CITY OF CLOVIS

NOTICE OF PUBLIC HEARINGS

WATER SUPPLY FEE

Notice is hereby given of two public hearings to be held on March 9, 2020 and March 16, 2020, both at 6:00 p.m. in the City of Clovis Council Chambers, 1033 5th Street, Clovis, California.

The purpose of the public hearings relates to the City’s proposed adoption of a new water supply fee (“Water Supply Fee”) to serve new development in the City.  An Ordinance authorizing the new Water Supply Fee will be introduced at the public hearing on March 9, 2020.  A second reading of the Ordinance will occur at the public hearing on March 16, 2020, and the City Council will consider approval of the Ordinance and the amount of the fee by Resolution.

The proposed Water Supply Fee is based upon two components: (1) the cost of acquiring new water resources (“Water Supply”) pursuant to the City’s September 1, 2019 Firm Surface Water Supply and Purchase Agreement with Fresno Irrigation District (“FID”); and (2) the cost of the City’s water banking facilities (“Water Banking”) as outlined in the agreements with FID governing those agreements, and identified in the September 1, 2019 Revised, Amended and restated Cooperative Agreement Between FID and the City for Water Utilization and Conveyance.  The two FID agreements are hereinafter referred to as the “FID Agreements”.

The Water Supply component is computed based on land use demands as estimated by the Water Master Plan, with a credit given to parcels located within FID boundaries that contribute a water supply.  The Water Banking component is based on the costs of the Water Banking facilities. Water Supply Fees will range from approximately $5,000 per acre for industrial uses to approximately $40,000 per acre for very high density residential uses. The Water Supply Fee for medium density single family home developments will be approximately $12,000 per acre.

The City has determined that the Water Supply Fee is necessary to pay for the Water Supply and Water Banking and that without the Water Supply Fee the City will not be able to meet its obligations under the FID Agreements.  If the City is not able to meet its obligations under the FID Agreements, the City will not be able to provide essential water services to new development, and this will result in a specific, adverse impact upon the public health or safety.  The City will also be unable to comply with California Government Code § 66473(b)(1), which requires that new subdivisions have a sufficient water supply as a condition of approval.

This public hearing notice is designed to satisfy two purposes.  First, it serves as the required notice under the Mitigation Fee Act, Government Code § 66000 et seq.  Second, it serves as notice under the Subdivision Map Act, Government Code § 66410 et. seq., and particularly § 66474.2(b), of the City’s intent to apply the new Water Supply Fee to all new project applications submitted to the City after the date of this public hearing notice (February 24, 2020), regardless of the effective date of the fee.  All project approvals will be conditioned on payment of the Water Supply Fee, or the City will be unable to serve the project.

NOTICE INVITING BIDS

NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to, installation of 134,000± square yards of rubberized cape seal in various local streets in the City of Clovis. The rubberized cape seal involves an application of rubberized asphalt chip seal and an application of Type II slurry seal at each location. The chip seal binder may contain 100% recycled California waste tires at a minimum of 15% (minimum 300 lbs. per ton) by weight in the asphalt binder. This project also involves installation of 222,400± square yards of Type II slurry seal to additional streets and Type I for Dry Creek Trail within the City boundary. See the scope of work in the Construction Specifications for details.

A complete listing of bid quantities is contained in the bid proposal form. Bids will be received for the complete work in accordance with the plans and specifications on file with the City Clerk at the Clovis Civic Center, Clovis, CA. Plans and specifications, forms of proposal, contract and special provisions can be downloaded free of charge from the vendor portal of PlanetBids, Inc., which is accessible on the City of Clovis website.

Bids must be filed with the City Clerk at the Clovis Civic Center prior to 2:00 p.m., Tuesday, March 24, 2020, at which time the City Clerk will open said bids. Bids shall be submitted in sealed envelopes and marked:

Bid Proposal: Rubberized Cape Seal 2020

No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer. Each bid must be accompanied by a certified or cashier’s check or bidder’s bond, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid. Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract. A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded. Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Clovis. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance. Pursuant to Public Contract Code Section 22300, substitution of securities for any monies withheld by the City of Clovis to ensure performance under the contract shall be permitted. In accordance with the provisions of Chapter 13 (commencing with Section 4590), Division 5, Title 1 of the Government Code of the State of California, securities may be substituted for monies withheld on the project.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done. Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612. A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.

All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form. The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”. Bidders for this project must possess a valid Class A, C12 or C32 License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal. A bidder, or a subcontractor listed in his bid proposal, must possess a valid Class C27 or C61D49 License. Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract. All representations made on the proposal are made under penalty of perjury.
