NOTICE INVITING BIDS PURSUANT TO PUBLIC CONTRACT CODE 22000, ET SEQ.

(THE UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT)

Notice is hereby given that the Fresno Unified School District (“DISTRICT”) will receive sealed bids for Bid No. 22-22, Multipurpose Room Audio/Visual System  Upgrades at Various School Sites – Group B, to remove existing and install new audio/visual systems in the multipurpose rooms.

Notice is hereby given pursuant to the provisions of Section 1770 et seq of the California Labor Code, each worker of the contractor and any of its subcontractors engaged in work on the Project shall be paid not less than the prevailing wage rate. The project is subject to compliance monitoring and enforcement by the Department of Industrial Relations (DIR).

Pursuant to Labor Code Section 1725.5, the DIR established a Contractor Registration Program, in which no contractor or subcontractor shall bid on, be listed in a bid, or engage in the performance of any public work contract without being registered.

Prime Contractor must have a valid Class “C-7” or “C-10” Contractor’s  License.

A MANDATORY pre-bid conference has been scheduled at 10:00 AM, December 2, 2021 in front of the Administration Office at Terronez Middle  School, 2300 S. Willow Ave, Fresno, CA 93725.  Contractors bidding as a Prime Contractor for the project must attend in order for their bid to be “responsive”.  Immediately following the pre-bid conference will be a mandatory job-walk of the site.

On or about December 7, 2021 the County of Fresno will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of the Lead-Based Paint Hazard Control Grant Program (LBPHC) as authorized by Section 1011 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (Title X of the Housing and Community Development Act of 1992, 42 U.S.C. 4852) with funding provided by the Consolidated Appropriations Act, 2017 (Public Law 115-31), approved May 5, 2017. The Lead-Based Paint Hazard Control Program funding is authorized under Section 502 of the Housing and Urban Development Act of 1970 (12 U.S.C. 1701z-2) for the following multi-year program/project, which covers a period of time from November 1, 2021 to April 30, 2025.  The Lead-Based Paint Hazard Control Program will be applied in removing lead hazards from 133 units of low-income housing in Fresno County. The grant will also increase lead awareness through community events, presentations, workshops and meetings, consultations, agency and community-based collaborations, targeted mailings, and build the capacity for maintaining affordable lead-safe housing. The targeted area for the grant includes zip codes 93648, 93662, 93702, 93703, and 93706 in the County of Fresno. The County is requesting the release of $3,000,000.00 of HUD Lead-Based Paint Hazard Control Grant funds and $48,653.17 of County local funds.

The proposed hazard control activities to be funded under this program are categorically excluded from the National Environmental Policy Act requirements, but subject to compliance with some of the environmental laws and authorities listed at § 58.5 of 24 CFR Part 58. In accordance with §58.15, a tiered review process has been structured, whereby some environmental laws and authorities have been reviewed and studied for the intended target areas listed above. Other applicable environmental laws and authorities will be complied with, when individual projects are ready for review. Specifically, the target areas have been studied and compliance with the following laws and authorities have been established in this Tier 1 review:  Airport Hazards, Coastal Barrier Resources, Air Quality, Coastal Zone Management, Endangered Species, Explosive and Flammable Hazards, Farmlands Protection, Floodplain Management, Noise Abatement and Control, Sole Source Aquifers, Wetlands Protection, Wild and Scenic Rivers, and Environmental Justice. In the Tier 2 review, compliance with environmental laws and authorities for the following will take place for proposed projects funded under the program listed above:  Flood Insurance, Contamination and Toxic Substances, and Historic Preservation. Should individual aggregate projects exceed the threshold for categorical exclusion detailed at §58.35(a), an Environmental Assessment will be completed and a separate Finding of No Significant Impact and Request for Release of Funds published. White in his capacity as Director of the Department of Public Works and Planning, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Fresno County to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the County of Fresno’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of Fresno; (b) the County of Fresno has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Karen M. Senate Bill 854, signed into law June 20, 2014, became effectively immediately. It established a new public works contractor registration program which will collect fees to fund compliance monitoring and enforcement, determine prevailing wage and public works coverage, and hear enforcement appeals.

All contractors and subcontractors intending to bid or perform work on public works projects will be required to register, and annually renew, online for the program. The cost to register for the program is currently $400.00 and is non-refundable. This is a DIR fee paid to the State. The City will not register a contractor, nor collect funds.

Public works refers to construction, alteration, demolition, installation, or repair work (including maintenance) done under contract and paid by public funds. For a more detailed explanation of public works projects, refer to California Labor Code 1720 -1720.6.

If the services you may provide the City in the future, fall under the definition of “public works”, please ensure you are registered with the DIR. Effective immediately, the City will be required to fill out a form alerting the DIR of the services you are providing the City. Detailed information is required to complete this form. If the services you are currently providing the City fall under “public works” you may be asked to provide information needed to complete the DIR form. You will be asked to complete this in a timely manner to avoid interruption in the services you are providing.
