The special tax will annually pay for the cost of County Sheriff “police protection services” within Annexation Territory No. 11A, and certain related administrative costs of Community Facilities District No. 2006-01 (Police Protection Services) of the County of Fresno. The initial maximum special tax rates for the District are:

Pre-Bid Conferences:
Bidders for the following bid packages must attend at least one pre-bid conference in order to be eligible to submit a bid: JG3-1 Earthwork, JG3-2 Concrete, JG3-7 General Specialties, JG3-8 Plumbing & Site Utilities, and JG3-10 Electrical. Bids must be accompanied by a bidder’s bond, cashier’s check, or certified check for at least ten per cent (10%) of the amount of the base bid and made payable to the Owner, issued by an Admitted Surety (an insurance organization authorized by the Insurance Commissioner to transact business of insurance in the State of California during this calendar year), which shall be given as a guarantee that the bidder will enter into a contract if awarded the work and will be declared forfeited, paid to, or retained by the Owner as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the Owner after being requested to do so.
This Contract is subject to project-specific prequalification pursuant to Public Contract Code section 20111.6. If a bidder is not prequalified for this Project to bid on the Contract, Owner will not accept the bid. Any subcontractors the bidder lists for work requiring C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, or C-46 licenses must have current pre-qualified status with the Owner for this Project. Contractors not currently prequalified by the Owner for this Project must submit the prequalification application to the Owner by the date specified in the application. Bidders may obtain the Project-specific prequalification application from the Owner. The Owner’s approved contractor prequalification list for this Project will be posted on the Facilities Planning webpage. All prequalification packets must be submitted no later than 2:00 p.m., Friday February 28, 2025. Only bidders who have been prequalified on or before Friday, March 7, 2025, will be eligible to bid this project.
The Contractor shall be required to satisfy the conditions set forth in the contract and Education Code section 45125.2 regarding fingerprinting requirements and student safety prior to permitting any contact with students. Upon award of the contract and before beginning work, the Contractor shall be required to provide a verification of compliance with the student safety provisions of the contract and Education Code section 45125.2.
The Owner will require the successful Bidder to achieve the minimum goal of 3% DVBE (Disabled Veteran Business Enterprises) established in the bidding documents or to provide acceptable evidence of good faith efforts to do so accompanying the bid.
The successful bidder will be required to furnish a Payment (Labor and Material) Bond in the amount of one hundred per cent (100%) of the contract price, and a Faithful Performance Bond in the amount of one hundred per cent (100%) of the contract price, said bonds to be secured from an Admitted Surety (an insurance organization authorized by the Insurance Commissioner to transact business of insurance in the State of California during this calendar year), and satisfactory to the Owner. The surety insurers must, unless otherwise agreed to by Owner in writing, at the time of issuance of the bonds, have a rating not lower than “A-” as rated by A.M. Best Company, Inc. or other independent rating companies. Owner reserves the right to approve or reject the surety insurers selected by the successful bidder and to require the successful bidder to obtain bonds from surety insurers satisfactory to the Owner. The bidder will be required to furnish insurance as set forth in the Contract Documents.
The successful bidder will be allowed to substitute securities or establish an escrow in lieu of retainage, pursuant to Public Contract Code Section 22300, and as described in the General Conditions.
The Owner will not consider or accept any bids from contractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors. In accordance with Section 3300 of said Code, the Contractor shall have a license classification as described in the MULTIPLE PRIME CONTRACT SCHEDULE.
Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. Bidder shall state the public works contractor registration number on the designation of subcontractors form for each subcontractor performing more than one-half of one percent (0.5%) of the bidder’s total bid. No bid will be accepted nor any contract entered into without proof of the contractor’s and subcontractors’ current registration with the Department of Industrial Relations to perform public work. If awarded a Contract, the Bidder and its subcontractors, of any tier, shall maintain active registration with the Department of Industrial Relations for the duration of the Project. In bidding on this project, it shall be the Bidder’s sole responsibility to evaluate and include the cost of complying with all labor compliance requirements under this contract and applicable law in its bid.
The lowest bid shall be determined as follows: The lowest total of the prime bid on the base contract and the bids on all additive items and all deductive items. (Public Contract Code section 20103.8, subd. (b).) The District reserves the right to add or deduct any of the additive or deductive items from the project or contract after the lowest responsible and responsive bidder is determined.
The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages and rate for legal holidays and overtime work as set forth in the Agreement. The Contractor must pay for any labor therein described or classified in an amount not less than rates specified. Copies of the required rates are on file at the Owner’s business office and are available to any interested party on request.
The Owner reserves the right to waive any irregularity and to reject any or all bids. Unless otherwise required by law, no bidder may withdraw its bid for a period of 60 days after date set for the opening thereof.

RESOLUTION NO. 2025.01
AUTHORIZING THE LEASE OF
REAL PROPERTY TO THE STATE OF CALIFORNIA DEPARTMENT OF TECHNOLOGY FOR THE MIDDLE MILE BROADBAND INITIATIVE
WHEREAS, the State Center Community College District (“District”) is a community college district formed and organized pursuant to the laws of the State of California with the powers and purposes set forth in the Education Code; and
WHEREAS, the District owns certain real property upon which it operates the Madera Community College (MCC) campus, including the currently unoccupied portion of the campus, upon which the State of California Department of Technology (“CDT”) desires to lease a 50′ by 50′ area as depicted in the diagram attached as Exhibit A (the “District Property”).
WHEREAS, the CDT is an agency of the State of California and is currently undertaking the Middle Mile Broadband Initiative (“MMBI”) for the benefit of the citizens of the state of California in the Central Valley and other areas. The MMBI is intended to bring publicly owned and operated long haul fiber connectivity throughout the state to improve access and lower cost for broadband development in areas that the market has not solved for to date. Building long distance fiber networks requires periodic amplification stations (somewhat analogous to pumping stations on a pipeline or the aqueduct); and
WHEREAS, CDT engineers have identified the District Property as a good location for such an amplification station and negotiated a location, appropriate compensation and other terms with CDT that meets their needs and is out of the way of future campus development plans of the District and the college, as depicted in proposed drawings of the project set forth in Exhibit B (the “Project’).
WHEREAS, the proposed form of the Lease Agreement is attached hereto as Exhibit C (the “Lease”); and
WHEREAS, pursuant to Education Code section 81430 et seq., the governing board of any community college district may lease to any public agency (including the state and its agencies, any portion of property belonging to the District which is determined by the governing board to not be needed for school classroom buildings by the District; and
WHEREAS, pursuant to Education Code section 81431, any lease of real property from a community college district to any other public agency shall be upon the terms and conditions agreed to by the parties; and
WHEREAS, pursuant to Education Code section 81432, prior to execution of such a Lease of real property to any other public agency, the community college district is required to adopt, by unanimous vote, a resolution authorizing the sale and prescribing the terms of the sale, which following adoption, such resolution shall be published in a newspaper of general circulation within the community college district’s boundaries for once a week for three weeks prior to the final execution of the Lease; and
WHEREAS, the District now desires to approve the Lease with the CDT pursuant to the terms set forth in the Lease attached hereto as Exhibit C and authorize the Chancellor to complete all remaining requirements necessary to execute the Lease pursuant to this Resolution; and
NOW, THEREFORE, THE BOARD OF TRUSTEES OF THE STATE CENTER COMMUNITY COLLEGE DISTRICT DOES HEREBY FIND, DETERMINE AND DECLARE AS FOLLOWS:
1. That all of the recitals set forth above are true and correct.
2. The District Property is not needed for school classroom buildings by the District.
3. Pursuant to Education Code section 81432, the Board hereby authorizes the leasing of the District Property to CDT pursuant to the terms set forth in the Lease.
4. The District’s Chancellor or her designee is authorized and directed to publish this Resolution in accordance with Education Code section 81432, subsection (b).
5. The District’s Chancellor or her designee is authorized to execute the Lease on behalf of the District, subject to any further changes, insertions and omissions to the Lease as the Chancellor or her designee reasonably deems necessary.
6. The District’s Chancellor or her designee is further authorized and directed to execute and deliver any and all papers, instruments, opinions, certificates, affidavits and other documents and to do or cause to be done any and all other acts and things necessary or proper for carrying out this Resolution and said Lease.
