Family Code § 7860 Procedure for Appointment of Counsel

At the beginning of the proceeding on a petition filed pursuant to this part, counsel shall be appointed as provided in this article. The public defender or private co appointed as counsel pursuant to this article. The same counsel shall not to represent both the child and the child’s parent.

FamilyCode § 7861 Appointment to Protect Interests of Child

The court shall consider whether the interests of the child require the appointment of counsel. If the court finds that the interests of the child require representation by counsel, the court shall appoint counsel to represent the child, whether or not the child is able to afford counsel. The child shall not be present in court unless the child so requests or the court so orders.

Family Code § 7862 Appointment of Counsel for Parent

If a parent appears without counsel and is unable to afford counsel, the court shall appoint counsel for the parent, unless that representation is knowingly and intelligently waived.

Family Code § 7863 Compensation and Expenses of Private Appointed Counsel

TRAFFIC SIGNAL AT THE INTERSECTION OF SHIELDS AND WEBER AVENUES

BID FILE NUMBER: 3483-11787

The scope of work includes, but is not limited to: Installation of a new traffic signal at the intersection of Shields Avenue and Weber Avenue. Improvements include ADA compliant curb ramps, crosswalks, right and left turn lanes, signing and striping, and street lighting.

The Construction Allocation for this project is $800,000.

The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code.  The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City.  A copy of the resolution is on file at the Office of the City Clerk.  Actual wage schedules are available at Construction Management Office, 1721 Van Ness Avenue, Fresno, California 93721, (559) 621-5600.

Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting bids.

All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager and must be accompanied by a Bid Deposit in the amount of TEN PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount.  All Bid Deposits will be held until a Contract has been executed with the successful Bidder or all bids have been rejected.

Bidders are advised that, as required by federal law, the State of California has established a statewide overall DBE goal.  City of Fresno federal-aid contracts are considered to be part of the statewide overall DBEgoal and the City is required to report to the California Department of Transportation (Caltrans) on DBE participation for all Federal-aid contracts each year so that attainment efforts may be evaluated. 

Bidders are advised that, as required by federal law, the City of Fresno is implementing new Disadvantaged Business Enterprise requirements for Disadvantaged Business Enterprises (DBE).  The DBE goal for this Project is TWELVE PERCENT (12%).  DBE participation shall be calculated on the basis of the Total Net Bid Amount and on all possible combinations of the Base Bid plus Add Alternate(s), if applicable.

Bidders are advised that any award of the Contract will be conditioned on the successful Bidder meeting the good faith efforts to meet the established goal for this project pursuant to 49 CFR 26.53.

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN THAT the Board of Supervisors (“Board”) of the County of Fresno (“County”) held a public hearing on December 4, 2018 to consider and take action to adopt the proposed Ordinance amendment to Chapter 17.92, Title 17 of the Fresno County Ordinance Code of the Fresno County Ordinance Code relating to the collection of Development Fees within the Sphere of Influence of the City of Clovis; waive reading of the proposed Ordinance in its entirety and set a second hearing for adoption of the proposed Ordinance on January 8, 2019.

At the public hearing, the Board conducted a first reading of the proposed Ordinance considering its adoption, and set January 8, 2019 at the Board Chambers, Hall of Records, Third Floor, 2281 Tulare Street, Fresno, California, 93721, for the Board’s second reading and adoption of the proposed Ordinance.

The proposed Ordinance amendment updates the fees as recently adopted by the City of Clovis.  The Ordinance provides that Clovis development fees (“Fees”), which are set forth in Schedule of Fees to the proposed Ordinance, shall be charged by the County on behalf of the City of Clovis (“Clovis”) for any “discretionary development application” submitted to the County after the effective date of the Ordinance, and to be approved by the County, with respect to any development project within the Clovis sphere of influence (“Clovis SOI”). The County is adopting the proposed Ordinance under a memorandum of understanding with Clovis.

The purposes of the Fees, as applicable, are for Clovis to finance public facilities within Clovis and the Clovis SOI, which Clovis has determined are needed to mitigate adverse impacts caused by new development within the Clovis SOI. To that end, Clovis may use the Fees, as applicable, to (i) prevent deterioration of public facilities by constructing, improving, acquiring, providing, or planning for such public facilities financed by the fees concurrently with such development, and (ii) provide a source of funding to the County for a County library in Clovis that is necessary to serve such development.

The public hearing will be held under the provisions of the Mitigation Fee Act (Gov. Code, secs 66000 et seq.), and any related laws. This notice is given pursuant to Government Code, sections 6062a, 66017, and 66018. The proposed Ordinance will be effective commencing sixty (60) days following its adoption by the Board. 

A copy of the Schedule of Fees, and any data supporting the proposed Fees, will be available for public review at the office of the Clerk to the Board of Supervisors (“Clerk”), at the above address for the Board Chambers, on County business days between the hours of 8:00 AM and 5:00 PM. A copy of the Board agenda materials, including the proposed Ordinance, for the Board’s actions on this matter will be made available for public review, commencing on or about the Thursday immediately before the applicable Board public hearing or meeting date, at the office of the Clerk, and on the County’s Internet web site at www.co.fresno.ca.us.

SUMMARY OF PROPOSED ORDINANCE

This Ordinance amends Chapter 17.92 of the Ordinance Code of Fresno County relating to the collection of Development Fees within the Sphere of Influence of the City of Clovis per the provisions of Sections 4.1.3 and 4.1.4 of Article IV of the City/County Memorandum of Understanding (MOU).  On July 2, 2018, the Clovis City Council adopted Resolution No. 2018-91, which adopted the City of Clovis proposed master development fee schedule for 2018-19.  The City transmitted the signed resolution (City of Clovis, City Council Resolution No. 2018-91) and fee schedule to the County for the County’s adoption on October 2, 2018.  The current request is the eighth adjustment to the City’s fees since implementation of this process in 2005.

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN THAT the Board of Supervisors (“Board”) of the County of Fresno (“County”) will hold a public hearing on December 4, 2018 in the Board Chambers, Hall of Records, Third Floor, 2281 Tulare Street, Fresno, California, 93721, to consider and take action to adopt the proposed Ordinance amendment to Chapter 17.92, Title 17 of the Fresno County Ordinance Code of the Fresno County Ordinance Code relating to the collection of Development Fees within the Sphere of Influence of the City of Clovis; waive reading of the proposed Ordinance in its entirety and set a second hearing for adoption of the proposed Ordinance on January 8, 2019.

At the public hearing, the Board will conduct a first reading of the proposed Ordinance to consider its adoption, and set January 8, 2019 or as soon thereafter as the matter may be heard, at the Board Chambers, for the Board’s second reading and adoption of the proposed Ordinance (unless the Board orders a different date or location for taking such action).

The proposed Ordinance amendment updates the fees as recently adopted by the City of Clovis.  The Ordinance provides that Clovis development fees (“Fees”), which are set forth in Schedule of Fees to the proposed Ordinance, shall be charged by the County on behalf of the City of Clovis (“Clovis”) for any “discretionary development application” submitted to the County after the effective date of the Ordinance, and to be approved by the County, with respect to any development project within the Clovis sphere of influence (“Clovis SOI”). The County is adopting the proposed Ordinance under a memorandum of understanding with Clovis.

The purposes of the Fees, as applicable, are for Clovis to finance public facilities within Clovis and the Clovis SOI, which Clovis has determined are needed to mitigate adverse impacts caused by new development within the Clovis SOI. To that end, Clovis may use the Fees, as applicable, to (i) prevent deterioration of public facilities by constructing, improving, acquiring, providing, or planning for such public facilities financed by the fees concurrently with such development, and (ii) provide a source of funding to the County for a County library in Clovis that is necessary to serve such development.

The public hearing will be held under the provisions of the Mitigation Fee Act (Gov. Code, secs 66000 et seq.), and any related laws. This notice is given pursuant to Government Code, sections 6062a, 66017, and 66018. The proposed Ordinance will be effective commencing sixty (60) days following its adoption by the Board. 

A copy of the Schedule of Fees, and any data supporting the proposed Fees, will be available for public review at the office of the Clerk to the Board of Supervisors (“Clerk”), at the above address for the Board Chambers, on County business days between the hours of 8:00 AM and 5:00 PM. A copy of the Board agenda materials, including the proposed Ordinance, for the Board’s actions on this matter will be made available for public review, commencing on or about the Thursday immediately before the applicable Board public hearing or meeting date, at the office of the Clerk, and on the County’s Internet web site at www.co.fresno.ca.us.

Anyone may attend the public hearing and meeting of the Board and make any oral or written presentations at that time. In addition, if you wish to submit any written comments to the Board on this matter in advance of the hearing or meeting, you may deliver those comments, either personally or by mail, to the Clerk at the above address. If you wish to present any such written comments to the Board, you are encouraged to do so sufficiently in advance of the public hearing or meeting so that County staff and the Board can have enough time to take your comments into consideration in advance of the Board hearing.

Bids must be made on a form prepared by the District and included in the contract documents.  Bids will be received no later than Wednesday, December 19, 2018 at 2:00 PM after which time they will be opened and read aloud.  Bids must be sealed, marked with bid number and title, and returned to the Purchasing Department of the State Center Community College District at 1525 E. Weldon Ave, Fresno, CA 93704.  Facsimile (FAX) copies of the bid will not be accepted.

A pre-bid conference has been scheduled on Wednesday, December 5, 2018 @ 10:00AM. Those attending the non-mandatory pre-bid conference shall meet at the Entrance of the New District Office Building (corner of Fulton & Fresno Street).

Prospective bidders shall be required to have a valid Class C20 Contractor’s License.

The successful bidder will be required to furnish a Payment Bond, a Performance Bond, Workers Compensation and General Liability Insurance as required by the Contract Documents.  The successful bidder shall also be required to enter into a written agreement on a form provided by the District.

Bids must be accompanied by a bidder’s bond or certified check for at least ten (10%) of the amount of the bid and payable to the District, which shall be given as a guarantee that the bidder will enter into a contract if awarded the work. Said bond or certified check will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the District.

Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code §1725.5 (“DIR Registered Contractor”).  A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness.  Pursuant to Labor Code §1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors.  If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.

The Work is subject to payment of Prevailing Wage Rates (PWRs).  The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided.  Pursuant to Labor Code §1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.

The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference. Contractor must pay for any labor described or classified in an amount not less than rates specified.

Consistent with Public Contract Code section 22300, the District shall, at the request and expense of the Contractor, permit the substitution of securities or the payment of funds equivalent to the amount of monies withheld as retention from progress payments.

The Board of Trustees reserves the right to reject any or all proposals, waive any informality in the receiving of bids, and consider quality, convenience, and reasonable qualifications as well as price in making awards.
