Unless you so respond, your default will be entered upon Plaintiff’s application, and the Plaintiff may apply to the Court for the relief demanded in the complaint. Persons who contest the validity of the matter described below and in the complaint will not be subject to punitive action, such as wage garnishment or seizure of their real or personal property.
DETAILED SUMMARY OF THE MATTER THAT PLAINTIFF SEEKS TO VALIDATE:
The California Department of Water Resources (Department) operates facilities which conserve, store, transport and deliver water to urban and agricultural water agencies throughout the State. Since 1960, the Department has approved, planned and constructed a system of water storage and transportation and power generation facilities (the State Water Project). Currently, State Water Project water is conveyed across the Sacramento-San Joaquin Delta through the natural channels of the Delta formed by the confluence of the Sacramento and San Joaquin Rivers, as those channels have been modified over the past 150 years.
The Department has undertaken to develop a comprehensive plan for the effective delivery of State Water Project water across the Delta. The Department is currently undertaking planning and design activities regarding potential new Delta conveyance facilities. The facilities under review would transport water from new intake points on the Sacramento River at the northern edge of the Delta through an underground tunnel running below the natural waterways of the Delta to State Water Project export facilities at or below the southern edge of the Delta. These facilities would be a further modification of the Feather River Project authorized pursuant to the Central Valley Project Act, Water Code sections 11100 et seq.
The Department has established a proposed revenue bond financing to finance the cost of the environmental review, planning, engineering and design, and if and when appropriate, the acquisition and construction of Delta conveyance facilities. On January 6, 2025, the Department adopted a bond resolution authorizing the issuance of revenue bonds for those purposes. Under the bond resolution, bonds for construction cannot be issued unless specific conditions precedent are satisfied, which include regulatory and statutory requirements regarding the physical and environmental aspects of approving, constructing, and operating Delta conveyance facilities.
On January 7, 2025, the Department filed a validation action to confirm the legal validity of the Department’s proposed bond financing. A validation action is a judicial proceeding in which a governmental agency, like the Department, can confirm the validity of a proposed financial transaction before it commits to or undertakes the transaction. The Department’s validation complaint, the bond resolution, and a copy of this Summons are available on the Department’s internet website at: https://water.ca.gov/Programs/State-Water-Project/Delta-Conveyance/Public-Information.

On February 13, 2025 at the time of day indicated below, or as soon thereafter as possible, a public hearing will be held in Room 301, Hall of Records, Tulare and “M” Streets, Fresno, California, to consider all items contained within this agenda that are subject to the provisions of either the Fresno County Ordinance Code or the California State Planning Law. The Commission will also determine whether a Negative Declaration, Mitigated Negative Declaration or an Environmental Impact Report is appropriate on all projects for which an Initial Study (IS) has been prepared. 1.   UNCLASSIFIED CONDITIONAL USE PERMIT NO. 3696 filed by SAR 1, LLC. proposing to allow a first one-year time extension to exercise CUP 3696 which authorized the installation and operation of two anaerobic digesters and a biomethane facility to produce commercial grade biogas for conveyance to an existing utility owned pipeline, via an existing point of interconnection at a previously approved digester site; and allow the construction of an approximately 3.5-mile-long underground pipeline, which will connect the proposed biomethane facility to the existing utility owned pipeline. The project will be located on portions of three adjacent parcels, a 159.26 acre, a 98.14-acre and 48.48-acre parcel; and the proposed pipeline will traverse six additional parcels to the point of interconnection, at the previously approved digester site, in the AE-20 (Exclusive Agricultural, 20-acre minimum parcel size) Zone District. The project site is located approximately 0.5 miles west of S. Jameson Avenue, between W. Floral Avenue, and W. Nebraska Avenue; the proposed pipeline route would extend southwesterly to an existing dairy site located approximately one half mile northeast of the intersection of W. Kamm Avenue and the S. Bishop Avenue alignment, and approximately 4 miles northeast of the unincorporated community of Helm (APNs: 041-030-47S, 48S, 20S, 041-020-30S, 29S, 31S, 32S, 27S, 041-060-60S) (11511 W. Floral Avenue) (Sup. Dist. 4).

Notice is hereby given that the Board of Supervisors of the County of Fresno has set this hearing for Tuesday, the 11th day of February, 2025, at the hour of 9:30 A.M. (or as soon thereafter as possible), in the Board of Supervisors Chambers, Room 301, Hall of Records, 2281 Tulare St., Fresno, California, as the time and place for holding a public hearing on the following matter:
Allow the construction, operation, maintenance, and decommissioning of the Sonrisa Solar Project (Project), of a photovoltaic (PV) solar electricity generating up to 200 megawatts and an energy facility with a capacity of approximately 184 on approximately 2,000 acres.
The Project would connect to the electrical grid via an approximately 0.2-mile gen-tie connection to an existing 3.3 mile long 230 kilovolt (kV) gen-tie through an adjacent energy project which connects to the existing Tranquillity Switching Station, which is operated by Pacific Gas and Electric Company (PG&E). The requested term for the CUP is 35 years.
The approximately 2,000-acre site, is located in western Fresno County, generally is bounded by State Route 33 (SR 33 also known as South Derrick Avenue) to the west, West Manning Avenue to the south, South Merced Avenue to the east, and West Adams Avenue to the north, West South Avenue bisects the site from east to west, approximately 7 miles west of the unincorporated community of Tranquillity, consisting of Assessor Parcel Numbers below: (Sup.
