NOTICE OF INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION

CITY OF PARLIER FIG TREE PARK PROJECT

NOTICE IS HEREBY GIVEN that the City of Parlier (City) plans to adopt a Mitigated Negative Declaration for the City of Parlier Fig Tree Park Project (Project). The public hearing will be held at the City of Parlier – at the City Hall, City Council Chambers, located at 1100 E Parlier Ave, Parlier, CA 93648, on Thursday, August 4th, at 6:30 pm. 

The proposed Project would construct a new community park on a portion of the undeveloped area of Fresno County Assessor Parcel Number 355-041-24T in central Parlier. The Project would plant new trees, create a natural bioswale to capture stormwater, and construct a jogging and walking pathway around the perimeter of the park. The Project proposes to install solar light fixtures to provide lighting along the walkway during the evenings once the Project has been completed. The City of Parlier’s official park hours are from 7AM to 10PM. The Project would include ADA on-site parking. The Project includes restrooms with low-flow toilets and would be designed with environmental sustainability features (i.e. recycled materials, solar lights, environmentally friendly hardscape, etc.) The proposed Project would cover approximately 1.76 acres of land.

Pursuant to the California Environmental Quality Act, an Initial Study/Mitigated Negative Declaration has been prepared, describing the degree of potential environmental impacts of the Project. The City has assessed the potential environmental impacts of this Project and has determined that they will be less than significant with mitigation. Copies of the Initial Study and proposed Mitigated Negative Declaration are on file and available for public review upon written notice to 1100 E Parlier Ave, Parlier, CA 93648. The public review period during which the City will receive comments on the proposed Mitigated Negative Declaration will begin on June 15, 2022, and end on July 14, 2022. Notice is hereby given that on May 12 2022, the City Council of the City of Fresno (“City”) adopted Council Resolution No. 2022-116 to annex Parcel Map No. 2020-05 to the City of Fresno Community Facilities District No. 9 (“CFD No. 9”) and to authorize the levy of Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”).  Under this City Law and Council Resolution No. 2022-116, the City gives notice as follows:

The text of Council Resolution No. 2022-116, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Council Resolution No. 2022-116 is summarized as follows:

a.  As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 9, the boundaries of which are shown on the map on file with the City Clerk.

b.  The purpose of CFD No. 9 is to provide services and maintenance for certain regulatory required public improvements that are constructed or installed on public property, dedicated rights-of-way or easements on the perimeter of commercial, industrial and multi-family subdivisions.  These improvements include, without limitation, landscaping and irrigation systems, street trees, median hardscaping, local street curbs, gutters, sidewalks, street paving, street name signage and street lights, trails and trail amenities (“Services”).

c.  The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 9 under the rate and method of apportionment described in Council Resolution No. 2022-116 and Exhibit C thereto.  The special tax requires the approval of two-thirds of the qualified electors of CFD No. 9 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.

d.  The Special Tax, if approved, will be used to finance all or a portion of the Services.

e.  The Director of Public Works or his designee of the City is directed to cause to be prepared a written report for CFD No. 9, Annexation No. 54 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 9 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.

f.   As set forth below, the City will hold a public hearing on the annexation of Parcel Map No. 2020-05 to CFD No. 9 with its Services and Special Tax.

g.  The time and place established under Council Resolution No. 2022-116 for the public hearing required under City Law are Thursday, June 23, 2022, at the hour of 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.

    At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 9, the extent of CFD No. 9 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 9, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 9 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 9 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 9, or against levying a specified Special Tax, those types of facilities or the specified special tax will be eliminated from the proceedings to annex to CFD No. 9.

     The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 9.

Contractor certifies that Contractor and its trustees, shareholders, partners, officers, employees, agents, representatives, subcontractors, and students will not access SCCCD owned or operated indoor space for more than 15 minutes, unless the person accessing the indoor space is fully vaccinated against COVID-19.  Contractor certifies that it has collected and maintains proof that all persons accessing SCCCD indoor space are fully vaccinated against COVID-19.  Contractor will show proof of vaccination for any person who has accessed, or will access, SCCCD indoor space, upon SCCCD’s request.  These requirements are effective as of October 15, 2021 including current modernization projects.  Exceptions will be granted for new or existing projects when contractor, contractor employees, subcontractors, or other contractor representatives will not enter SCCCD District occupied facilities for longer than 15 minutes.

Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code §1725.5 (“DIR Registered Contractor”).  A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness.  Pursuant to Labor Code §1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors.  If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.

The Work is subject to payment of Prevailing Wage Rates (PWRs).  The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided.  Pursuant to Labor Code §1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.

Fresno Housing is requesting bids for two projects at Wedgewood commons located at 2415 Fifth Street, Sanger, CA 93657; one interior rehabilitation project and another for exterior asphalt and concrete work. Interested individuals can bid on one or both separate solicitations (interior/exterior). The bids shall include all labor, equipment, materials, and supplies necessary to complete the project/s, (except if otherwise stated within the specifications, set forth in the General Scope of Work, and in a condition acceptable to Fresno Housing (FH).

Wedgewood Commons Interior Rehab – B22002

FH is requesting bids for the modification and installation interior light fixtures, ceiling fans and miscellaneous rehab work on approximately 64 single story apartment units.

Wedgewood Commons Exterior Rehab – B22003

FH is requesting bids for the concrete sidewalk replacement, asphalt repair/ replacement, seal and striping of the H/C parking stalls and accessible paths to the trash enclosures, and the modification of the asphalt parking for the office parking area, the asphalt and concrete work modifications, and the installation and striping signage.
