Notice of Regulatory Fee – Water Code Section 10730
California’s Sustainable Groundwater Management Act (SGMA) was enacted to address groundwater depletion and promote long-term water reliability. SGMA requires each groundwater basin to be managed by a Groundwater Sustainability Agency (GSA) and guided by a Groundwater Sustainability Plan (GSP).
Westlands Water District serves as the GSA for the San Joaquin Valley Basin Westside Subbasin. In this role, the District develops and implements the local GSP, coordinates with stakeholders, monitors basin conditions, and reports annually to the Department of Water Resources. These efforts ensure compliance with SGMA and support the sustainable management of groundwater resources for the region.
As the GSA for the San Joaquin Valley Basin Westside Subbasin, Westlands Water District imposes a SGMA Land-Based Charge to cover the costs of its GSP, which was adopted for Fiscal Year 2025-26 at the Board of Director’s February 20, 2025, public hearing in Resolution 102-25. In Fiscal Year 2025-26, the adopted rate was $1.11 per eligible acre. For Fiscal Year 2026-27, Westlands Water District proposes to increase the rate to $3.17 per eligible acre. This increase is based on inflation and the exclusion of prior-year surpluses in the 2025-26 adopted rate and does not exceed the District’s reasonable regulatory costs.

As a part of the Project, the Project site would be annexed to the City of Fowler and would be prezoned to the City’s R-1-6 mapping designation, with an implementing zone district of R-3 (Medium Density Residential). TPM No. 2025-45 would subdivide the property into two parcels of approximately 16.73 and 21.62 acres. VTSM No. 6537 would further subdivide the two resulting parcels into 179 single family residential lots, as well as a linear park along the Project site’s northern and western boundary. The Planning Commission will also consider whether the Project meets the qualifications to be absolved of further environmental review pursuant to California Environmental Quality Act Guidelines section 15183. The Planning Commission will consider the Project and make a recommendation to the City Council as to what action to take on the matter.

The Planning Commission invites your participation and the public is welcome to speak at the hearing. If you challenge any Planning Commission or City Council action in court, you may be limited to challenge only those issues raised at the Planning Commission or City Council public hearings.

Meeting material(s), staff report(s), and a telephone number to provide access to the Planning Commission meeting via teleconference will be available to the public at least three days prior to the hearing and may be reviewed at www.fowlercity.org.
