NOTICE IS HEREBY GIVEN that on Thursday, May 26, 2022, at 6:00 p.m.,the Clovis Planning Commission will conduct a public hearing in the City Council Chamber, 1033 Fifth Street, Clovis, CA 93612, to consider the following items:

CUP2020-004, Review of a previously approved conditional use permit allowing the expansion of an existing athletic facility to include outdoor athletic training, activities, and events for a portion of an approximate 0.6 acre property located at 340 Clovis Avenue with regard to compliance with the conditions of approval. If the Planning Commission determines that the project is out of compliance with the conditions of approval, the Commission may act to modify CUP2020-004 and its conditions of approval or to revoke the permit pursuant to Section 9.92.060 of the Clovis Municipal Code. The City has determined that Project Item No.1 is in substantial conformance with the environmental analysis and environmental impact report performed for the Loma Vista Specific Plan. No major revisions will be required with the certified environmental impact report to accommodate the proposed project. Therefore, subject to CEQA Sections 15162 and 15182 no further environmental review is required for this project.

For Project Item No. 2, the original approval of CUP 2020-004 in September of 2020 was found to be exempt from CEQA pursuant to a Class I categorical exemption, which exempts existing facilities. No further review under the California Environmental Quality Act is required in conjunction with the review of project with regard to compliance with the conditions of approval. Any action by the City to enforce conditions or to revoke CUP2020-004, if required, is exempt from CEQA pursuant to a Class 21 categorical exemption, which exempts enforcement actions by regulatory agencies.

Regarding 2022-2023 District Budget and Assessment Tax

Notice is hereby given that the Budget Workshop of the Fresno Metropolitan Flood Control District will be held at 6:00 pm, on Wednesday, June 1, 2022 in the Fresno Metropolitan Flood Control District Board Chambers, 5469 E. Project scope includes installation of new video surveillance cameras, wireless access points and facility paging speakers to be connected to existing system platforms.   Installation will include all equipment, cabling, pathways and associated firestopping. Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code   1725.5 (“DIR Registered Contractor”).   A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness.   Pursuant to Labor Code   1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors.   If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.

The Work is subject to payment of Prevailing Wage Rates (PWRs).   The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided.   Pursuant to Labor Code   1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.

The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference. Consistent with Public Contract Code section 22300, the District shall, at the request and expense of the Contractor, permit the substitution of securities or the payment of funds equivalent to the amount of monies withheld as retention from progress payments.

Notice is hereby given that the County of Fresno has prepared Initial Study Application (IS) No. 8152 pursuant to the requirements of the California Environmental Quality Act for the following proposed project:

INITIAL STUDY APPLICATION NO. 8152 and UNCLASSIFIED CONDITIONALUSE PERMIT NO. 3725 filed by DANIEL MOSTO, proposing to allow a solid waste processing facility (reconditioning and refurbishing of bulk containers and drums) on a 2.16-acre parcel within the M-3 (Heavy Industrial) Zone District. The subject parcel is located on the south side of E. Jensen Ave., 190 feet east of S. Maple Ave., adjacent to the City of Fresno to the north (APNs: 487-070-45 & 46) (4646 E. Jensen Ave.) (Sup. Dist. 3). Adopt the Mitigated Negative Declaration prepared for Initial Study Application No. 8152 and take action on UNCLASSIFIED CONDITIONAL USE PERMIT NO. 3725.

(hereafter, the “Proposed Project”)

The County of Fresno has determined that it is appropriate to adopt a Mitigated Negative Declaration for the Proposed Project.   The purpose of this Notice is to (1) provide notice of the availability of IS Application No. 8152 and the draft Mitigated Negative Declaration and request written comments thereon; and (2) provide notice of the public hearing regarding the Proposed Project.

Public Comment Period

The County of Fresno will receive written comments on the Proposed Project and Mitigated Negative Declaration from April 27th, 2022 through May 27, 2022.

An electronic copy of the draft Mitigated Negative Declaration for the Proposed Project may be obtained from Elliot Racusin at the addresses above.

Public Hearing

The Planning Commission will hold a public hearing to consider approving the Proposed Project and the Mitigated Negative Declaration on June 9th, 2022 at 8:45 a.m., or as soon thereafter as possible, in Room 301, Hall of Records, 2281 Tulare Street, Fresno, California 93721.   Interested persons are invited to appear at the hearing and comment on the Proposed Project and draft Mitigated Negative Declaration.
