NOTICE OF INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION
FOR THE TENTATIVE MAP NO. 6471 PROJECT
NOTICE IS HEREBY GIVEN that the City of Fowler (City) plans to adopt a Mitigated Negative Declaration (MND) for the Tentative Map No. 6471 Project (Project). The public hearing to consider the Project is scheduled to be held on Thursday, April 3, 2025, at 6:30 pm, at the City of Fowler located at 128 S. Fifth Street, Fowler, CA 93625.
The Project proposes to annex approximately 83.04 acres (APNs: 340-120-05, -06, -28, and -29) into the City of Fowler. Approximately 30.65 acres of the annexed land would be prezoned to the M-1 zone district and the remaining 52.39 acres to the R-1-6 zone district. Williamson Act Contract No. 6340 on APN: 340-120-05 would be canceled, and Ag Preserve Fowler-Selma-Kingsburg No. 27 would be diminished. The M-1 zoned area would be subdivided into 44 parcels for future Light Industrial land uses. Streets would be constructed and designed to City of Fowler standards. A stormwater retention basin is proposed which will be designed to accommodate the increased impermeability of the subdivision. Clayton Avenue would be widened to 60 feet along the project frontage. Approximately 0.5 miles of sewer main would be constructed to connect to Selma-Kingsburg-Fowler County Sanitation District facilities in Golden State Boulevard. Approximately 1.3 miles of water main would be constructed to connect the subdivision to the existing mains in Golden State Boulevard and Fowler Avenue. A lot line adjustment would be submitted to separate the designated remainder from the industrial subdivision. Traffic signal improvements would be made at Golden State Boulevard at Jefferson and Clayton Avenues, Clovis Avenue at Lincoln Avenue and State Route 99 Southbound Ramps, and Merced Street at the State Route 99 Southbound ramps.
Pursuant to the California Environmental Quality Act (CEQA), an Initial Study (IS)/MND has been prepared, describing the degree of possible environmental impacts of the Project. The City has assessed the potential environmental impacts of this Project and has determined that they will be less than significant. Copies of the IS and proposed MND are on file and available for public review at the City of Fowler, 128 S. Fifth Street, Fowler, CA 93625. The public review period during which the City will receive comments on the proposed MND will begin on February 26, 2025, and end on March 27, 2025. The site has been reviewed in accordance with Government Code Section 65962.5 and is not listed as a hazardous waste or materials site.

The scope of work includes but is not limited to; Grind, overlay and full-depth reconstruction along Herndon Avenue from Valentine Avenue to Marks Avenue. The project also includes curb ramp improvements, signal loop detectors, signage and striping.
The Construction Allocation for this project is $1,318,535.00.

The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code. The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wagres and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City. A copy of the resolution is on file at the Office of the City Clerk. Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting bids.
All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager. A Bid Deposit, which can be provided separately, in the amount of TEN
PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount. Bidders are advised that, as required by federal law, the State of California has established a statewide overall DBE goal. City of Fresno federal-aid contracts are considered to be part of the statewide overall DBE goal, and the City is required to report to the California Department of Transportation (Caltrans) on DBE participation for all Federal-aid contracts each year so that attainment efforts may be evaluated.
Bidders are advised that, as required by federal law, the City of Fresno is implementing new Disadvantaged Business Enterprise requirements for Disadvantaged Business Enterprises (DBE). The DBE goal for this Project is SEVENTEEN PERCENT (17%). DBE participation shall be calculated on the basis of the Total Net Bid Amount and on all possible combinations of the Base Bid plus Add Alternate(s), if applicable.

Bidders are advised that this contract is subject to the City’s Community Workforce Agreement, a project labor agreement executed by the City and the Fresno, Madera, Tulare, Kings Building Trades Council. Which includes a local hiring program, wherein the contractor must use best faith efforts to meet the hiring percentage requirements for Journey-level and apprentice level project work hours. REGARDING ANNEXATION OF TERRITORY TO CITY OF FRESNO COMMUNITY FACILITIES DISTRICT NO. 9
ANNEXATION NO. 64
Notice is hereby given that on January 30, 2025, the City Council of the City of Fresno (“City”) adopted Council Resolution No. 2025-026 to annex the territory known as Assessor’s Parcel Number 506-130-04S to the City of Fresno Community Facilities District No. 9 (“CFD No. 9”) and to authorize the levy of Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”).  Under this City Law and Council Resolution No. 2025-026, the City gives notice as follows:
The text of Council Resolution No. 2025-026, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Council Resolution No. 2025-026 is summarized as follows:
a.            As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 9, the boundaries of which are shown on the map on file with the City Clerk.
b.            The purpose of CFD No. 9 is to provide services and maintenance for certain regulatory required public improvements that are constructed or installed on public property, dedicated rights-of-way or easements on the perimeter of commercial, industrial and multi-family subdivisions.  These improvements include, without limitation, landscaping and irrigation systems, street trees, median hardscaping, local street curbs, gutters, sidewalks, street paving, street name signage and streetlights, trails and trail amenities (“Services”).
c.            The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 9 under the rate and method of apportionment described in Council Resolution No. 2025-026 and Exhibit D thereto.  The special tax requires the approval of two-thirds of the qualified electors of CFD No. 9 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.
d.            The Special Tax, if approved, will be used to finance all or a portion of the Services.
e.            The Director of Public Works or his designee of the City is directed to cause to be prepared a written report for CFD No. 9, Annexation No. 64 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 9 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.
f.             As set forth below, the City will hold a public hearing on the annexation of the territory known as Assessor’s Parcel Number 506-130-04S to CFD No. 9 with its Services and Special Tax.
g.            The time and place established under Council Resolution No. 2025-026 for the public hearing required under City Law are Thursday, March 13, 2025, at the hour of 9:20 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.
            At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 9, the extent of CFD No. 9 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 9, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 9 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 9 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 9, or against levying a specified Special Tax, those types of facilities or the specified special tax will be eliminated from the proceedings to annex to CFD No. 9.
    The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 9.
