            Plaintiff has filed a civil complaint against you.  You may contest the validity of the above matter by appearing and filing with the Court a written responsive pleading to the complaint not later than March 26, 2021, which is ten (10) or more days after the completion of the publication of this summons in the Fresno Business Journal and the Hanford Sentinel.  Your pleading must be in the form required by the California Rules of Court.  Your original pleading must be filed in this Court with proper filing fees and proof that a copy thereof was served on Plaintiff’s attorney.  Unless you so respond, your default will be entered upon Plaintiff’s application, and the Plaintiff may apply to the Court for the relief demanded in the complaint.  Persons who contest the validity of the matter described below and in the complaint will not be subject to punitive action, such as wage garnishment or seizure of their real or personal property. 

            DETAILED SUMMARY OF THE MATTER THAT PLAINTIFF SEEKS TO VALIDATE: 

            The Mercy Springs Water District (the “District”) is a California water district located in Fresno County, with its principal office in Firebaugh, California.  Pursuant to applicable statutes and other authorities, the District is authorized to perform various duties and functions related to providing irrigation water to landowners within the District’s boundaries.  As pertinent here, the District is authorized to enter into contracts with and cooperate with the United States for irrigation purposes.  Beginning in 1967, the District has so contracted for water delivery with the United States Department of Interior, Bureau of Reclamation (“Reclamation”) for delivery of water through the federal Central Valley Project (“CVP”) water reclamation dams, canals, and other facilities.  The District transferred a large part of its contracted CVP water to third parties for agricultural purposes and retains some amounts for its landowners within the District.

            On December 16, 2016, the United States Congress enacted the Water Infrastructure Improvements for the Nation Act, Pub.L. 114-322 (2016) (the “WIIN Act”).  Pursuant to Section 4011(a) of the WIIN Act, in 2019, the District requested that Reclamation convert its existing water supply contract to a repayment contract under Section 9(d) of the 1939 Reclamation Project Act (53 Stat. 1187) (the “1939 Act”).  The District and Reclamation entered into negotiations for the Conversion Contract beginning in May 2019.  In July 2020, Reclamation posted the unexecuted negotiated Conversion Contract on its website for a public comment period.  After the comment period ended, Reclamation provided the unexecuted Conversion Contract to the District for the approval of the District’s Board of Directors and authorization for signature.  The Conversion Contract will provide continued water delivery to the District and shall remain in force unless or until the District does not make the annual payments for the delivered water.  A copy of the Conversion Contract is attached to the District’s complaint as Exhibit 2.  

            The District publicly noticed its special Board of Directors (the “Board”) meeting agenda on-site at the District and on the District’s website, notifying the public of the Board’s consideration of the Conversion Contract to be held on October 15, 2020.  At the Board meeting on October 15, 2020, the District’s Board approved the Conversion Contract and authorized the execution and delivery of the Conversion Contract to Reclamation, and related actions in furtherance of executing the Conversion Contract.  A copy of the Resolution is attached in the District’s complaint as Exhibit 1.

Description of Work: The project involves offloading and installing granular activated carbon (GAC) treatment vessels provided by others including piping, valves, instruments, and meters. Includes earthwork, grading, paving, concrete, surfacing, concrete foundations, steel backwash tank, yard piping, electrical and controls, a block building, fencing, walls, and associated improvements for treatment of water from City of Reedley Municipal Well 12. Also included is construction of approximately 1,870 feet of 12-inch and 14-inch piping connecting the treatment site to Well 12 and the City’s water distribution mains.

Each bid shall be submitted on a form furnished as part of the Contract Documents and must be accompanied by cash, a cashier’s check, a certified check, or a bidder’s bond executed by an admitted surety insurer, or substitute pursuant to Section 995.710 of the Code of Civil Procedure, in an amount not less than 10% of the amount of the bid, made payable to the order of or for the benefit of the City. The security of unsuccessful bidders will be returned by the City no later than sixty (60) days following the date of award. Each bid shall be sealed and delivered to the City at the location designated in this notice for the opening of proposals at or before the time in this notice provided. The City Council has obtained from the Director of the California Department of Industrial Relations a determination of the general prevailing rate of per diem wages and the general prevailing rate for legal holiday and overtime work in the locality in which said work is to be performed for each craft, classification, or type of worker needed. Not less than the determined rates shall be paid to all workers employed in the performance of the contract. Such rates of wages are on file with the Department of Industrial Relations and in the office of the City and are available to any interested party upon request.

Pursuant to Public Contract Code Section 22300, equivalent securities may be substituted for monies withheld to ensure performance of the contract. The City reserves the right to solely determine the adequacy of the securities being proposed by the Contractor and the value of those securities. The City shall also be entitled to charge an administrative fee, as determined by City in its sole discretion, for substituting equivalent securities for retention amounts. The City’s decisions with respect to the administration of the provisions of Section 22300 shall be final and shall include, but not be limited to, determinations of what securities are equivalent, the value of the securities, the negotiability of the securities, the costs of administration and the determination of whether or not the administration should be accomplished by an independent agency or by the City. The City shall be entitled, at any time, to request the deposit of additional securities of a value designated by City, in City’s sole discretion, to satisfy this requirement. If the City does not receive satisfactory securities within 12 consecutive days of the date of the written request, City shall be entitled to withhold amounts due Contractor until securities of satisfactory value to City have been received.

Notice is hereby given that the Board of Trustees of the State Center Community College District will receive sealed bids for the furnishing of all labor, materials, and services for Bid No. 2021-19, Camera Project, Reedley College.

Engineer’s estimate: $230,000.00

Bids must be made on a form prepared by the District and included in the contract documents. Due to Covid-19 Social Distancing, Bids will be received no later than March 11, 2021 at 2:00 PM, via EMAIL to Sofia McClellan ; sofia.mcclellan@scccd.edu, after which time they will be opened and tabulated and bid results will be e-mailed out and posted at www.fresnorepro.com on/after 2:30 p.m. Original Bid documents must be sealed, marked with bid number and title, and returned to the Purchasing Department of the State Center Community College District at NEW District Office location: 1171 Fulton St., Fresno, CA 93721. Bids must be postmarked within 24 hours of bid due date. Facsimile (FAX) copies of the bid will not be accepted.

A MANDATORY pre-bid conference will take place in person on March 1, 2021 at 8:30 a.m. Those attending the MANDATORY pre-bid conference shall meet in front of Reedley College Gym (grass area). Address: 995 N. Reed Ave., Reedley, CA 93654.

Prospective bidders shall be required to have a valid Class C7 or C10 Contractor’s License.

The successful bidder will be required to furnish a Payment Bond, a Performance Bond, Workers Compensation and General Liability, and Builder’s Risk Insurance as required by the Contract Documents. The successful bidder shall also be required to enter into a written agreement on a form provided by the District.

Bids must be accompanied by a bidder’s bond or certified check for at least ten (10%) of the amount of the bid and payable to the District, which shall be given as a guarantee that the bidder will enter into a contract if awarded the work. Said bond or certified check will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into the contract provided

by the District.

COVID-19 guidelines and procedures for all construction sites and workers at all public works must be implemented at all times. Each Bidder and all Subcontractors will be required to abide by the California Department of Industrial Relations (DIR) Division of Occupational Safety & Health Publications Unit SAFETY AND HEALTH GUIDANCE COVID-19 INFECTION PREVENTION IN CONSTRUCTION guidelines, https://www.dir.ca.gov/dosh/coronavirus/COVID-19-Infection-Prevention-in-Construction.pdf . Contactors and Subcontractors will be required to stay updated on any changes to the DIR guidelines and to make sure they remain within compliance.

Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code §1725.5 (“DIR Registered Contractor”). A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness. Pursuant to Labor Code §1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors. If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.

The Work is subject to payment of Prevailing Wage Rates (PWRs). The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided. Pursuant to Labor Code §1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.

The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference. Contractor must pay for any labor described or classified in an amount not less than rates specified.

Consistent with Public Contract Code section 22300, the District shall, at the request and expense of the Contractor, permit the substitution of securities or the payment of funds equivalent to the amount of monies withheld as retention from progress payments.

The Board of Trustees reserves the right to reject any or all proposals, waive any informality in the receiving of bids, and consider quality, convenience, and reasonable qualifications as well as price in making awards.

Proposed Flood Hazard Determinations for the City of Clovis, Fresno County, California, and Case No. 20-09-2182P.
