) to address the specific environmental effects of implementing the proposed project. The Draft EIR consists of analysis of the following environmental issue areas that may be impacted by the project:

NOTICE OF INTENT TO ADOPT A

MITIGATED NEGATIVE DECLARATION

Notice is hereby given that the County of Fresno has prepared Initial Study Application (IS) No. 7721 pursuant to the requirements of the California Environmental Quality Act for the following proposed project:

INITIAL STUDY APPLICATION NO. 7721 and DIRECTOR REVIEW AND APPROVAL APPLICATION NO. 4602 filed by CHARLES MAXWELL, proposing to amend DRA No. 4112 and DRA No. 4465 to allow operational modifications for an approved commercial horse arena on a 40.05-acre parcel in the AL-40 (Limited Agricultural, 40-acre minimum parcel size) Zone District.  Operational modifications include increasing the number of authorized event days from 24 event days to 72 event days and change operational time limits to allow 30 of the event days to operate during the evening hours from 4:00 PM to 10:00 PM. The project site is located on the west side of Rusty Spur Lane approximately 690 feet south of its nearest intersection with Millerton Road and is approximately 6.35 miles east from the unincorporated community of Friant (SUP. DIST. 5) (APN 138-061-49). Adopt the Mitigated Negative Declaration prepared for Initial Study Application No. 7721 and take action on Director Review and Approval Application No. 4602 with Findings and Conditions.

The County of Fresno has determined that it is appropriate to adopt a Mitigated Negative Declaration for the Proposed Project.  The purpose of this Notice is to (1) provide notice of the availability of IS Application No. 7721 and the draft Mitigated Negative Declaration, and request written comments thereon; and (2) provide notice of the public hearing regarding the Proposed Project.
