NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that on Monday, September 13, 2021, at 6:00 p.m., a public hearing will be conducted in the Council Chamber of the Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612.  The Clovis City Council will consider the following item:

1.    Consider Approval – Res. 21-__, A request to approve the 2021 City of Clovis Planning Division fee schedule.

The proposed update to the City of Clovis Planning Division fee schedule utilizes the fee calculation methodology developed by the City and used consistently since approximately 2002. This methodology applies direct and indirect costs associated with the processing of each permit type to a time estimate which accounts for each step in the permitting process. A majority of the planning entitlement fees are proposed to increase. Since 2009, changes in State law pertaining to CEQA, land use planning, zoning regulations, and development requirements have also increased the time estimate for entitlement reviews.

The City has determined that Project Item No. 1 is exempt from CEQA pursuant to Public Resources Code Section 15061(b)(3) which provides that CEQA applies only to projects that have the potential for causing a significant effect on the environment.  A Notice of Exemption has been completed during the preliminary review and is kept for public review with the project file during the processing of the project application.  Staff will file the notice with the County Clerk if the project is approved.

All interested parties are invited to comment in writing to the Planning Division by no later than 4:00 p.m. on September 13, 2021, and/or to appear at the hearing described above to present testimony in regard to the above listed request. NOTICE IS HEREBY GIVEN THAT the City of Mendota seeks to receive Construction Manager at Risk Qualifications and Proposals for the following project, (“Project”):

Mendota City Hall and Police Station

The Project consists of:  approximately 13,780 sf of new building on a ½ acre lot with onsite and offsite improvements. The building consists of a single-story City Council Room wing, two-story City Hall wing, and a single-story Police wing. The Police wing is anticipated to be seismically separated from the rest of the facility in-order to limit the extent of the essential services requirements. The building is anticipated to be constructed of type V stick framed with engineered trusses over a standard slab on grade foundation system finished in stucco in a Spanish Revival design style. Interior finishes are intended to be standard Class A office finishes with a value preference to low maintenance and longevity. Site improvements are anticipated to include an asphalt parking lot, small entry plaza in pavers, site gates and fencing, and strategic landscaping.

The Project work shall commence at: 7th and Rio Frio Street, Mendota, CA 93640

The estimated construction budget is: $5,800,000 excluding equipment and agency fees

The estimated schedule is:

·         Qualification Period (selection of 3 qualified RFQ/Pders) – 9/10/21 – 9/24/21

A non-mandatory conference and site visit will be held on September 16th, 2021 at 2:00 PM via remote meeting (link to be provided upon request).  .  The conference is expected to take approximately one (1) hour or less.

The successful proposer shall be required to furnish a 100% Performance Bond and a 100% Payment Bond if it is awarded the contract for the Work.

The successful responder may substitute securities for any monies withheld by the City to ensure performance under the Contract, in accordance with the provisions of section 22300 of the Public Contract Code.

The Contractor and all Subcontractors under the Contractor shall pay all workers on all work performed pursuant to this Contract not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by the Director of the Department of Industrial Relations, State of California, for the type of work performed and the locality in which the work is to be performed within the boundaries of the City, pursuant to sections 1770 et seq. of the California Labor Code.  Prevailing wage rates are also available from the City or on the Internet at: .

This Project is subject to labor compliance monitoring and enforcement by the Department of Industrial Relations pursuant to Labor Code section 1771.4 and subject to the requirements of Title 8 of the California Code of Regulations.  The Contractor and all Subcontractors under the Contractor shall furnish electronic certified payroll records directly to the Labor Commissioner weekly or within ten (10) days of any request by the City or the Labor Commissioner.  The successful responder shall comply with all requirements of Division 2, Part 7, Chapter 1, Articles 1-5 of the Labor Code.

In order to provide a logical boundary, the City proposes to prezone 0.33 acres of land (APN 340-220-33) to the RCO zone district (Parcel 2). Both parcels are proposed for annexation. The City Council will also consider adoption of an Addendum in accordance with the California Environmental Quality Act as a responsible agency to a previously adopted Mitigated Negative Declaration (State Clearinghouse No. 2021050269) pursuant to the California Environmental Quality Act (CEQA). The Fowler Planning Commission recommended approval of the Prezone and adoption of the Addendum at their September 2, 2021 meeting.

The Fresno County Board of Supervisors is giving notice that at their regularly scheduled meeting on September 21, 2021 at 10:00 a.m., or as soon thereafter as the matter may be heard, at the Fresno County Hall of Records, Board of Supervisors Chambers, 3rd Floor, 2281 Tulare Street, Fresno, California, they will consider adoption of the ordinance summarized below.

SUMMARY OF PROPOSED ORDINANCE

The Ordinance will add Chapter 5.02 to Title 5 of the County of Fresno Ordinance Code (the “Ordinance Amendment”).  The Ordinance Amendment will delegate settlement authority within certain limits to the County Administrative Officer, the Human Resources Director and the County Counsel.  The limits under the Ordinance Amendment for the County Administrative Officer is $50,000 for all claims for or against the County, and for the Human Resources Director of $50,000 for all general liability claims against the County and $50,000 of additional county funds for workers compensation claims.  The Human Resources Director will also be able to settle employment or personnel disputes in the amount of $50,000 that do not exceed the payment of $30,000 in additional salary or benefits.  The County Counsel will be delegated the authority to waive costs of suit (including potential legal fees) up to $5,000 in exchange for a dismissal of an action against the County.
