NOTICE TO ALL PERSONS INTERESTED IN THE MATTER OF (AVISO PARA TODAS PERSONAS INTERESADOS EN EL ASUNTO DE): THE CONTRACT BETWEEN THE UNITED STATES AND WESTLANDS WATER DISTRICT PROVIDING FOR PROJECT WATER SERVICE FROM DELTA DIVISION AND FACILITIES REPAYMENT.
This matter concerns the Contract Between the United States and Westlands Water District (“District”) providing for Central Valley Project water service and facilities repayment, which the District Board of Directors, on September 15, 2020, authorized for execution and delivery, in substantially the form presented to it, as set forth in Resolution No. 124-20 (“Repayment Contract”), and which the parties fully executed.
The specific Repayment Contract is Contract No. 14-06-200-7823J-LTR1-P, entitled “Contract Between the United States and Westlands Water District Providing for Project Water Service From Delta Division and Facilities Repayment” based upon the water assigned under the agreement for partial assignment between the District and Oro Loma Water District and the subject of Resolution No. 124-20.
The District seeks a judicial decree, pursuant to California Code of Civil Procedure section 860, et seq., determining that the proceedings on the part of the District for the authorization of the execution of the Repayment Contract were in all respects legal and valid under applicable California law.
All persons interested in this matter may contest the legality or validity of the proceedings by appearing and filing a written answer to the complaint not later than February 23, 2021. Unless you respond timely, a default will be entered upon application by the Plaintiff, and the Plaintiff may apply to the Court for the relief demanded in the complaint. Persons who contest the legality or validity of the proceedings will not be subject to punitive action, such as wage garnishment or seizure of their real or personal property. You may seek the advice of an attorney in any matter connected with the complaint or this summons. Such attorney should be consulted promptly so that your pleading may be filed or entered within the time required by this summons.
DETAILED SUMMARY OF THE MATTER THAT PLAINTIFF SEEKS TO VALIDATE:
The District previously acquired by assignment certain rights to Central Valley Project water. The specific agreement which effected the assignment is a March 1, 2012, partial assignment agreement between the District and Oro Loma Water District based upon Oro Loma Water District’s water service contract. Based upon this assignment, the District and the United States subsequently entered into Contract No. 14-06-200-7823J, which provides for water service from Central Valley Project facilities from March 1, 2012, through February 28, 2030 (“Water Service Contract”).
On December 16, 2016, the 114th Congress of the United States of America enacted the Water Infrastructure Improvements for the Nation Act (Pub. L. 114-322, 130 Stat. 1628) (“WIIN Act”). Section 4011(a)(1) of the WIIN Act provides that: “upon request of the contractor, the Secretary of the Interior shall convert any water service contract in effect on the date of enactment of this subtitle and between the United States and a water users’ association [Contractor] to allow for prepayment of the repayment contract pursuant to paragraph (2) under mutually agreeable terms and conditions.”
Pursuant to and consistent with the WIIN Act, and upon the District’s request, the United States and the District negotiated terms and conditions that convert the Water Service Contract to a repayment contract, and those terms and conditions are reflected in the Repayment Contract. The Repayment Contract also reflects the current standard terms and conditions required by the Reclamation Manual, and continues water service to the District in the same scope and nature of the ongoing Central Valley Project and its existing facilities.
Under the Repayment Contract, ongoing receipt and delivery of water to the District will continue with no expansion of service and no new facilities constructed because the District will deliver the water received under the Repayment Contract: (1) to lands within the District’s boundaries for beneficial use and that have been in production, and (2) through existing facilities.
Although the specific terms of the Repayment Contract are set forth within its text, the following highlight some of the changes made:
(a) superfluous recitals in the Water Service Contract were deleted and new recitals were added to explain the basis for the conversion;
(b) definitions were: (i) added to reflect new provisions required to convert the Water Service Contract to a repayment contract, and (ii) modified to reflect requirements of the Reclamation Manual;
(c) the term of the Water Service Contract is deleted and new text added that provide a new effective date, and for the contract to continue so long as certain conditions are met;
(d) provisions related to rates, method of payment and repayment were deleted, revised and supplemented to reflect the payment obligation and mandates of the WIIN Act; and
(e) provisions were deleted, revised and supplemented to reflect text mandated by the Reclamation Manual.
Article 41 of the Repayment Contract requires the District to provide “a certified copy of a final decree of a court of competent jurisdiction in the State of California, confirming the proceedings on the part of the Contractor for the authorization of the execution of this amended Contract.”
The District reviewed the terms and conditions of the Repayment Contract and found the form and content thereof to be acceptable to the District and appropriate for execution in substantially the form presented to the District’s Board of Directors. Such terms and conditions are consistent with the District’s powers and authority under California law. Consequently, on September 15, 2020, at a duly noticed and regular meeting of the District’s Board of Directors, the Board of Directors adopted Resolution No. 124-20 for the purpose of authorizing the approval and the execution of the Repayment Contract (“Resolution”). Through the Resolution, the Board of Directors approved the Repayment Contract in substantially the form presented to the Board of Directors, found execution of the Repayment Contract was statutorily and categorically exempt from the California Environmental Quality Act, and authorized the District’s President to execute the Repayment Contract, in substantially the form presented to the Board of Directors, with such additional changes and/or modifications as are approved by the President of the District, its General Manager and its General Counsel. In accordance with Resolution No. 124-20, the parties subsequently fully executed the Repayment Contract.
The District therefore seeks a judicial decree, pursuant to Code of Civil Procedure section 860, et seq., determining the proceedings on the part of the District for the authorization of the execution of the Repayment Contract were in all respects legal and valid under applicable California law.
Copies of District Resolution No. 124-20, the Repayment Contract as approved pursuant to the Resolution and as fully executed, the District’s Complaint for Validation Judgment, and the proposed judgment may be obtained upon request by telephoning (559) 241-6215 and may also be viewed on the Westlands Water District’s website at www.wwd.ca.gov.

Notice is hereby given that on December 3, 2020, the City Council of the City of Fresno (City) adopted Council Resolution 2020-312 to annex Final Tract Map No. 6270 to the City of Fresno Community Facilities District No. 11 (CFD No. 11) and to authorize the levy of Special Taxes under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (City Law). Under this City Law and Council Resolution 2020-312, the City gives notice as follows:
a. The text of Council Resolution 2020-312, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof. The text of Council Resolution 2020-312 is summarized as follows:
b. As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 11, the boundaries of which are shown on the map on file with the City Clerk.
c. The purpose of CFD No. 11 is to provide financing for the maintenance of the landscaping and irrigation systems, open spaces, trails, concrete curbs, gutters, medians, hardscaping and sidewalks, street lights, local street paving and street name signage plus any added developer requested features (Services) located in street, landscaping and open space easements and public properties associated with the subdivision as more fully described in Council Resolution No. 2020-312 and Exhibit C thereto.
d. The method of financing the Services is through the imposition and levy of a special tax (Special Tax) to be apportioned on the properties in CFD No. 11 under the rate and method of apportionment described in Council Resolution 2020-312 and Exhibit D thereto. The Special Tax requires the approval of two-thirds of the qualified electors of CFD No. 11 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.
e. The Special Tax, if approved, will be used to finance all or a portion of the Services.
f. The Director of Public Works of the City or his designee is directed to cause to be prepared a written report for CFD No. 11, Annexation 117 (District Report) that shows the Services by type and required to adequately meet the needs of CFD No. 11 and the estimated costs of the Services. REQUEST FOR BIDS FOR ABATEMENT OF WEEDS, TRASH AND LITTER ON CERTAIN PROPERTIES IN THE CITY OF CLOVIS
Notice is hereby given that sealed bids will be received by the City Clerk of the City of Clovis, at Clovis City Hall, 1033 Fifth Street, Clovis, California 93612, by
2:00 p.m. February 12, 2020
For the abatement of weeds, trash and litter on certain properties in the City of Clovis subject to the terms outlined below:
1. SCOPE
Pursuant to Ordinance 2.9.03 of the City of Clovis, the following shall comprise the request for competitive bids from contractors for abatement work to be performed in the City of Clovis for Calendar Year 2020. Your bid submitted on the attached form will cover your cost to the City for the removal and/or abatement of weeds by mowing or discing, land leveling, rubbish removal, hand work, etc., as outlined on the attached forms. The City does not warrant in any way, that the estimated amount of work to be done is the amount that will actually be required. The number of parcels to be abated will be approximately 10 to 15. It is expected that any number of these could be abated by the owners, or their agents, prior to actual commencement of abatement proceedings by the City Contractor(s) selected as a result of this competitive bid procedure.
2. GENERAL INFORMATION
The Clovis Fire Department is preparing for Clovis’ annual weed abatement program. This year’s abatement bid is for a two-year contract and may be extended for one additional year at the option of the City. The weed abatement period is normally scheduled to commence in May; the exact date will vary depending upon weather conditions.
3. SPECIFICATIONS
Contractor shall furnish labor and equipment to properly abate weeds and debris on parcels as assigned by the Clovis City Fire Department and under the supervision of a Fire Department staff member. Equipment used shall be of a design to penetrate soil a minimum of five inches (5”) and shall cover grass with dirt sufficiently to eliminate fire travel. Parcels within the city limits are to be disced and or cleared completely. Parcels that require weeds to be cut or mowed must also include the removal of that material.
A. Bidder is to maintain a clean and safe work zone at all times including but not limited to proper use of barricades, cones and flagging for worker/s, traffic and pedestrian safety.
B. Bidder is to haul off and properly dispose of debris daily.
C. Bidder shall provide at least three current references from individuals for whom this type of work was performed within the last 12 months.
4. TIME LIMIT FOR COMPLETION OF WORK
The City of Clovis reserves the right to assign work to more than one contractor. All abatement is to be completed within fifteen (15) days of the date the contractor is advised to commence work.
5. BASIS FOR AWARD OF CONTRACT
Bids will be awarded, based on the ability to meet the Weed Abatement terms, the minimum bid consistent with the type and size of equipment, the contractor’s apparent ability to perform the work in the fastest time consistent with safety, and the ability to complete the work in an acceptable manner.
More than one abatement contractor may be authorized by the City of Clovis if it is found that this is in the best interests of the City and the property owners. Separate contractors may be authorized for each section of the bid; i.e., discing and other work.
6. RIGHT OF CITY TO REJECT BIDS
The City Council reserves the right to accept or reject any or all bids or portions thereof.
7. FAILURE TO PERFORM MAY RESULT IN REASSIGNMENT OF CONTRACT
It is understood and agreed that contractor(s) selected as a result of this bid, will be expected to complete all abatement work to the satisfaction of the inspecting officer within fifteen (15) days of the date of authorization to commence abatement proceedings. In the event of non-completion within such time limit, the work may be reassigned to another contractor by the City of Clovis. In the event of such reassignment, compensation shall be paid only for the actual work satisfactorily completed, provided however, that such compensation shall be withheld until all contractors have completed the work assigned and have submitted bills for such work, and in no case sooner than 30 days after completion of such work.
8. CONTRACTOR TO KEEP RECORDS OF WORK COMPLETED
The successful contractor(s) will be required to keep an account of the cost of abatement in front of or on each separate parcel of land where work is performed and shall submit a written report identifying items removed, handwork and dirt leveling for cost verification by the Fire Chief. All parcels requiring dirt leveling/hauling, rubbish or trash removal shall be photographed before the work is started and after the work is accomplished and a receipt from the disposal site must be attached to the work order submitted back to the City. Contractor(s) shall contact Clovis Fire Department before and after cleaning all parcels.
9. SATISFACTORY PERFORMANCE
All work is to be performed as required by the Fire Chief of the City of Clovis and as outlined in the contract awarded to the successful bidder(s).
The San Joaquin Valley Air Pollution Control District has specific guidelines to limit fugitive dust emissions to comply with State and Federal regulations which may be applicable to abatement activity as described in this Weed Abatement Contract Bid. All contractors awarded a bid by the City of Clovis must comply with all applicable rules under Regulation VIII of the San Joaquin Valley Air Pollution Control District’s Rules and Regulations at all times. San Joaquin Valley Air Pollution Control District should be contacted for further information about these regulations.
10. CERTIFICATE OF INSURANCE
The successful bidder(s) will furnish to the City of Clovis, within 48 hours of notification, a Certificate of Insurance to provide Bodily Injury Liability of $2,000,000/$4,000,000 and Property Damage Limits of not less than $1,000,000 on each occurrence. The Certificate of Insurance must provide such coverage to the City of Clovis as an additional insured, and must show the policy number and the date of effect and expiration of above policy.
