Adoption of the amended ordinance would allow each member of the Council to receive a salary of two hundred and seventy-seven dollars ($277.00) per month. This amendment would take effect after the first pay period following the commencement of a new term of office after the next municipal election. The proposed amendment of the Fowler Municipal Code would not present the potential to impact the environment and would therefore be exempt from environmental analysis pursuant to California Environmental Quality Act Guidelines Section 15061(b).

Fresno Street Reconstruction
Scope of work includes full compensation for all labor, materials, tools, equipment, and incidentals to perform a pavement rehabilitation, concrete improvements, and signing & striping on Fresno Street & 1st Street. In addition, adding new bike lanes and facilities on several streets within the City of Fowler. Contractor shall furnish and install improvements to include full-depth reclamation pavement rehabilitation, curb ramps, curb, gutter, sidewalks, new thermoplastic crosswalks, green and white bike lane markings, parking stall striping, painted red curbs, and bike lane signage. Additional concrete flatwork shall be constructed for bike repair and air-filling, as well as for bike racks installed as part of this project. Additionally, the contractor shall remove all conflicting striping within the project area. All Improvements are shown in the project drawings in Appendix B- Fresno Street Reconstruction Plans. All items shall be removed or constructed per City of Fowler or applicable Caltrans State Standard drawings and specifications.

It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done. Said wage determinations are on file with the City Clerk and are incorporated herein by reference.
Minimum wage rates for this project have been determined by the Secretary of Labor. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates predetermined by the Director of the Department of Industrial Relations of the State of California for similar classifications of labor, the contractor and his subcontractors shall pay not less than the higher wage rate.
Bids are required for the entire work described herein. Bids will be compared on the basis of the total of bid items.
The successful bidder shall furnish a faithful performance and labor and materials bonds each in the amount of 100 percent of the contract amount. Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Fowler. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance and that the City of Fowler will not accept a surety company with a Best’s rating of less than B.
Pursuant to Public Contract Code Section 22300, substitution of securities for any moneys withheld by the City of Fowler to ensure performance under the contract shall be permitted.

Bid Proposal: BIG DRY CREEK CANAL TRAIL IMPROVEMENTS AT LETTERMAN PARK
No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer. Each bid must be accompanied by a certified or cashier’s check or bidder’s bond on the City’s form, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid. Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract. A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials (Payment) Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded. Said bonds shall be on the City’s forms and shall be issued by a surety company which is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, which has a rating not lower than “A-” as rated by A.M. In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done. Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612. A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.
In accordance with the provisions of Sections 1725.5, 1771.1, 1771.3, and 1771.4 of the Labor Code, this project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal (subject to the requirements of Section 4104 of the Public Contract Code), or engage in the performance of any contract for public work, as defined by that chapter of the Labor Code, unless currently registered and qualified to perform public work pursuant to Section 1725.5 of the Labor Code. See Section 7-2 of the Standard Specifications (General Conditions) for additional requirements.
The City of Clovis will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.
The work to be performed under this contract is on a project assisted under a program providing direct federal financial assistance from the Department of Housing and Urban Development (HUD), Community Development Block Grant (CDBG) program, and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 USC 1701u. Section 3 requires that to the greatest extent feasible opportunities for training and employment to be given to low and moderate income persons residing within the project area and that the contracts for work in connection with the project be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the area of the project. Regulations for implementing the Section 3 clause are contained in 24 CFR 135, as amended, and as specified in the project specifications.
All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form. The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”. Bidders for this project must possess a valid Class A License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available. Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract. All representations made on the proposal are made under penalty of perjury.
The project is subject to the contracting requirements and implementing regulations as amended in Title 13, Section 2449 General Requirements for In-Use Off-Road Diesel-Fueled Fleets, of the California Code of Regulations (13 CCR § 2449(i)). Bidders must submit a valid Certificate of Reported Compliance (CRC) issued by the California Air Resources Control Board at the time of bidding. Bidders are responsible for submitting their listed subcontractors’ CRCs and any supporting documentation within five (5) calendar days of bid opening. Failure to submit the required CRCs may render a bid non-responsive.
The lowest bid shall be determined by the amount of the base bid. The Owner reserves the right to add or deduct any of the additive or deductive items after the lowest responsible and responsive bidder is determined.
The City of Clovis reserves the right to reject any or all bids, to waive any informalities or minor irregularities in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interest of the City of Clovis.
Time of completion for the Project shall be Twenty (200) Working Days from the date established in the Owner’s Notice to Proceed.
Unless otherwise required by law, no bidder may withdraw its bid for a period of sixty (60) days after the date set for the opening thereof or any authorized postponement thereof. The Owner reserves the right to take more than sixty (60) days to make a decision regarding the rejection of bids or the award of the Contract.

NOTICE IS HEREBY GIVEN that at a regular meeting on Tuesday, February 17, 2026, at 6:00 p.m. or as soon thereafter as the matter can be heard, the Fowler City Council will hold a hearing at the City Hall Council Chamber at 128 S. 5th Street, Fowler, California, to consider the following:
City of Fowler Planning Fee and Development Impact Fee Schedule for 2026. The City Council will consider an update to the City of Fowler’s Planning Fee and Development Impact Fee Schedule for calendar year 2026. Such updates would result in an inflationary increase in fees collected to process development projects. This increased cost will cover the current estimated reasonable cost of providing such services. Pursuant to Government Code Section 66016(a), the data and information from which the proposed fees are derived shall be made available for public review at Fowler City Hall during normal business hours beginning not less than ten (10) days prior to the hearing.

SUMMARY OF ORDINANCE NO. 2026-01 OF THE CITY OF FOWLER
On February 3, 2026, the Fowler City Council introduced Ordinance No. 2026-01 as a part of Planning Project No. 25-19, which includes Vesting Tentative Subdivision Map No. 6520, a request to prezone Assessor’s Parcel Number 343-040-02 (Project site), and a request to annex the Project site to the City of Fowler (Project). The Project has proposed the subdivision of the Project site into a single-family residential development comprising 180 lots, along with outlots dedicated for public facilities, such as open space, and a storm drainage basin. The Project site is located at the southwest corner of East Sumner Avenue and South Sunnyside Avenue (see Exhibit 1). The site is within the City’s Sphere of Influence but is not within the city limits and as a result the Project site would be required to be annexed to the city limits prior to development within the City of Fowler. The General Plan land use designation for the Project site is Medium Low Density Residential (MLDR), which allows a density range of 3.7-5.5 dwelling units per acre. The site is currently zoned AE-20 (Exclusive Agricultural – Minimum 20 acres) by Fresno County and must be given a City of Fowler zoning designation prior to annexation to the City. The Project proposes to prezone the site to R-1-6 mapping zone district (Single Family Residential) with an implementing zone district of R3 (Medium Density Residential), which is consistent with the site’s MLDR General Plan land use designation. The City Council will also consider finding that the Project is consistent with the City’s General Plan and General Plan Environmental Impact Report pursuant to California Environmental Quality Act Guidelines Section 15183, absolving the Project from further environmental analysis. If adopted, Ordinance No. 2026-01 would result in the Project site being prezoned as proposed.
