Project Title: Kamm Avenue Pistachio Processing Plant
Notice is Hereby Given:
The County of Fresno (County) is the Lead Agency on the below-described Kamm Avenue Pistachio Processing Plant Project (Project) and has prepared a Notice of Preparation (NOP) of a Recirculated Environmental Impact Report (EIR), pursuant to the California Environmental Quality Act (CEQA) and the CEQA Guidelines. Previously, an NOP was prepared for the proposed Project and was properly noticed and circulated pursuant to CEQA Guidelines for public review from September 14, 2020 – November 2, 2020. Public scoping meetings were held on September 28, 2020 and October 19, 2020. Following the NOP review period and scoping meetings, the Draft EIR was prepared and was circulated for public review from February 17, 2021 – April 4, 2021. The Draft EIR has not been certified by the Fresno County Board of Supervisors. Pursuant to Section 15088.5 of the CEQA Guidelines, a Lead Agency is required to recirculate an EIR when significant new information is added to the EIR after public notice is given of the availability of the Draft EIR for public review but before certification. The County reviewed comments on the previously-circulated Draft EIR, and the request by the Applicant to recirculate the Draft EIR to provide additional detailed information about the processing equipment requested by commenters, and determined to exercise its discretion to initiate preparation of a Recirculated Draft EIR. As such, the County released an NOP of a recirculated EIR from April 28, 2021 – June 1, 2021 and an additional scoping meeting was held on May 10, 2021. Since that time, the Project description has been modified as described herein and therefore this new NOP for the Recirculated EIR is being provided.
This NOP is being provided to solicit the views of the public, interested parties, and/or agencies as to the scope and content of the Recirculated Draft EIR. Specifically, the County is requesting that commenters provide comments on the NOP for the Recirculated EIR, identify additional environmental topics (and/or special studies) that they believe need to be explored in the forthcoming Recirculated Draft EIR, and to identify other relevant environmental issues related to the scope and content of the forthcoming Recirculated Draft EIR.
Project Location:
The proposed processing plant components of the Project would be located on two parcels totaling approximately 317.2 acres, on the south side of Kamm Avenue, approximately one mile west of Highway 33, and approximately 4.0 miles east of Interstate 5 in the western portion of unincorporated Fresno County (portions of Assessor’s Parcel Numbers 38-030-17S and 038-300-30S). The unincorporated community of Three Rocks, a U.S. Census designated place, is located approximately 1.5 miles to the southeast of the proposed Project site. See Figure 1 – Regional Location Map and Figure 2 – Project Vicinity Map.
Project Description:
Kamm Avenue Pistachio Processing, LLC (Applicant) is proposing to construct and operate a pistachio processing facility to process nuts from nearby orchards and other areas. The Applicant proposes to construct, operate, and maintain a pistachio processing plant with three huller lines with an average annual processing capacity of 77 million pounds of pistachios. The Project would provide pistachio processing capacity in the immediate vicinity of existing pistachio orchards that currently ship harvested crops for processing to more remote locations, including processing plants located outside of Fresno County. The Project would operate year-round to package and process harvested pistachios for retail and wholesale customers. During an approximately 60-day harvest period, which typically occurs sometime from August to October, the Project would operate seven days a week and 24 hours per day to receive, hull, heat, dry and store pistachio crops in onsite storage silos. During non-harvest operations, the Project would operate two shifts per day, five or six days per week depending on pistachio product market conditions. The Project would have a full-time workforce of 200 employees. An additional 210 seasonal workers would be employed during the approximately 60-day harvest period. The primary pistachio processing facilities would be located within an approximately 80-acre fenced area bordered by Kamm Avenue to the north and agricultural fields to the south, east and west. Two process water settling and cleaning ponds, each with 48 acre-feet of storage capacity, would be located along the southern area of the site and would be connected to the processing plant via an underground pipeline. Approximately 80 to 90 percent of all water used by the Project will be recaptured, cleaned, and used by local pistachio growers for irrigation.
Major components of the Project would include:
· A 132,200 square foot processing and packing building (approximately 47-feet in height) with appurtenant equipment. A variance is requested to allow the silos to be built in excess of the 35-foot height limit of the Zone District.
· A 15,000 square foot cold storage building.
· Fifty two (52) storage silos with a base diameter of 48 feet and a height of approximately 70 feet with vent stacks, appurtenant scaffolding and access equipment. A variance is requested to allow the silos to be built in excess of the 35-foot height limit of the Zone District.
· A 21,600 square foot huller canopy and other processing equipment.
· Fifteen (15) natural gas fired column dryers, each with a 27 million British thermal unit per hour capacity.
· A 353,000 gallon process water storage tank and two 80,055 gallon domestic water storage tanks.
· An onsite approximately 2,130 square foot domestic water treatment facility, including a facility control room, domestic water treatment filers, and storage ponds. The proposed location of the storage pond has been moved by the Applicant to be closer to the processing equipment to further reduce energy consumption from management of wastewater flows.
· Utility (natural gas and electric) equipment to provide permanent service to the processing equipment, including onsite utility equipment, and an offsite natural gas line and upgraded electric line. To assure operational capacity of processing equipment during initial harvests, the facility may use propane supplied by trucks until the permanent gas line is constructed.
· Access roads, scales, signage and related facilities for harvest and shipping truck loading and unloading and employee and other vehicular access and parking facilities.
· Other necessary infrastructure for Project operations and maintenance, including a shop building, a chemical storage warehouse, a fire pumphouse, a motor control center, a compressor building, an administration office building, breakroom and supervisor office building, guard shacks, sand and media raw water filters and process water separators and screens.
Project Description Changes from the Previous NOD:
The Project Description provided herein has been updated from the previous NOP (circulated April 28, 2021 – June 1, 2021). The following is a general description of the changes that have occurred between the previous NOP and the current NOP:
· Increase in processing capacity from 66 million to 77 million pounds of finished pistachio products each year.
· Increase in the number of full-time employees from 60 to 200, and an increase in the number of seasonal employees from 60 to 210.
· Increase in the size of the processing building from 130,000 square feet to 132,200 square feet.
· Increase in the number of silos from 49 to 52.
· Increase in the number of column dryers from 13 to 15.
· Increase in the amount of domestic water storage tanks from a single 70,000-gallon water tank to two 80,025 gallon tanks.
· Other minor changes to the Project Description have occurred which will be described in further detail in the forthcoming Recirculated EIR.
Scope of the Recirculated Environmental Impact Report:
As the Project Description may lead to clarifications and revisions to the environmental analysis included in the previously circulated EIR, the County has elected to recirculate the entire EIR and not just revised chapters or portions of the EIR as permitted by CEQA Guidelines section 15088.5(f). Therefore, the forthcoming Recirculated Draft EIR will address the following CEQA Guidelines Appendix G topics: Aesthetics, Agriculture/Forestry Resources, Air Quality, Biological Resources, Cultural Resources, Energy, Geology and Soils, Greenhouse Gas Emissions, Hazards and Hazardous Materials, Hydrology and Water Quality, Land Use and Planning, Mineral Resources, Noise, Population and Housing, Public Services, Recreation, Transportation, Tribal Cultural Resources, Utilities and Service Systems, and Wildfire. The Recirculated Draft EIR will also review Project alternatives as well as cumulative impacts. The environmental baseline for the CEQA analysis will be June 1, 2019, which is prior to the development of existing improvements on the site.
Document Availability and Public Review Timeline:
Due to the time limits mandated by State law, your response to the NOP for the Recirculated Draft EIR must be sent no later than 30 days after receipt of this notice. NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to, installation of sewer, potable water, storm drain, and Fresno Irrigation utilities, and new street lights, pavement reconstruction, and concrete improvements. In addition, the construction work includes modifications to the existing traffic signal and installation of new traffic loops and pavements marking and signs on the Nees Avenue Street Widening (“Project”).
A complete listing of bid quantities is contained in the bid proposal form. Bids will be received for the complete work in accordance with the plans and specifications on file with the City Clerk at the Clovis Civic Center, Clovis, CA. Plans and specifications, forms of proposal, contract and special provisions can be downloaded free of charge from the vendor portal of PlanetBids, Inc., which is accessible on the City of Clovis website.
Bids must be filed with the City Clerk at the Clovis Civic Center prior to 2:00 p.m., Tuesday, October 4, 2022, at which time the City Clerk will open said bids. Bids shall be submitted in sealed envelopes and marked:
Bid Proposal: Nees Avenue Street Widening
No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer. Each bid must be accompanied by a certified or cashier’s check or bidder’s bond on the City’s form, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid. Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract. A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials (Payment) Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded. Said bonds shall be on the City’s forms and shall be issued by a surety company which is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, which has a rating not lower than “A-” as rated by A.M. Best Company, Inc. or other independent rating companies, and which is acceptable to the City of Clovis. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance. In accordance with the provisions of Chapter 13 (commencing with Section 4590), Division 5, Title 1 of the Government Code of the State of California, securities may be substituted for monies withheld on the project.
In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done. Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612. A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.
In accordance with the provisions of Sections 1725.5, 1771.1, 1771.3, and 1771.4 of the Labor Code, this project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal (subject to the requirements of Section 4104 of the Public Contract Code), or engage in the performance of any contract for public work, as defined by that chapter of the Labor Code, unless currently registered and qualified to perform public work pursuant to Section 1725.5 of the Labor Code. See Section 7-2 of the Standard Specifications (General Conditions) for additional requirements.
The City of Clovis will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.
The Federal minimum wage rates for this project as predetermined by the United States Secretary of Labor are set forth in the Bid book and in copies of this book that may be examined at the offices described above where project plans, special provisions, and bid forms may be seen. The latest edition is also available from the Internet web site at U.S. General Services Administration and archives are available through the System for Award Management (SAM).gov. Addenda to modify the Federal minimum wage rates, if necessary, will be issued to holders of Bid book. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. “Modifications” to the wage rates typically change the wage rate or fringe benefits for particular crafts and trades included in the original decision. Modifications will not be effective if they are received after the bid opening or later than ten (10) days prior to the bid opening (unless there is reasonable time to notify bidders). Modifications received prior to ten (10) days before the bid opening will require notification of bidders by Addendum.
Attention is directed to the Federal minimum wage rate requirements in the Bid book. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. The Department will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes “helper” (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the duties of the employees in question.
Bidders are advised that, as required by federal law, the City of Clovis is implementing new Disadvantaged Business Enterprise requirements for Disadvantaged Business Enterprises (DBE). Section 2, “Proposal Requirements and Conditions,” under subsection titled “Disadvantaged Business Enterprises (DBE)” and Section 5, “General,” under subsection titled “Performance of Subcontractors” of these special provisions cover the DBE requirements. The DBE Contract goal is twenty-two percent (22%). The Agency may consider the DBE commitments of the 2nd and 3rd bidders when determining whether the low bidder made good faith efforts to meet the DBE goal.
This project is subject to “Buy America” requirements of the Surface Transportation Assistance Act of 1982 (Section 165), and the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) Sections 1041(a) and 1048(a), Title 23 CFR 635.410, and the regulations adopted pursuant thereto.
This project is also subject to the Cargo Preference Act (CPA) implementing regulations in Title 46 CFR 381, “Cargo Preference – U.S.-Flag Vessels”, for all Federal-aid projects.
All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form. The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”. Bidders for this project must possess a valid Class A and/or C12 License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available. Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract. All representations made on the proposal are made under penalty of perjury.
The lowest bid shall be determined by the amount of the base bid. The City of Clovis reserves the right to reject any or all bids, to waive any informalities or minor irregularities in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interest of the City of Clovis.
Time of completion for the Project shall be Eighty-Five (85) Working Days from the date established in the Owner’s Notice to Proceed.
Unless otherwise required by law, no bidder may withdraw its bid for a period of sixty (60) days after the date set for the opening thereof or any authorized postponement thereof. The Owner reserves the right to take more than sixty (60) days to make a decision regarding the rejection of bids or the award of the Contract.

REQUEST FOR BIDS
The purpose of this Request for Bids (RFB) is to solicit proposals from qualified Contractors to provide construction, testing, and commissioning services for a 70/6.6kV 35MVA transformer replacement as detailed in the Scope of Work of the RFB package. 1) Sealed bids will be received by the Friant Power Authority at Provost and Pritchard Consulting’s Clovis office prior to 3:00:00 p.m. (local time) on October 17th, 2022, at 455 W. Fir Ave, Clovis, CA 93611, and following said deadline all bids will be publicly opened and read. Bids shall be submitted in a sealed envelope with the name of the bidder, the name of the project and the statement “Do Not Open Until the Time of Bid Opening.” Bids received after said deadline will be returned unopened to the bidder. 2) A mandatory pre-bid meeting and project site tour will be held on October 4th at 9:00 a.m. (local time) at the following address: Friant Power Authority, 18015 Friant Road, Friant, CA 93626.
