            DETAILED SUMMARY OF THE MATTER THAT PLAINTIFF SEEKS TO VALIDATE: 

            Tranquillity Irrigation District (“District”) is a California irrigation district located in Fresno County, California.  Pursuant to applicable statutes and other authorities, the District is authorized to perform various duties and functions related to providing irrigation water to landowners within the District’s boundaries.  As pertinent here, the District is authorized to enter into contracts with and cooperate with the United States for irrigation purposes.  Beginning in 1963, the District has so contracted for water delivery with the United States Department of Interior, Bureau of Reclamation (“Reclamation”) for delivery of water through the federal Central Valley Project (“CVP”) water reclamation dams, canals, and other facilities, and more specifically, through the Delta-Mendota Canal.  The District uses the contracted CVP water to provide irrigation water to its customers in the District.

            On December 16, 2016, the United States Congress enacted the Water Infrastructure Improvements for the Nation Act, Pub.L. 114-322 (2016) (the “WIIN Act”).  Pursuant to Section 4011(a) of the WIIN Act, in 2019, the District requested that Reclamation convert its existing water supply contract to a repayment contract under Section 9(d) of the 1939 Reclamation Project Act (53 Stat. 1187) (the “1939 Act”).  The District and Reclamation entered into negotiations for the Conversion Contract beginning on May 2019.  In July 2020, Reclamation posted the unexecuted negotiated Conversion Contract on its internet website for a 60-day public comment period.  After the comment period ended, Reclamation provided the unexecuted Conversion Contract to the District for the approval by the District’s Board of Directors and authorization for signature.  The Conversion Contract will provide continued water delivery to the District and its customers and shall remain in force unless or until the District does not make the annual payments for the delivered water.  A copy of the Conversion Contract is attached to the District’s complaint as Exhibit 2.  

            The District publicly noticed its special Board of Directors (the “Board”) meeting agenda on its website and on-site at the District, notifying the public of the Board’s consideration of the Conversion Contract to be held on October 14, 2020.  At the public Board meeting on October 14, 2020, the District’s Board approved the Conversion Contract and authorized its execution and delivery to Reclamation, and related actions in furtherance of executing the Conversion Contract.  A copy of the Resolution is attached in the District’s complaint as Exhibit 1.

            The District brought this validation action to confirm the validity of the Conversion Contract and the proceedings related thereto.  The validation complaint, the accompanying exhibits, and a copy of this Summons are available on the District’s offices and its internet website at:

SUMMARY OF ORDINANCE

2019 HOUSING LEGISLATION URGENCY ORDINANCE EXTENSION

On December 7, 2020, the Clovis City Council adopted Urgency Ordinance 20-17 which extends Urgency Ordinance No. 19-21 (adopted on December 16, 2019 and extended on January 21, 2020) for up to 12 months.  Urgency Ordinance No. 19-21 amended various sections of Title 9 of the Clovis Municipal Code (“Development Code”) to bring the Development Code into compliance with recently enacted State laws (“2019 Housing Laws”) related to procedures and standards for housing development projects, density bonus, accessory dwelling units (“ADUs”), and other housing-related concerns.

The interim ordinance extended by Urgency Ordinance 20-17 does the following:

Chapter 9.26 of Title 9: Adds a new category of housing developments eligible for a density bonus, along with the corresponding density bonus and the number of incentives or concessions for which such housing developments are eligible.

Section 9.40.020 of Title 9: Replaces Section 9.40.020 in its entirety to reflect the standards, procedures, and permitted accessory dwelling unit (“ADU”) and junior accessory dwelling unit (“JADU”) structures required by Government Code sections 65852.2 and 65852.22.

Section 9.40.200 of Title 9: Adds Low Barrier Navigation Center developments as a use by right in areas zoned for mixed use and nonresidential zones permitting multifamily uses, if State law requirements are satisfied.

Chapter 9.50 of Title 9: Adds a procedure for filing a preliminary application for housing developments and the effect thereof; adds procedures and timelines for review, acceptance, and approval of preliminary and final applications for housing developments; adds special requirements for housing developments in urbanized areas; revises and expands procedures and timelines for streamlined ministerial review of certain housing development projects, including moderate-income multifamily housing.

Chapter 9.77 of Title 9: Adds a chapter that establishes and incorporates objective standards for housing developments and a ministerial review process for qualifying housing developments.

A motion to approve Urgency Ordinance 20-17 was made by Councilmember Ashbeck and seconded by Councilmember Flores. The motion was approved by a unanimous vote.

Hydrogeological Support Services for Well DESIGN, construction, Inspection, TESTING, Rehabilitation, and Reporting

The City of Fresno, Department of Public Utilities, is requesting SOQs from qualified Hydrogeologists to provide support services for well design, construction, inspection, testing, rehabilitation, and reporting. The selected Hydrogeologist will support for the City during the design, construction, development, testing, and reporting of new groundwater monitoring wells and municipal water supply wells, as well as advise the City during the inspection and rehabilitation of existing municipal water supply wells. The City anticipates offering the initial time and materials contract not to exceed $45,000 for a one (1) year period. 

This Request for Qualifications is to provide the City with information on firm’s qualifications to provide said services. To be considered, the firm must be State of California Licensed Professional Geologist and Hydrogeologist and have extensive experience and knowledge in all phases of well construction, development, inspection, testing, rehabilitation, and reporting.
