NIB 1. General Description

The City of Fresno is soliciting bids to purchase Medium Accessible Paratransit Cutaways Unleaded Vehicles for delivery as stated in SC 6.1 Delivery Schedule.

The units shall be an air-conditioned low floor transit coaches comprised of a single functional unit. They shall have seating, as further described and shall have doors, and floor configurations suitable for City passenger use. Vehicles shall be supplied with a wheelchair ramp at the rear entrance and wheelchair positions with restraints.

In all cases, materials must be new and furnished as specified. Where brand names or specific items are used in these specifications, consider the term “reviewed equal” to follow. Wherever such names appear, reviewed equals will be accepted only with the prior written concurrence from the City.

The Contractor shall conform to these technical specifications and shall not omit any unit or component or both, part or detail to make these buses ready for service, even though such part or detail is not mentioned in these specifications. In absence of a specification, the Contractor shall adhere to its manufacturing standards. No changes or substitutions are permitted without the prior written consent of the City. This procurement will allow retirement of older buses and expansion of the revenue fleet. The City’s overall objective for purchase, design, and operation of anew fleet of buses shall be to satisfy the following requirements:

·        Safe and Reliable in Operation

·        Economic to Purchase, Operate and Maintain

·        Optimized Performance, Emissions and Fuel Consumption

·        Full compliance with all applicable rules, regulations, and standards in place at the time of manufacturing.

The accessible paratransit vehicles shall have a sleek, aerodynamic, modern, and fashionable design that is aesthetically appealing. A raised roof cap shall be designed to run the entire roof of the bus and conform to the contours of the body’s sleek, aerodynamic, modern, and fashionable design of the bus. The raised roof cap shall mask the electrical, HVAC system, battery system, and any other roof mounted equipment of the bus. The raised roof cap shall flow seamlessly from the top of the windshield to the rear of the bus. The windows shall be hidden framed and mount flush with the exterior of the bus. All

exterior panels shall have a smooth and seamless look with no visible fasteners. Exterior access doors shall be designed to be functional with a sleek and discrete look.

This project is funded in part with financial assistance from the U.S. Department of Transportation, Federal Transit Administration (FTA). The successful proposer shall be knowledgeable of and in

NIB 8.1 Applicable FTA Guidance

FTA Circular 4220.1F provides contracting guidance for recipients of federal assistance awarded by FTA when using that federal assistance to fund procurements or third party contracts. FTA also publishes a Best Practices Procurement Manual (BPPM) which is available on FTA’s website. NOTICE IS HEREBY GIVEN that on Thursday, July 1, 2021 at 6:30 p.m. or as soon thereafter as the matter can be heard, the Fowler Planning Commission will hold a regular meeting at the City Hall Council Chamber at 128 S. 5th Street, Fowler, California to hear and consider the following:

1.       General Plan Update Workshop. The Planning Commission will consider the Land Use Alternatives Summary & Recommendations Report as presented by staff and make a recommendation to the City Council for a preferred land use alternative for the City of Fowler General Plan. This item is scheduled for 6:30 p.m. to 7:30 p.m.

2.       Tentative Parcel Map No. 21-01 (Alan Mok Engineering). This project proposes to create a 0.95-acre (41,547.90 s.f.) parcel and a 0.22-acre (9,397.06 s.f.) parcel from an existing 1.16-acre parcel located at the southeast corner of South 10th Street and Vacated Fowler Avenue (APN 343-201-08). The project will support the development of Conditional Use Permit 18-04, a previously approved request to allow drive-through restaurants and/or retail facilities and a marquee sign measuring 675 square feet in area. The Planning Commission will also consider adoption of a Finding of a Categorical Exemption pursuant to CEQA Guidelines Section 15332. Recommendations on all project components will be forwarded to the City Council for its consideration at a future meeting.

3.       Zoning Text Amendment No. 21-01 and Categorical Exemption. This project proposes to amend Title 9, Chapter 5, Article 22, Section 17 of the Fowler Municipal Code to allow uses with drive-throughs to have multiple drive-through menu boards. The application includes a proposed finding of exemption from the California Environmental Quality Act (CEQA Guidelines Section 15311).

4.       Conditional Use Permit Application No. 21-02 and Categorical Exemption. This project proposes to establish a recycling center use. The Planning Commission will also consider the adoption of a Categorical Exemption analyzing the potential project impacts pursuant to the California Environmental Quality Act (CEQA). The subject property is located at 600 North 8th Street (APN: 345-190-09) at the northwest corner of East Adams and North 8th Streets.

The Commission requests your participation and the public is welcome to speak at the workshop and the hearing on the project or the environmental document. If you challenge any Planning Commission action in court, you may be limited to challenge only those issues raised at the Planning Commission hearing or subsequently at the City Council public hearing if the Planning Commission action is appealed, or prior to, the public hearing.

NOTICE INVITING BIDS

NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to, 0.5- mile of street rehabilitation on Shaw Avenue from Sunnyside to Fowler including grinding and replacing A.C. pavement, replacements of concrete curb returns, sidewalks and minor median island, adjustments of existing utility boxes, manholes, and utility valve boxes to finish grades, replacements of traffic striping, markings and signage, traffic signal modification, and reinstallation of traffic loop detectors. This project also involves rehabilitation of asphalt concrete sections in full depth at the Shaw-Sunnyside Intersection and Shaw-Fowler Intersection for the Shaw Avenue Street Rehabilitation (“Project”).

A complete listing of bid quantities is contained in the bid proposal form. Bids will be received for the complete work in accordance with the plans and specifications on file with the City Clerk at the Clovis Civic Center, Clovis, CA. Plans and specifications, forms of proposal, contract and special provisions can be downloaded free of charge from the vendor portal of PlanetBids, Inc., which is accessible on the City of Clovis website.

Bids must be filed with the City Clerk at the Clovis Civic Center prior to 2:00 p.m., Tuesday, July 13, 2021, at which time the City Clerk will open said bids. Bids shall be submitted in sealed envelopes and marked:

Bid Proposal: Shaw Avenue Street Rehabilitation

No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer. Each bid must be accompanied by a certified or cashier’s check or bidder’s bond on the City’s form, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid. Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract. A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials (Payment) Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded. Said bonds shall be on the City’s forms and shall be issued by a surety company which is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, which has a rating not lower than “A-” as rated by A.M. Best Company, Inc. or other independent rating companies, and which is acceptable to the City of Clovis. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance. In accordance with the provisions of Chapter 13 (commencing with Section 4590), Division 5, Title 1 of the Government Code of the State of California, securities may be substituted for monies withheld on the project.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done. Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612. A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.

In accordance with the provisions of Sections 1725.5, 1771.1, 1771.3, and 1771.4 of the Labor Code, this project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal (subject to the requirements of Section 4104 of the Public Contract Code), or engage in the performance of any contract for public work, as defined by that chapter of the Labor Code, unless currently registered and qualified to perform public work pursuant to Section 1725.5 of the Labor Code. See Section 7-2 of the Standard Specifications (General Conditions) for additional requirements.

The City of Clovis will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

The Federal minimum wage rates for this project as predetermined by the United States Secretary of Labor are set forth in the Bid book and in copies of this book that may be examined at the offices described above where project plans, special provisions, and bid forms may be seen.  The latest edition is also available from the Internet web site at

U.S. General Services Administration and archives are available through the beta.SAM.gov. Addenda to modify the Federal minimum wage rates, if necessary, will be issued to holders of Bid book. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are

referenced but not printed in the general prevailing wage rates. “Modifications” to the wage rates typically change the wage rate or fringe benefits for particular crafts and trades included in the original decision. Modifications will not be effective if they are received after the bid opening or later than ten (10) days prior to the bid opening (unless there is reasonable time to notify bidders). Modifications received prior to ten (10) days before the bid opening will require notification of bidders by Addendum.

Attention is directed to the Federal minimum wage rate requirements in the Bid book. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. The Department will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes “helper” (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the duties of the employees in question.

Bidders are advised that, as required by federal law, the City of Clovis is implementing new Disadvantaged Business Enterprise requirements for Disadvantaged Business Enterprises (DBE). Section 2, “Proposal Requirements and Conditions,” under subsection titled “Disadvantaged Business Enterprises (DBE)” and Section 5, “General,” under subsection titled “Performance of Subcontractors” of these special provisions cover the DBE requirements. The DBE Contract goal is thirteen percent (13%). The Agency may consider the DBE commitments of the 2nd and 3rd bidders when determining whether the low bidder made good faith efforts to meet the DBE goal.

This project is subject to “Buy America” requirements of the Surface Transportation Assistance Act of 1982 (Section 165), and the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) Sections 1041(a) and 1048(a), Title 23 CFR 635.410, and the regulations adopted pursuant thereto.

This project is also subject to the Cargo Preference Act (CPA) implementing regulations in Title 46 CFR 381, “Cargo Preference – U.S.-Flag Vessels”, for all Federal-aid projects.

All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form. The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”. Bidders for this project must possess a valid Class A or C12 License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available. Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract. All representations made on the proposal are made under penalty of perjury.

The lowest bid shall be determined by the amount of the base bid. The Owner reserves the right to add or deduct any of the additive or deductive items after the lowest responsible and responsive bidder is determined.

The City of Clovis reserves the right to reject any or all bids, to waive any informalities or minor irregularities in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interest of the City of Clovis.

Time of completion for the Project shall be Thirty (30) Working Days from the date established in the Owner’s Notice to Proceed.

Unless otherwise required by law, no bidder may withdraw its bid for a period of sixty (60) days after the date set for the opening thereof or any authorized postponement thereof. The Owner reserves the right to take more than sixty (60) days to make a decision regarding the rejection of bids or the award of the Contract.
