Plaintiff, CITY OF FRESNO, a municipal corporation, psi, Administered by RISICO CLAIMS MANAGEMENT, formerly AMERICAN ALL-RISK LOSS ADMINISTRATORS, (hereinafter “CITY”), complains of Defendants, and each of them, and for a cause of action, alleges as follows:
1. Defendant, NORRIS SHANE COBB, II (hereinafter “COBB”) is an individual residing in the City of Fresno, County of Fresno, and State of California.
2. The true names or capacities, whether individual, corporate, associate, or otherwise of Defendants, DOES 1 through 50, inclusive, are unknown to Plaintiff who therefore sues said Defendants by said fictitious names, and leave of court will be asked to amend this complaint to show their true names and capacities when the same have been ascertained.
3. That at all times herein mentioned, Defendants, and each of them, were the agents, servants and employees of the other named Defendants and were acting at all times herein mentioned within the scope of their agency and employment and with the knowledge and consent of their principals and employers.
4. That at all times herein mentioned, Plaintiff was and now is a municipal corporation organized and existing under and by virtue of the laws of one of the States of the United States and is permissibly self-insured for workers’ compensation liability and is legally obligated to discharge any liability for workers’ compensation benefits imposed by the Workers= Compensation laws of the State of California.
5. That at all times herein mentioned, FRESNO POLICE DEPARTMENT, functioning as an Agency for the CITY, was the employer of Scott Payn.
6. RISICO CLAIMS MANAGEMENT, formerly AMERICAN ALL-RISK LOSS ADMINISTRATORS, is a Corporation duly organized and existing under and by virtue of the laws of the State of California and is a third-party administrator that administers the claims of the CITY OF FRESNO and in particular administered the workers’ compensation claim of Scott Payn at all times herein.
7. That on or about July 28, 2012, Defendant COBB undertook the acts which form the basis of this Complaint in Fresno, California.
FIRST CAUSE OF ACTION
INTENTIONAL BATTERY BY COBB
8. Plaintiffs incorporate paragraphs 1 through 7 above as though fully set forth herein.
9. That on or about July 28, 2012, Officer Scott Payn was on duty in the course and scope of employment with the FRESNO POLICE DEPARTMENT, at or near 1634 W. Saginaw in Fresno, California, and there approached Defendant COBB in an attempt to detain and question him about a burglary at 1634 W. Saginaw Avenue, Fresno, California. At that time COBB intentionally physically battered Officer Payn by tackling him and fighting him. The physical battering by Defendant COBB caused bodily harm to Officer Payn.
10. That at all time herein mentioned 1634 W. Saginaw Avenue was located in the City of Fresno, in the County of Fresno, in the State of California.
11. That as a direct and proximate result of COBB’s intentional conduct, Officer Scott Payn suffered bodily injuries requiring medical treatment.
12. That as a proximate result of COBB’s intentional conduct, Plaintiff, CITY, a municipal corporation, has been obligated to pay, pursuant to the Workers’ Compensation Act of the State of California, workers= compensation benefits to and on behalf of Officer Scott Payn in the amount of $37,170.33 and continuing.
13. That Plaintiff is informed and believes and on such information and belief alleges that it will be required to pay further sums for medical care and treatment for an indefinite time in the future.
14. That as a proximate result of COBB’s intentional conduct, Plaintiff has suffered and will continue to suffer expenses, costs and attorneys’ fees. Pursuant to Labor Code ‘ 3856, plaintiff prays for such attorneys’ fees, costs and expenses as allowed by law.
SECOND CAUSE OF ACTION
NEGLIGENCE BY COBB
15. Plaintiff incorporates paragraphs 1 through 14 above as though fully set forth herein.
16. That on or about July 28, 2012, as Officer Scott Payn, while on duty in the course and scope of employment with the FRESNO POLICE DEPARTMENT, at or near 1634 W. Saginaw Avenue, Fresno, California, was attempting to lawfully approach and question Defendant COBB, Defendant COBB so negligently conducted himself as to cause bodily harm to Officer Scott Payn.
17. That as a direct and proximate result of COBB’s negligent conduct, Officer Scott Payn suffered bodily injuries requiring medical treatment.
18. That as a proximate result of COBB’s negligent and careless conduct, Plaintiff, CITY, a municipal corporation, has been obligated to pay, pursuant to the Workers’ Compensation Act of the State of California, workers= compensation benefits to and on behalf of Officer Scott Payn in the amount of $37,170.33 and continuing.
19. That Plaintiff is informed and believes and on such information and belief alleges that it will be required to pay further sums for medical care and treatment for an indefinite time in the future.
20. That as a proximate result of COBB=s negligent conduct, Plaintiff has suffered and will continue to suffer expenses, costs and attorneys’ fees. Pursuant to Labor Code ‘ 3856, Plaintiff prays for such attorneys’ fees, costs and expenses as allowed by law.
THIRD CAUSE OF ACTION
NEGLIGENCE PER SE BY COBB
21. Plaintiffs incorporate paragraphs 1 through 20 above as though fully set forth herein.
22. That on or about July 28, 2012, as Officer Scott Payn, while on duty in the course and scope of employment with the FRESNO POLICE DEPARTMENT, at or near 1634 W. Saginaw in Fresno, California, was attempting to lawfully approach and question Defendant COBB. Defendant COBB attempted to resist lawful arrest by Officer Scott Payn.
23. That by resisting arrest, Defendant COBB violated California Penal Code ‘69, Resisting Executive Officers.
24. The violation of Cal. Pen. Code ‘69 was the proximate cause of injuries sustained by Officer Scott Payn.
25. The physical injury Officer Scott Payn sustained is one of the types of injuries that Cal. Pen. Code ‘69 is designed to prevent.
26. Police Officers are the types of Executive Officers that are meant to be protected by Cal. Pen. Code 69 (People v. Buice, 230 Cal. App. 2d 324).
27. That as a proximate result of COBB’s conduct, Plaintiff, CITY, a municipal corporation, has been obligated to pay, pursuant to the Workers’ Compensation Act of the State of California, workers’ compensation benefits to and on behalf of Officer Scott Payn in the amount of $37,170.33 and continuing.
28. That Plaintiff is informed and believes and on such information and belief alleges that it will be required to pay further sums for medical care and treatment for an indefinite time in the future.
29. That as a proximate result of COBB’s conduct, Plaintiff has suffered and will continue to suffer expenses, costs and attorneys’ fees. Pursuant to Labor Code ‘ 3856, Plaintiff prays for such attorneys’ fees, costs and expenses as allowed by law.
30. Plaintiff is informed and believes defendant COBB was convicted of a felony for violation of Penal Code ‘69. As such, plaintiff seeks attorney’s fees under Code of Civil Procedure ‘1021.4.
WHEREFORE, Plaintiff prays judgment against Defendants for:
(1) Workers’ Compensation benefits paid to or on behalf of Scott Payn in an amount currently of $37,170.33 and continuing, according to proof;
(2) For future disability benefits and costs of medical care and treatment according to proof;

Notice is hereby given that on November 2, 2017; the City Council of the City of Fresno (“City”) adopted Council Resolution 2017-304 to amend Annexation No. 54, Final Tract Map No. 6073, of the City of Fresno Community Facilities District No. 11 (“CFD No. 11”), to change the rate and method of apportioning the special tax and to establish a new Maximum Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”). Under this City Law and Resolution 2017-304, the City gives notice as follows:
The text of Resolution 2017-304, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof. The text of Resolution 2017-304 is summarized as follows:
The purpose of CFD No. 11 is to provide financing for the maintenance of the landscaping and irrigation systems, open spaces, trails, concrete curbs, gutters, medians, hardscaping and sidewalks, street lights, local street paving and street name signage plus any added developer requested features (“Services”) located in street, landscaping and open space easements and public properties associated with the subdivision as more fully described in Resolution 2017-304 and Exhibit A thereto.
The method of financing the Services is through the imposition and levy of a new Maximum Special Tax (“Special Tax”) to be apportioned on the properties in Annexation No. 54 of CFD No. 11 under the revised rate and method of apportionment described in Resolution 2017-304 and Exhibit B thereto. The Special Tax requires the approval of two-thirds of the qualified electors of CFD No. 11 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.
The Special Tax, if approved, will be used to finance all or a portion of the Services.
The Director of Public Works of the City or his designee is directed to cause to be prepared an amended written report for Annexation No. 54 of CFD No. 11 (“Amended District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 11 and the estimated costs of the Services. The Amended District Report will be made a permanent part of the record of the public hearing specified below. Reference is made to the Amended District Report as filed with the City Clerk.
As set forth below, the City will hold a public hearing on the amendment of Annexation No. 54 of CFD No. 11, Final Tract Map No. 6073.
e. The time and place established under Resolution 2017-304 for the public hearing required under City Law are Thursday, December 7, 2017, at the hour of 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.
At the hearing, the testimony of all interested persons or taxpayers for or against the proposed amendment to Annexation No. 54 of CFD No. 11 will be heard. Any person interested may file a protest in writing as provided by City Law. If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in Annexation No. 54 of CFD No. 11, or the owners of one-half or more of the area of land in Annexation No. 54 of CFD No. 11 and not exempt from the Special Tax, file written protests against the amendment to Annexation No. 54 of CFD No. 11 and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to amend Annexation No. 54 of CFD No. 11 or levy the new Special Tax for a period of one-year from the date of the decision of the City.
The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 11.

CITY OF CLOVIS SUMMARY OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLOVIS AMENDING SECTION 9.58.040 AND ADDING SECTION 9.58.070, OF CHAPTER 9.58, OF TITLE 9, OF THE CLOVIS MUNICIPAL CODE PERTAINING TO HOME OCCUPATION PERMITS
On December 11, 2017, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council will consider a request to amend Section 9.58.040 and adding Section 9.58.070, of Chapter 9.58, of Title 9, of the Clovis Municipal Code pertaining to home occupation permits. Over the past year, the City of Clovis has begun to receive complaints regarding short term vacation rentals. There is currently nothing in the municipal code regulating short term vacation rentals. Short term rental generally means the rental of a dwelling by the owner to another person for a period of less than thirty (30) consecutive days. This does not include city-approved hotels, motels, bed and breakfasts, and time-share projects. This ordinance amendment would require a home occupation permit for operation of short term vacation rentals and implement operating regulations and standards.

NOTICE INVITING INTERESTED CONTRACTORS FOR THE 2018 INFORMAL BID LIST
FOR
STATE CENTER COMMUNITY COLLEGE DISTRICT
In accordance with the State of California Uniform Public Construction Cost Accounting Commission (CUPCCAA), the State Center Community College District is inviting all interested licensed contractors to submit their company for inclusion on the District’s Informal Bidding Contractors List for the calendar year 2018.
You must resubmit to be included on the 2018 list even if your company has submitted an application in prior years.
Per California Public Contract Code 22032, any Public Works Project that is estimated to be $175,000 or less is subject to the Informal Bidding Procedures set forth by the State of California Uniform Construction Cost Accounting Commission. All trade categories are subject to Informal Bidding Procedures. Contractors that are interested in being on the 2018 Informal Bidding Contractors List are required to have a current license and are subject to verification through the Contractors State License Board.
Additionally, pursuant to SB854, no contractor or subcontractor may be listed on a bid for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations (DIR) and no contractor or subcontractor may be awarded a contract for a public works project (awarded on or after April 1, 2015) unless registered with the DIR per California Labor Code section 1725.5.

PROPOSED VACATION OF NORTH CARNEGIE AVENUE BETWEEN THE UNION PACIFIC RAILROAD RIGHT-OF-WAY AND WEST BULLARD AVENUE
The Council of the City of Fresno, State of California, pursuant to the provisions of the Public Streets, Highways, and Service Easements Vacation Law, being Sections 8300-8363 of the California Streets and Highways Code, has adopted Resolution of Intention No. 1118-D to vacate a portion of North Carnegie Avenue between Union Pacific Railroad and West Bullard Avenue.
