WHEREAS, the County provides street lighting services, open space maintenance and public right-of-way landscape maintenance, in County Service Area No. 34, Zone D – Renaissance at Bella Vista (CSA 34D);

WHEREAS, Government Code section 25215.3 authorizes the Board of Supervisors (Board), on behalf of CSA 34D, to impose a benefit assessment in CSA 34D under the Landscaping and Lighting Act of 1972 (Streets and Highways Code, Division 15, Part 2, beginning with section 22500) for street lighting services, open space maintenance, and public right-of-way landscape maintenance, subject to the requirements of California Constitution, Article XIII D, section 4; and

WHEREAS, the “improvements” for purposes of Streets and Highways Code section 22525 are generally described as open space maintenance, the maintenance of public right-of-way landscape, which includes landscaping and irrigation systems, and street lighting services within CSA 34D; and

WHEREAS, before adopting this Resolution, the Board considered all testimony and documentary evidence, and gave all persons a full and fair opportunity to be heard with respect to any matter relating to the subject of this Resolution, both in favor and against it, and any matter relevant to these proceedings, all of which was done in the interest of the public, and the Board is fully informed of all matters referred to in this resolution.

NOW, THEREFORE, the Board of Supervisors of the County of Fresno does hereby find, determine, and resolve as follows :

Section 1.   The above recitals are all true and correct.

Section 2.   The Board hereby proposes to proceed under Chapter 3 of the Landscaping and Lighting Act of 1972 to levy and collect in the Assessment District, for CSA 34D, an assessment of the total cost of the street lighting services, open space maintenance and public right-of-way landscape maintenance for the 2022-23 fiscal year.

Section 3.   In connection with the proceedings that are the subject of this resolution, the Board hereby appoints and designates Steven E. White, P.E., Director, Department of Public Works and Planning, County of Fresno, registered under the Professional Engineers Act (Division 3, Chapter 7 of the California Business and Professions Code, beginning with section 6700), as the Assessment Engineer (Assessment Engineer).

Section 4.   The Assessment Engineer is hereby ordered to prepare and, no later than May 17, 2022, file with the Clerk of the Board a written report (Engineer’s Report) with regard to an assessment of the total cost street lighting services, open space maintenance, and public right-of-way landscape maintenance in CSA 34D for the 2022-23 fiscal year. The Engineer’s Report shall comply with the requirements of Streets and Highways Code, Division 15, Part 2, Chapter 1, Article 4, beginning with section 22565, and section 4 of Article XIII D of the California Constitution.

Section 5.   The Board hereby finds and determines that it took all of the foregoing actions and made all of the foregoing findings in full compliance with the law, including, without limitation, the Landscape and Lighting Act of 1972, Article XIII D of the California Constitution, and any other law referred to in this resolution.   All proceedings referred to in this resolution have been taken with respect to CSA 34D.

Section 6. This Resolution shall take effect immediately upon its adoption.

Section 7.   The Clerk of the Board shall certify to the adoption of this Resolution and shall cause a certified copy of this Resolution to be filed in the office of the Clerk.

WHEREAS, the Engineer’s Report contains a full and detailed description of the improvements, the boundaries of the Assessment District, and the proposed assessments upon assessable lots and parcels of land within the Assessment District; and

WHEREAS, the Engineer’s Report is on file with the Clerk of the Board; and

WHEREAS, before adopting this Resolution, the Board considered all testimony and documentary evidence, and gave all persons a full and fair opportunity to be heard with respect to any matter relating to the subject of this Resolution, both in favor and against it, and any matter relevant to these proceedings, all of which was done in the interest of the public, and the Board is fully informed of all matters referred to in this resolution.

The Board hereby declares its intention to levy and collect an assessment in the Assessment District, under Chapter 3 of the Landscaping and Lighting Act of 1972, for street lighting services, open space maintenance, and public right-of-way landscape maintenance for the 2022-23 fiscal year. The assessment is not proposed to increase from the previous year, under the definition of “increase” provided by Streets and Highways Code section 22630.5, Government Code section 54954.6, subdivision (a)(1)(D), and Government Code section 53750, subdivision (h)(1), because it does not increase any applicable rate used to calculate the assessment, revise the methodology by which the assessment is calculated, or result in an assessment being levied on any person or parcel that exceeds what was approved in the Proposition 218 proceeding in 2017, but applies the inflation increases approved by the Board in Resolution 17-544, and for those reasons is not subject to the special notice, protest, hearing, and assessment balloting procedures under Government Code section 53753.

Section 3.   A public hearing of the Board is hereby set for June 7, 2022, at 9:30A.M., or as soon after as practicable, in the Board Room of the Fresno County Board of Supervisors, Room 301, Hall of Records, 2281 Tulare Street, Fresno, California, 93721, for hearing all objections and protests to the annual assessment, the amount assessed against each parcel, and related matters as set forth in the Engineer’s Report (collectively, Public Hearing).   The Public Hearing shall be held under Sections 22629 through 22631 of the California Streets and Highways Code.   The Public Hearing may be continued from time to time by the Board without further notice, except that it may not be continued to a date after August 10, 2022, without prior consent of the County Auditor-Controller/Treasurer-Tax Collector.

Section 4   The Board hereby authorizes and directs the Clerk of the Board to cause notice of the filing of the Engineer’s report, and of the time, date, and place of the Public Hearing to be published under Government Code section 6061, one time, at least 10 days before the Public Hearing, as required by Streets and Highways Code sections 22552 and 22553. The publication required by this Section 4 of this resolution shall include all the information in this resolution.

Section 5. Property owners wishing to preserve the opportunity to file a lawsuit challenging the assessment, if levied, must file a written protest and state therein the specific grounds of protest.   Any grounds of protest not stated in a written protest filed prior to the close of the public hearing of protests are deemed waived in any subsequent lawsuit and may not be raised in such lawsuit.

Section 6. The validity of the assessment announced by the Board of Supervisors shall not be contested in any action or proceeding unless the action or proceeding is commenced within thirty days after the assessment is announced and adopted (Fresno County Ordinance Code section 4.28.040).

Section 7. The Board hereby finds and determines that it took all of the foregoing actions and made all of the foregoing findings in full compliance with the law, including, without limitation, Landscaping and Lighting Act of 1972, Article XIII D of the California Constitution, and any other law referred to in this resolution. All proceedings referred to in this resolution have been taken with respect to the Assessment District for CSA 34D.

Notice is hereby given that the County of Fresno has prepared Initial Study (IS) No. 7962 pursuant to the requirements of the California Environmental Quality Act for the following proposed project:

INITIAL STUDY NO. 7962 and DIRECTOR REVIEW AND APPROVALAPPLICATION NO. 4642 filed by CVEAS, INC, proposing to allow the maintenance and storage of trucks and trailers to be devoted exclusively to the transportation of agricultural products, supplies and equipment, on an approximately 2.5-acre portion of a 34.76-acre parcel in the AE-20 (Exclusive Agricultural, 20-acre minimum parcel size) Zone District. The project site is located on the southwest corner of E. A public hearing of the Board is hereby set forJune 7, 2022, at 9 : 30A.M., or as soon after as practicable, in the Board Room of the Fresno County Board of Supervisors, Room 301, Hall of Records, 2281 Tulare Street, Fresno, California, 93721, for hearing all objections and protests to the annual assessment, the amount assessed against each parcel, and related matters as set forth in the Engineer’s Report (collectively, Public Hearing).   The Public Hearing shall be held under Sections 22629 through 22631 of the California Streets and Highways Code.   The Public Hearing may be continued from time to time by the Board without further notice, except that it may not be continued to a date after August 10 without prior consent of the County Auditor-Controller/Treasurer-Tax Collector.

Section 4. The Board hereby authorizes and directs the Clerk of the Board to cause notice of the filing of the Engineer’s report, and of the time, date, and place of the Public Hearing to be published under Government Code section 6061, one time, at least 10 days before the Public Hearing, as required by Streets and Highways Code sections 22552 and 22553. The publication required by this Section 5 of this resolution shall include the information of this Resolution.

Section 5. Property owners wishing to preserve the opportunity to file a lawsuit challenging the assessment, if levied, must file a written protest and state therein the specific grounds of protest.   Any grounds of protest not stated in a written protest filed prior to the close of the public hearing of protests are deemed waived in any subsequent lawsuit and may not be raised in such lawsuit.

Section 6. The validity of the assessment announced by the Board of Supervisors shall not be contested in any action or proceeding unless the action or proceeding is commenced within thirty days after the assessment is announced and adopted (Fresno County Ordinance Code Section 4.28.040).

Section 7. The Board hereby finds and determines that it took all of the foregoing actions and made all of the foregoing findings in full compliance with the law, including, without limitation, Landscaping and Lighting Act of 1972, Article XIII D of the California Constitution, and any other law referred to in this resolution. All proceedings referred to in this resolution have been taken with respect to the Tenaya Park Assessment District for CSA 2.

Section 8. This Resolution shall take effect immediately upon its adoption.

Section 9. The Clerk of the Board shall certify to the adoption of this Resolution and shall cause a certified copy of this Resolution to be filed in the office of the Clerk.

FRESNO COUNTY DRAFT ANNUAL ACTION PLAN

The County of Fresno’s draft Annual Action Plan of proposed uses for Community Development Block Grant (CDBG), HOME Investment Partnership Program (HOME), and Emergency Solutions Grants (ESG) funds during the 2022-23 program year is available for public review and comment.   Copies of the Plan are available for review at the County’s Community Development Division office, 2220 Tulare St., 8th Floor, Fresno, CA and at the Fresno County Central Library, 2420 Mariposa St., Fresno, CA.   The draft Action Plan can also be found online at http://www.co.fresno.ca.us/grants.

PUBLICATION OF SUMMARY OF PROPOSED ORDINANCE

COUNTY OF FRESNO

The Fresno County Board of Supervisors is giving notice that at their regularly scheduled meeting on June 7, 2022 at 9: 30 a.m., or as soon thereafter as the matter may be heard, at the Fresno County Hall of Records, Board of Supervisors Chambers, 3rd Floor, 2281 Tulare Street, Fresno, California, they will consider adoption of the ordinance summarized below.

SUMMARY OF PROPOSED ORDINANCE

The proposed ordinance would amend Title 8 of the County of Fresno Ordinance Code that addresses and governs the management, collection, and diversion of solid waste. Chapter 8.27 shall establish the Organics Disposal Reduction Program, applicable with respect to the collection, transportation, and recycling of organic waste within the County.   The State of California, through its enactment of Senate Bill 1383 (“SB 1383;” Chapter 395, Statutes of 2016), mandated that jurisdictions achieve significant reductions in Short-Lived Climate Pollutants through reduction of organic waste disposal in landfills by 2025.   SB 1383 authorized creation of regulations (14 CCR, Sections 18891.1-18998.4) that prescribe standardized solid waste collection systems and protocols that facilitate traditional gray container (trash) and blue container (recyclables) waste collection, but expand green container materials collection to include “organics” which is both green waste (grass, leaves, branches, etc.) and food waste.   The proposed ordinance would :   (1) create an organic waste collection program in the County that would be executed through the existing solid waste “Exclusive Service Area Program” or “ESAP”; (2) establish the County’s “Designated Collection System” which would be a three container source separated materials system; (3) outline waste diversion requirements for single-family, multifamily, and commercial generators of organic waste; (4) outline requirements for commercial edible food generators, food recovery organizations and services, haulers, and facility operators; (5) establish criteria applicable to commercial organic waste generators for qualifying for a waiver from waste diversion requirements; (6) establish “self-hauling” and outline requirements for generators who opt to forego collection service and provide for hauling themselves; (7) create protocols for performing inspections and investigations related to compliance with the proposed ordinance and State of California regulations; and (8) establish enforcement powers and protocol and authorizes the use of punitive enforcement tools such as administrative citations, fines, as well as less punitive tools such as education and outreach materials for addressing   non-compliance.

Community Services District No. 2004-1

Notice is hereby given by the City of Clovis that the City Council, on April 18, 2022, adopted A Resolution of Intention to Annex Territory to Maintenance District and to Authorize the Levy of Special Taxes Therein (the “Resolution of Intention”) stating its intention to annex the territory (Annexation #73) to the City’s Community Facilities District No. 2004-1 (Police and Fire Services) (the “District”), pursuant to Mello Roos Community Facilities Act of 1982, Sections 53311 and following, California Government Code (the “Act”).   Reference is hereby made to the Resolution of Intention, on file with the City Clerk of the City for further particulars.

Pursuant to the Resolution of Intention, the Council determined that certain territory, as more particularly described in the Resolution of Intention, be annexed to the existing District, all as provided in the Act.   The Resolution of Intention provides that the special taxes heretofore caused to be levied in the District for financing the public facilities and services provided through the District shall be levied in the territory proposed to be annexed, subject to public hearing and landowner election proceedings as specified in the Act.

Notice is further given that Monday, June 6, 2022, at the hour of 6 : 00 o’clock p.m., in the regular meeting place of the City Council, City Hall, 1033 Fifth Street, Clovis, California, are the time and place when and where the Council of the City as the legislative body for the District, will conduct a public hearing on the annexation of the territory described in the Resolution of Intention to the District and finally consider and determine whether the public convenience and necessity require the annexation of said territory to the District and the levy of special taxes therein.

Notice is further given that at the hearing, the testimony of all interested persons for and against the annexation of said territory to the District or the levying of special taxes within the territory proposed to be annexed will be heard.

NOTICE OF INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION

CITY OF PARLIER FLOOD PROTECTION PROJECT

NOTICE IS HEREBY GIVEN that the City of Parlier (City) plans to adopt a Mitigated Negative Declaration for the City of Parlier Flood Protection Project (Project). The public hearing will be held at the City of Parlier – at the City Hall, City Council Chambers, located at 1100 E Parlier Ave, Parlier, CA 93648, on Thursday, July 7th, at 6: 30 pm. 

The proposed Project involves the upsizing of the existing stormwater collection system in the southeast area of the City of Parlier. This Project consists of the following: installing approximately 2, 000 linear feet of larger-sized storm drains and manholes, installing a stormwater pump station at the Merced Stormwater Basin for redundancy, and deepening the east section of the existing Richard Flores Stormwater Basin. The Project consists the existing Richard Flores Stormwater Basin at the northeastern intersection of 1st Street and South Newmark Avenue (APN 355-192-14ST), the Merced Stormwater Basin located at the northeast intersection of Tuolumne Street and South Newmark Avenue, as well as along sections of J Street, Merced Street, K Street, and Tulare Street in the City of Parlier.

Pursuant to the California Environmental Quality Act, an Initial Study/Mitigated Negative Declaration has been prepared, describing the degree of potential environmental impacts of the Project. The City has assessed the potential environmental impacts of this Project and has determined that they will be less than significant with mitigation. Copies of the Initial Study and proposed Mitigated Negative Declaration are on file and available for public review upon written notice to 1100 E Parlier Ave, Parlier, CA 93648. The public review period during which the City will receive comments on the proposed Mitigated Negative Declaration will begin on May 20, 2022, and end on June 20, 2022. The initial period of any such debarment shall not be less than one year and may be permanent depending on the violation. A Proposer may request a hearing, in accordance with Fresno Municipal Code Section 4-104, upon receipt of a notice of proposed debarment from the City Manager or designee. The Caruthers Community Services District is soliciting bids for construction of the Sludge Drying Bed, CDBG Project No. 20111. The Caruthers Community Services District hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award. Fresno Housing is seeking proposals from qualified firms to provide housing quality standard inspection services. The selected firm(s) will be required to perform all initial, annual, biennial, and compliant housing quality standard inspections for the Housing Choice Voucher (HCV) units, Project-Based Voucher (PBV) units, and units that the PHA has a controlling or financial interest.
