The Kings River Conservation District is soliciting bids for sediment removal at the Empire 1 Pool on the Kings River, located two miles west of Lemoore, CA. In general, the Work consists of removing accumulated sediment from the channel using scrappers and bulldozers. The sediment will be placed at the laydown areas shown in the Request For Proposal. Sealed or electronic bids will be received at the office of the Purchasing Manager of the City of Fresno for the following:
AIRPORTS DEPARTMENT JOB ORDER CONTRACTING FOR
GENERAL BUILDING CONSTRUCTION, HVAC CONSTRUCTION,
AND ELECTRICAL CONSTRUCTION BID FILE NUMBER: 12300168
A Job Order Contract is an indefinite quantity contract pursuant to which the Contractor may perform an ongoing series of individual Projects at different locations within the city or at any location or facility under the jurisdiction of the City. The bid documents include a Construction Task Catalog® containing construction tasks with preset Unit Prices. All Unit Prices are based on local labor, material and equipment prices and are for the direct cost of construction.
The Contractor will bid two sets of Adjustment Factors to be applied to the Unit Prices for a total of 4 Adjustment Factors. The first set will include an Adjustment Factor for performing work during Normal Working Hours and a second Adjustment Factor for performing work during Other Than Normal Working Hours. The second set will include an Adjustment Factor for performing work during Normal Working Hours at Secure Locations and a second Adjustment Factor for performing work during Other Than Normal Working Hours at Secure Locations. The same four Adjustment Factors shall apply to every Pre-priced Task in the Construction Task Catalog®.
The City may award up to four (4) individual contracts for General Building Construction, one to each of the four lowest responsive, responsible bids, up to two (2) individual contracts for HVAC Construction, one to each of the two lowest responsive, responsible bids, and up to two (2) individual contracts for Electrical Construction, one to each of the two lowest responsive, responsible bids, but reserves the right to reject any and all bids, and waive any irregularities in any bid received.
Each bidder may submit one and only one bid for this solicitation. If a bidder submits more than one bid for this solicitation; then that bidder will be disqualified for all bids submitted and those bids will be returned to the bidder unopened.
Thereafter, as projects are identified the Contractor will jointly scope the work with the City. The City will prepare a Detailed Scope of Work and issue a Request for Proposal to the Contractor. The Contractor will then prepare a Job Order Proposal for the Project including a Job Order Price Proposal, drawings and sketches, a list of subcontractors and materialmen, construction schedule, and other requested documentation. The Job Order Price shall equal the value of the approved Job Order Price Proposal. The value of the Job Order Price Proposal shall be calculated by summing the total of the calculation for each Pre-priced Task (Unit Price x quantity x Adjustment Factor) plus the value of all Non Pre-priced Tasks.
If the Job Order Proposal is found to be complete and reasonable, a Job Order may be issued.
A Job Order will reference the Detailed Scope of Work and set forth the Job Order Completion Time, and the Job Order Price. The Job Order Price shall be a lump sum, fixed price for the completion of the Detailed Scope of Work. A separate Job Order will be issued for each Project. Extra work, credits, and deletions will be contained in a Supplemental Job Order. A unique City Purchase Order will be issued for each Job Order.
The Owner selected The Gordian Group’s (Gordian) Job Order Contracting (JOC) Solution for their JOC program. The Gordian JOC SolutionTM includes Gordian’s proprietary JOC Software and JOC Applications,
construction cost data, and Construction Task Catalog® which shall be used by the Contractor solely for the purpose of fulfilling its obligations under this Contract, including the preparation and submission of Job Order Proposals, Price Proposals, subcontractor lists, and other requirements specified by the Owner. The Contractor shall be required to execute Gordian’s JOC System License and Fee Agreement and pay a 1% JOC System License Fee to obtain access to the Gordian JOC SolutionTM. The JOC System License Fee applies to all Job Orders issued to the Contractor under the terms this Contract. The Contractor shall include the JOC System License Fee in the Adjustment Factors.

Each bidder may submit one and only one bid per contract type. If a bidder submits more than one bid for a contract type, then that bidder will be disqualified for all bids submitted and those bids will be returned to the bidder unopened.
Term of Contract and Option Periods:
1. The Base Term of the Contract is for a period of one (1) year, or the issuance of Job Orders totaling a maximum value of $1,000,000, whichever comes first.
2. The Contract has two (2) bilateral Option Terms. Both parties must agree to extend the Contract for an Option Term. Each Option Term is for a period of one (1) year, or the issuance of Job Orders totaling a maximum value of $1,000,000, whichever comes first, plus any carry-over amounts from previous terms. The Maximum Contract Value is $3,000,000 over the potential 3 (1) year terms.
3. All Job Orders issued during the term of this Contract shall be valid and in effect notwithstanding that the Detailed Scope of Work may be performed, payments may be made, and the guarantee period may continue, after such period has expired. All terms and conditions of the Contract apply to each Job Order.
Minimum and Maximum Contract Values
1. The Minimum Contract Value for this Contract is $0.
2. The Maximum Contract Value for each Contract is $1,000,000 per term with a possible $3,000,000 maximum over all. The Contractor is not guaranteed to receive this volume of Job Orders. It is merely an estimate. The City has no obligation to give the Contractor the opportunity to perform Job Orders in excess of the Minimum Contract Value. At the discretion of the City and if deemed to be in the public interest, the Maximum Contract Value of this Contract may be increased.

The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code. The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City. All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager and must be accompanied by a Bid Deposit in the amount of Twenty Thousand Dollars ($20,000) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount. Title VI Solicitation Notice — The CITY, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.
(ii) Government wide Requirements for Drug-free Workplace (Government Code §8355, Drug Free Workplace Act of 1988)
Bidders are advised that, as required by federal law, the State of California has established a statewide overall DBE goal. City of Fresno federal-aid contracts are considered to be part of the statewide overall DBE goal and the City is required to report to the Federal Aviation Administration (FAA) on DBE participation for all Federal-aid contracts each year so that attainment efforts may be evaluated.
This contract is under and subject to the Equal Opportunity Clause and Wage Rate Decision contained in the contract documents.
In accordance with provisions of section 22300 of the California Public Contract Code, Contractor may substitute securities for any monies withheld by City to ensure performance under the Contract.
Prior to commencing any portion of the Work, CONTRACTOR shall apply for and furnish OWNER separate payment and performance bonds for its Work on the Contract. The performance bond shall be in an amount equal to one hundred percent (100%) of the individual Job Order to cover 100% faithful performance of and payment of all obligations arising under the Contract Documents. The payment bond shall be in an amount equal to one hundred percent (100%) of the individual Job Order to guarantee the payment in full of all claims for labor performed and materials supplied in connection with the individual Job Order / Contract.
No bid will be considered for award unless the Bidder at the time of bid opening, is licensed with a valid Class “B” Contractor’s License issued by the State of California for the General Building Construction contracts, a valid Class “C20” Contractor’s License issued by the State of California for the HVAC Construction contracts, or a valid Class “C10” Contractors License issued by the State of California for the Electrical Construction contracts.
The City reserves the right to reject any and all bids.
