DETAILED SUMMARY OF MATTER THAT PLAINTIFF SEEKS TO VALIDATE:

            International Water District (the “District”) is a California Water District located in Fresno County, California.  Pursuant to applicable statutes and other authorities, the District is authorized to perform various duties and functions related to providing irrigation water to landowners within the District’s boundaries.  As pertinent here, the District is authorized to enter into contracts with and cooperate with the United States for irrigation purposes.  Beginning in 1963, the District has contracted for water service with the United States Department of Interior, Bureau of Reclamation (the “United States”) for delivery of water through the federal Central Valley Project (“CVP”).  The District uses the contracted CVP water to provide irrigation and municipal and industrial water to its customers in the District.

            On December 16, 2016, the United States Congress enacted the Water Infrastructure Improvements for the Nation Act, Pub.L. 114-322 (2016) (the “WIIN Act”).  Pursuant to Section 4011(a) of the WIIN Act, the District requested that the United States convert its existing water supply contract to a repayment contract as provided in Section 9(d) of the 1939 Reclamation Project Act (53 Stat. 1187) (the “1939 Act”).  In or around August 2021, and in compliance with the National Environmental Policy Act, the United States posted the unexecuted negotiated Repayment Contract on its internet website for a public comment period.  After the comment period ended on October 12, 2021, the United States provided the unexecuted draft of the Repayment Contract to the District for the District’s Board of Directors’ approval and authorization for signature.  The Repayment Contract will provide continued water delivery to the District and its customers and shall remain in force unless or until the District does not make the annual payments for the delivered water.  A copy of the executed Repayment Contract is attached to the District’s complaint as Exhibit 2.  

            In compliance with the Ralph M. Brown Act and in accordance with the Governor’s Executive Order N-29-20, on December 6, 2021, the District publicly noticed the agenda for its special meeting of the Board of Directors (the “Board”) at the District, notifying the public of the Board’s consideration of the Repayment Contract.  At the December 7, 2021, Board meeting, the Board approved the Repayment Contract and authorized the execution and delivery of the Repayment Contract to the United States and related actions in furtherance of executing the Repayment Contract.  A copy of the Resolution is attached in the District’s Complaint as Exhibit 1.

            The District brought this Validation Action to confirm the validity of the Repayment Contract and the proceedings related thereto.  The Complaint, the accompanying

Project Location: The City, its sphere of influence (SOI), and specific areas beyond the City and its SOI (non-SOI Plan Area) are defined and referred to herein as the Plan Area. At the local level, the Plan Area is generally bounded by Copper Avenue on the north, Willow Avenue on the west, Academy Avenue on the east, and Shields Avenue on the south. State Route 168 (SR-168) bisects the City from the southwest to the northeast.

Project Description: Clovis is preparing a focused update to its existing General Plan concentrating on policy changes to the Circulation Element only. The proposed Project also includes adoption of the Transportation Impact Analysis Guidelines. The focused General Plan Update does not affect land uses or development patterns, and does not result in any physical development.

Significant Environmental Effects: The Draft EIR has identified significant and unavoidable environmental impacts related to Transportation/Circulation and Cumulative Impacts. All other environmental issues were determined to have no impact, less than significant impacts, or less than significant impacts with mitigation measures.

Public Review Period: A 45-day public review period for the Draft EIR will commence on June 29, 2022 and end on August 15, 2022. Any written comments on the Draft EIR must be received at the above address within the public review period. Notice is hereby given that the County of Fresno has prepared Initial Study Application (IS) No. 8151 pursuant to the requirements of the California Environmental Quality Act for the following proposed project:

INITIAL STUDY APPLICATION NO. 8151 and CLASSIFIED CONDITIONAL USE PERMIT APPLICATION NO. 3724 filed by DAVID F. HINES, H&R FACILITIES CO., proposing to allow a commercial fruit cold storage/packing facility on a 76.22-acre parcel in the AE-20 (Exclusive Agriculture; 20-acre minimum parcel size) Zone District. CITY OF FRESNO, COUNTY OF FRESNO, STATE OF CALIFORNIA,

AND THE LEVY OF A SPECIAL TAX THEREIN

NOTICE IS HEREBY GIVEN that on Thursday, June 2, 2022, the Commission (the “Commission”) of the California Statewide Communities Development Authority (the “Authority”) duly adopted its Resolution No. 22SCIP-70 (the “Resolution of Intention”) wherein it declared its intention, pursuant to a joint community facilities agreement with the City of Fresno (the “Local Agency”), to form a community facilities district within the territorial limits of the City of Fresno, to be known as “California Statewide Communities Development Authority Community Facilities District No. 2022-08 (Fancher Creek), City of Fresno, County of Fresno, State of California” (the “Community Facilities District”), to designate Improvement Area No. 1, Improvement Area No. 2 and Improvement Area No. 3 therein (the “Improvement Areas”) and to levy a special tax therein to finance certain public improvements to be owned by the Local Agency (the “Improvements”) and development impact fees (the “Fees”).  On June 2, 2022, the Commission also adopted its Resolution No. 22SCIP-69 (the “Resolution to Incur Bonded Indebtedness”) wherein it declared its intention to incur bonded indebtedness in a principal amount not to exceed four million seven hundred fifty thousand dollars ($4,750,000) for Improvement Area No. 1, and in a principal amount not to exceed seven million dollars ($7,000,000) for Improvement Area No. 2, to finance the Improvements and Fees, all under and pursuant to the terms and provisions of the “Mello Roos Community Facilities Act of 1982,” being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of California, commencing with Section 53311 (the “Act”).

This Notice contains a brief summary of the proposal embodied in the Resolution of Intention and the Resolution to Incur Bonded Indebtedness (collectively, the “Proposal”), but you are referred to the Authority’s Resolution of Intention and its Resolution to Incur Bonded Indebtedness on file with the Authority for the definitive description of the Proposal, including a description of the Improvements and Fees, a list of incidental expenses and bond issuance costs and the rate and method of apportionment of the proposed special tax for the Community Facilities District.

The Proposal consists of the authorization of (1) the special tax within the Community Facilities District to finance the Improvements and Fees, (2) the issuance of bonds to finance the Improvements and Fees, and (3) the establishment of the initial annual appropriations limit for the Community Facilities District in the amount of four million seven hundred fifty thousand dollars ($4,750,000) for Improvement Area No. 1, seven million dollars ($7,000,000) for Improvement Area No. 2, and two million dollars ($2,000,000) for Improvement Area No. 3.

In order to confer the authority upon the Authority to levy the special tax and to issue the bonds, a public hearing must be held on the Proposal, the Authority must determine to form the Community Facilities District, and the qualified electors within each Improvement Area of the Community Facilities District must approve the Proposal by a two-thirds vote.  As each Improvement Area of the Community Facilities District is uninhabited, or inhabited by fewer than 12 registered voters, the qualified electors are, pursuant to the Act, the owners of property within each Improvement Area of the Community Facilities District.

Any protests to the Proposal may be made orally or in writing by any interested persons or taxpayers, except that any protests pertaining to the regularity or sufficiency of the proceedings shall be in writing and shall clearly set forth the irregularities and defects to which objection is made.  The Commission may waive any irregularities in the form or content of any written protest and at the public hearing may correct minor defects in the proceedings.  All written protests not presented in person by the protester at the public hearing shall be filed with the Secretary of the Authority at or before the time fixed for the public hearing in order to be received and considered.  Any written protest may be withdrawn in writing at any time before the conclusion of the public hearing.

Written protests by a majority of the registered voters residing and registered within the Community Facilities District (if at least six such voters protest), or by the owners of a majority of the land area within the Community Facilities District not exempt from the proposed special tax, will require suspension of these proceedings forming the Community Facilities District and designating the Improvement Areas for at least one year. If such protests are directed only against certain elements of the proposed Improvements or Fees or special tax, only those elements need be excluded from the proceedings.

The Authority’s special tax consultant, in consultation with and on behalf of the Local Agency, has studied the Community Facilities District and will provide, at or before the time of the public hearing, a report which will contain a brief description of the Improvements by type which in their opinion will be required to adequately meet the needs of the new development expected to occur within the Community Facilities District, together with estimates of the cost of financing the acquisition and construction of the Improvements, and an estimate of the incidental expenses related thereto.  The report will be available for inspection by the public, and will become a part of the record of the public hearing.  Questions should be directed to DTA, Inc.
