CUP2020-004, Review of a previously approved conditional use permit allowing the expansion of an existing athletic facility to include outdoor athletic training, activities, and events for a portion of an approximate 0.6 acre property located at 340 Clovis Avenue with regard to compliance with the conditions of approval. If the Planning Commission determines that the project is out of compliance with the conditions of approval, the Commission may act to modify CUP2020-004 and its conditions of approval or to revoke the permit pursuant to Section 9.92.060 of the Clovis Municipal Code. The City has determined that Project Item No.1 is in substantial conformance with the environmental analysis and environmental impact report performed for the Loma Vista Specific Plan. For Project Item No. 2, the original approval of CUP 2020-004 in September of 2020 was found to be exempt from CEQA pursuant to a Class I categorical exemption, which exempts existing facilities. No further review under the California Environmental Quality Act is required in conjunction with the review of project with regard to compliance with the conditions of approval. Any action by the City to enforce conditions or to revoke CUP2020-004, if required, is exempt from CEQA pursuant to a Class 21 categorical exemption, which exempts enforcement actions by regulatory agencies.

Subcontractors do not need to prequalify in order to bid on this project but are encouraged to prequalify for this project and other CUPCCAA projects by utilizing the Districts CUPCCAA prequalification form available at https://pbsystem.planetbids.com/portal/51469/portal-home.

Bids shall be based upon requirements as set forth in the contract documents, including plans and specifications, which may be obtained at:

Bids must be submitted via PlanetBids vendor portal at: https://pbsystem.planetbids.com/portal/51469/portal-home on form prepared by the District and included in the contract documents. Bids will be received no later than June 9, 2022 at 2:00 PM, via Planet Bids at https://pbsystem.planetbids.com/portal/51469/portal-home, after which time they will be opened electronically and bid results will posted on PlanetBids at or after 2:00 p.m. Only electronic bids submitted through PlanetBids will be accepted.

A pre-bid conference will take place in person on May 12, 2022 at 10:00 a.m. Those attending the non-mandatory pre-bid conference shall meet at: Address: 1101 E. University Ave, Fresno, CA 93741 (south entrance of Media Center).

Prospective bidders shall be required to have a valid Class C10 for electrical and pathways and C7 for low voltage Contractor’s License.

The successful bidder will be required to furnish a Payment Bond, a Performance Bond, Workers Compensation and General Liability, and Builder’s Risk Insurance as required by the Contract Documents. The successful bidder shall also be required to enter into a written agreement on a form provided by the District.

Bids must be accompanied by a bidder’s bond for at least ten (10%) of the amount of the bid and payable to the District, which shall be given as a guarantee that the bidder will enter into a contract if awarded the work. Said bond will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the District. An electronic copy of bid bond must be submitted and physical copy should be held with vendor and made available to District upon request.

COVID-19 guidelines and procedures for all construction sites and workers at all public works must be implemented at all times. Each Bidder and all Subcontractors will be required to abide by the California Department of Industrial Relations (DIR) Division of Occupational Safety & Health Publications Unit SAFETY AND HEALTH GUIDANCE COVID-19 INFECTION PREVENTION IN CONSTRUCTION guidelines, https://www.dir.ca.gov/dosh/coronavirus/COVID-19-Infection-Prevention-in-Construction.pdf. Contractors and Subcontractors will be required to stay updated on any changes to the DIR guidelines and to make sure they remain within compliance.

Contractor certifies that Contractor and its trustees, shareholders, partners, officers, employees, agents, representatives, subcontractors, and students will not access SCCCD owned or operated indoor space for more than 15 minutes, unless the person accessing the indoor space is fully vaccinated against COVID-19. Contractor certifies that it has collected and maintains proof that all persons accessing SCCCD indoor space are fully vaccinated against COVID-19. Contractor will show proof of vaccination for any person who has accessed, or will access, SCCCD indoor space, upon SCCCD’s request. These requirements are effective as of October 15, 2021 including current modernization projects. Exceptions will be granted for new or existing projects when contractor, contractor employees, subcontractors, or other contractor representatives will not enter SCCCD District occupied facilities for longer than 15 minutes.

Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code 1725.5 (“DIR Registered Contractor”). A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness. Pursuant to Labor Code 1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors. If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.

The Work is subject to payment of Prevailing Wage Rates (PWRs). The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided. Pursuant to Labor Code 1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.

The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference. Contractor must pay for any labor described or classified in an amount not less than rates specified.

Consistent with Public Contract Code section 22300, the District shall, at the request and expense of the Contractor, permit the substitution of securities or the payment of funds equivalent to the amount of monies withheld as retention from progress payments.

The Board of Trustees reserves the right to reject any or all proposals, waive any informality in the receiving of bids, and consider quality, convenience, and reasonable qualifications as well as price in making awards.

Notice is hereby given that Fresno County Superintendent of Schools (FCSS) is soliciting proposals from interested companies to provide various services in support of the expanded learning program. FCSS has issued the following requests for proposals (RFP):

MITIGATED NEGATIVE DECLARATION

Notice is hereby given that the County of Fresno has prepared Initial Study Application (IS) No. 8152 pursuant to the requirements of the California Environmental Quality Act for the following proposed project:

INITIAL STUDY APPLICATION NO. 8152 and UNCLASSIFIED CONDITIONALUSE PERMIT NO. 3725 filed by DANIEL MOSTO, proposing to allow a solid waste processing facility (reconditioning and refurbishing of bulk containers and drums) on a 2.16-acre parcel within the M-3 (Heavy Industrial) Zone District. The subject parcel is located on the south side of E. Jensen Ave., 190 feet east of S. Maple Ave., adjacent to the City of Fresno to the north (APNs: 487-070-45 & 46) (4646 E. Jensen Ave.) (Sup. Dist. 3). Adopt the Mitigated Negative Declaration prepared for Initial Study Application No. 8152 and take action on UNCLASSIFIED CONDITIONAL USE PERMIT NO. 3725.

The County of Fresno has determined that it is appropriate to adopt a Mitigated Negative Declaration for the Proposed Project. The purpose of this Notice is to (1) provide notice of the availability of IS Application No. 8152 and the draft Mitigated Negative Declaration and request written comments thereon; and (2) provide notice of the public hearing regarding the Proposed Project.
