The scope of work includes the rehabilitation of 18 sewer manholes and the installation of 1 polymer concrete manhole. The rehabilitation consists of the installation of 4 polymer concrete inserts and epoxy coating of the remaining 14. The manholes are located in Jensen Avenue between Fruit Avenue and Cherry Avenue, as shown on the Plans. Work shall include removal of grade rings, concrete repair, epoxy coating, installation of a polymer concrete manhole, adjusting channel openings, and removing and replacing manhole frame and covers, including all associated facilities, appurtenances, and incidentals, as shown on the plans, in conformance with the provisions in the specifications, and as directed by the Engineer.

The Engineer’s Estimate for this project is $880,000.

The scope of work includes, but is not limited to, construction of the Substation Expansion at the Regional Wastewater Reclamation Facility. This project will expand the existing substation to add another 70KV to 12KV transformer (pre-purchased and assigned to this contract), rated at 10 Mega Volt Amp (MVA). This expansion will include the addition of a high-side circuit switcher and connection to the existing switchgear installed in 2009.

The Construction Allocation for this project is $2,470,000.

The work hereunder constitutes a “public work” as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a “public work” in accordance with such Chapter of the California Labor Code. The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City. A copy of the resolution is on file at the Office of the City Clerk. Contractors and Subcontractors must meet any and all requirements of Labor Code sections 1771.1 and 1771.5 prior to submitting bids.

All proposals must be made on the Bid Proposal Form provided by the Purchasing Manager. A Bid Deposit, which can be provided separately, in the amount of TEN PERCENT (10%) of the Total Net Bid Amount (or, in bids with Add Alternates, the highest possible combination of the Base Bid plus Add Alternates) in the form of a certified or cashier’s check, an irrevocable letter of credit, or a certificate of deposit or a bidder’s bond executed by a corporate surety, admitted by the California Insurance Commissioner to do business in California, payable and acceptable to the City of Fresno; or the Bidder shall have registered with the Purchasing Manager of the City an annual bid bond sufficient to provide coverage in such amount. . All Bid Deposits will be held until a Contract has been executed with the successful Bidder or all bids have been rejected. Copies of Bid Deposits may be submitted electronically, with the exception of a certified or cashier’s check, which must be brought to the Purchasing Manager’s office and labeled accordingly with bid number prior to the bid opening.

A 100 percent Payment Bond and 100 percent Performance Bond for all public works contracts must be filed with the Contract Documents and approved by the City before the Contractor enters upon performance of the Work.

Bidders are advised that, as required by the Fresno Municipal Code, the city has established a National Targeted Worker mandatory participation level.

Bidders are advised that as required by the Fresno Municipal Code, the City of Fresno is implementing new National Targeted Worker requirements for public work of improvement contracts over $200,000. The mandatory participation level for National Targeted Workers is 15%.

No bid will be considered for award unless the Bidder at the time of bid opening, is licensed with a valid Class “A” Contractor’s License issued by the State of California.

The City reserves the right to reject any and all bids.

Bidders are advised that this contract is subject to the City’s Community Workforce Agreement, a project labor agreement executed by the City and the Fresno, Madera, Tulare, Kings Building Trades Council. Which includes a local hiring program, wherein the contractor must use best faith efforts to meet the hiring percentage requirements for Journey-level and apprentice level project work hours. Prospective bidders shall be required to have a valid Class B Contractor’s License.

The successful bidder will be required to furnish a Payment Bond, a Performance Bond, Workers Compensation and General Liability, and Builder’s Risk Insurance as required by the Contract Documents.  The successful bidder shall also be required to enter into a written agreement on a form provided by the District.

Bids must be accompanied by a bidder’s bond or certified check for at least ten (10%) of the amount of the bid and payable to the District, which shall be given as a guarantee that the bidder will enter into a contract if awarded the work. Said bond or certified check will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the District.

COVID-19 guidelines and procedures for all construction sites and workers at all public works must be implemented at all times.  Each Bidder and all Subcontractors will be required to abide by the California Department of Industrial Relations (DIR) Division of Occupational Safety & Health Publications Unit SAFETY AND HEALTH GUIDANCE COVID-19 INFECTION PREVENTION IN CONSTRUCTION guidelines, https://www.dir.ca.gov/dosh/coronavirus/COVID-19-Infection-Prevention-in-Construction.pdf  .  Contractors and Subcontractors will be required to stay updated on any changes to the DIR guidelines and to make sure they remain within compliance.

Contractor certifies that Contractor and its trustees, shareholders, partners, officers, employees, agents, representatives, subcontractors, and students will not access SCCCD owned or operated indoor space for more than 15 minutes, unless the person accessing the indoor space is fully vaccinated against COVID-19.  Contractor certifies that it has collected and maintains proof that all persons accessing SCCCD indoor space are fully vaccinated against COVID-19.  Contractor will show proof of vaccination for any person who has accessed, or will access, SCCCD indoor space, upon SCCCD’s request.  These requirements are effective as of October 15, 2021 including current modernization projects.  Exceptions will be granted for new or existing projects when contractor, contractor employees, subcontractors, or other contractor representatives will not enter SCCCD District occupied facilities for longer than 15 minutes.

Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code §1725.5 (“DIR Registered Contractor”).  A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness.  Pursuant to Labor Code §1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors.  If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.

The Work is subject to payment of Prevailing Wage Rates (PWRs).  The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided.  Pursuant to Labor Code §1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.

The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference. Contractor must pay for any labor described or classified in an amount not less than rates specified.

Consistent with Public Contract Code section 22300, the District shall, at the request and expense of the Contractor, permit the substitution of securities or the payment of funds equivalent to the amount of monies withheld as retention from progress payments.

The Board of Trustees reserves the right to reject any or all proposals, waive any informality in the receiving of bids, and consider quality, convenience, and reasonable qualifications as well as price in making awards.
