            Plaintiff has filed a civil complaint against you.  You may contest the validity of the above matter by appearing and filing with the Court a written responsive pleading to the complaint not later than March 5, 2021, which is ten (10) or more days after the completion of the publication of this summons in the Fresno Business Journal and the Merced Sun Star.  Your pleading must be in the form required by the California Rules of Court.  Your original pleading must be filed in this Court with proper filing fees and proof that a copy thereof was served on Plaintiff’s attorneys.  Unless you so respond, your default will be entered upon Plaintiff’s application, and the Plaintiff may apply to the Court for the relief demanded in the complaint.  Persons who contest the validity of the matter described below and in the complaint will not be subject to punitive action, such as wage garnishment or seizure of their real or personal property. 

            DETAILED SUMMARY OF THE MATTER THAT PLAINTIFF SEEKS TO VALIDATE: 

            The Eagle Field Water District (the “District”) is a California water district with service areas in Fresno and Merced Counties in California.  Pursuant to applicable statutes and other authorities, the District is authorized to perform various duties and functions related to providing irrigation water to landowners within the District’s boundaries.  As pertinent here, the District is authorized to enter into contracts with and cooperate with the United States for irrigation and municipal purposes.  Beginning in 1959, the District has so contracted for water delivery with the United States Department of Interior, Bureau of Reclamation (“Reclamation”) for delivery of water through the federal Central Valley Project (“CVP”) water reclamation dams, canals, and other facilities.  The District uses the contracted CVP water to provide irrigation and municipal water to its customers in the District.

            On December 16, 2016, the United States Congress enacted the Water Infrastructure Improvements for the Nation Act, Pub.L. 114-322 (2016) (the “WIIN Act”).  Pursuant to Section 4011(a) of the WIIN Act, in 2019, the District requested that Reclamation convert its existing water supply contract to a repayment contract under Section 9(d) of the 1939 Reclamation Project Act (53 Stat. 1187) (the “1939 Act”).  The District and Reclamation entered into negotiations for the Conversion Contract beginning in May 2019.  In July 2020, Reclamation posted the unexecuted negotiated Conversion Contract on its internet website for a public comment period.  After the comment period ended, Reclamation provided the unexecuted Conversion Contract to the District for approval by the District’s Board of Directors and authorization for signature.  The Conversion Contract will provide continued water delivery to the District and its landowners and shall remain in force unless or until the District does not make the annual payments for the delivered water.  A copy of the Conversion Contract is attached to the District’s complaint as Exhibit 2.  

            The District publicly noticed its special Board of Directors (the “Board”) meeting agenda on-site at the District and on the District’s website, notifying the public of the Board’s consideration of the Conversion Contract to be held on October 12, 2020.  At the Board meeting on October 12, 2020, the District’s Board approved the Conversion Contract and authorized the execution and delivery of the Conversion Contract to Reclamation, and related actions in furtherance of executing the Conversion Contract.  A copy of the Resolution is attached in the District’s complaint as Exhibit 1.

            The District brought this validation action to confirm the validity of the Conversion Contract and the proceedings related thereto.  The validation complaint, the accompanying exhibits, and a copy of this Summons are available upon request at the District’s offices and publicly available on the District’s website at:

NOTICE IS HEREBY GIVEN THAT the Board of Supervisors (“Board”) of the County of Fresno (“County”) will hold a public hearing on January 26, 2021 in the Board Chambers, Hall of Records, Third Floor, 2281 Tulare Street, Fresno, California, 93721, to consider petition for PARTIAL CANCELLATION OF AGRICULTURAL LAND CONSERVATION CONTRACT NO. 3342 (RLCC NO. 1009) to remove a 1.18-acre portion of a 40.00-acre parcel from the Williamson Act program to allow the 1.18 acres which contains a house to be created as a separate parcel through a zone variance and a mapping application for residential use as an alternative use of the 1.18-acre parcel.  The subject parcel is located on the west side of Rolinda Avenue, between Jensen Avenue and North Avenue, approximately seven miles west of the nearest city limits of the City of Fresno (Sup. Dist. 1) (APN 025-041-37s).

A copy of the Board agenda materials, including the RLCC No. 1009 staff report, will be made available for public review, commencing on or about the Wednesday immediately before the applicable Board public hearing date at the office of the Clerk of the Board of Supervisors (“Clerk”), at the above address for the Board Chambers, on County business days between the hours of 8:00 AM and 5:00 PM, and on the County’s Internet web site at https://fresnocounty.legistar.com/Calendar.aspx

CITY OF CLOVIS SUMMARY OF ORDINANCE 20-18 OF THE CITY COUNCIL OF THE CITY OF CLOVIS AMENDING THE CLOVIS DEVELOPMENT CODE, TITLE 9 OF THE CLOVIS MUNICIPAL CODE AND FINDING THAT THE PROJECT IS NOT SUBJECT TO FURTHER ENVIRONMENTAL REVIEW PURSUANT TO SECTION 15162 OF THE CEQA GUIDELINES

On January 4, 2021 at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council adopted an ordinance amending the development code, Title 9 of the Clovis Municipal Code.  The purpose of the request is to amend various sections of the City’s current Development Code that was adopted by the Council on October 8, 2014.  The Clovis Development Code has been in use for six years and several minor modifications and errors have been identified.

The ordinance was adopted by unanimous vote. A certified copy of the entire ordinance is available in the City Clerk’s office at 1033 5th Street, Clovis, CA, 93612.  559-324-2060 for questions.
