REQUEST FOR RELEASE OF FUNDS
On or about September 30, 2021 the County of Fresno will submit a request to the Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant Program (CDBG) under Title I of the Housing and Community Development Act of 1974 as amended, to undertake a project known as Environmental Review No. 8064 Mendota Rojas Pierce Park, CDBG #20471, for the purpose of expanding a community park in the City of Mendota. The project consists of expanding the park to the west, adding a baseball field, two soccer fields, restroom and concession facilities, and sports field lighting. Irrigation, landscaping, drinking fountains, fencing, shade structures, and appurtenant utilities will be installed. Other phase(s) of construction will include the extension of Smoot Avenue, including approximately 80 on-street parking spaces for the park, from its end at the Gregg Ct. alignment west to the Amador Street alignment, and constructing a segment of Amador Street from Smoot north to Oxnard Street. Estimated funding $575,222, total cost estimated to be $1,415,433.00. The project site is located on the north side of Smoot Avenue, between Gregg Ct. and Amador St., in Mendota.
FINDING OF NO SIGNIFICANT IMPACT
The County of Fresno has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 2220 Tulare Street, Suite A, Fresno, CA 93721 and may be examined or copied Mondays through Thursdays 9 A.M to 5 P.M. and Fridays 8:30 A.M. to 12:30 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the County of Fresno Department of Public Works and Planning, Attn: Thomas Kobayashi at the address listed above, or by email to: tkobayashi@fresnocountyca.gov. All comments received by September 29, 2021 will be considered by the County of Fresno prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The County of Fresno certifies to HUD that Steven E. White in his capacity as Director of the Department of Public Works and Planning consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County of Fresno to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the County of Fresno’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of Fresno; (b) the County of Fresno has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD, CPD Office, by email to: CPD_COVID-19OEESFO@hud.gov.
