NOTICE INVITING BIDS PURSUANT TO PUBLIC CONTRACT CODE 22000, ET SEQ.
(THE UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT)
Notice is hereby given that the Fresno Unified School District (“DISTRICT”) will receive sealed bids for Bid No. 22-18, Ewing and Turner Elementary Schools Unit Ventilation, EMS, and Central Plant Equipment Replacement, to replace existing classroom HVAC equipment and related infrastructure.
Notice is hereby given pursuant to the provisions of Section 1770 et seq of the California Labor Code, each worker of the contractor and any of its subcontractors engaged in work on the Project shall be paid not less than the prevailing wage rate. The project is subject to compliance monitoring and enforcement by the Department of Industrial Relations (DIR).
Pursuant to Labor Code Section 1725.5, the DIR established a Contractor Registration Program, in which no contractor or subcontractor shall bid on, be listed in a bid, or engage in the performance of any public work contract without being registered.
Prime Contractor must have a valid Class “C-20” Contractor’s License.
A MANDATORY pre-bid conference has been scheduled at 11:00 AM, December 21, 2021 in front of the Administration Office at Ewing Elementary School, 4873 E. Olive Ave, Fresno CA 93727. Contractors bidding as a Prime Contractor for the project must attend in order for their bid to be “responsive”. Immediately following the pre-bid conference will be a mandatory job-walk of the sites.
This Project is subject to prequalification, pursuant to Public Contract Code 20111.6. Contractors submitting bids to perform as both Prime Contractor/General Contractor or Electrical, Mechanical, and Plumbing Subcontractor must be prequalified prior to bidding on the project. Prime Contractors must list prequalified mechanical, electrical and plumbing subcontractors or in order for their bid to be “responsive”. Electrical, Mechanical, and Plumbing subcontractors are contractors holding either: C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, and C-46 contractor’s license. Prequalified Prime Contractor may self-perform electrical, plumbing, mechanical work if prequalified under applicable licenses. Applications may be obtained from DISTRICT Purchasing Web Site: https://purchasing.fresnounified.org/prequalification-for-public-works or at DISTRICT Purchasing Department. Questionnaire and Financial Statement shall be submitted directly to DISTRICT Purchasing Department no later than 2:00 PM, December 30, 2021. Prequalification status is valid for one (1) calendar year for any subsequent projects requiring prequalification.
Sealed Bids must be received prior to 2:01 P.M. on January 12, 2022 on Procureware, the District’s online bidding portal, after which time the bids will be opened and bid results posted.
Bids shall be accompanied by a certified check, cashier’s check, or a bidder’s bond in an amount not less than ten percent (10%) of total bids made payable to Fresno Unified.
The substitution of appropriate securities in lieu of retention amounts from progress payments in accordance with Public Contract Code Section 22300 is permitted.

Pursuant to Public Contract Code 3400(c)(2), Fresno Unified School District finds that it is in the best interest of the DISTRICT to standardize the products, equipment, and materials listed in Exhibit A-1 and Exhibit A-2 in order to match other products/equipment in use on a particular work of improvement either completed or in the course of completion. Where a specific brand, trade name, material, or product identified in the bid documents is also listed in Exhibit A-1 or Exhibit A-2, it shall be deemed to be followed by the words “No Substitutions,” and CONTRACTOR shall not make or request substitutions regarding any such product, equipment or material. NEGATIVE DECLARATION
Notice is hereby given that the County of Fresno has prepared Initial Study (IS) No. 8111 pursuant to the requirements of the California Environmental Quality Act for the following proposed project:
INITIAL STUDY NO. 8111 for CLASSIFIED CONDITIONAL USE PERMIT APPLICATION NO. 3717 filed by KEN AND SUZAN BLAIR, proposing to amend CUP No. 2402 to add micro-brewery and tasting room as a new use to the uses currently allowed for an existing Agriculture Commercial Center on a 1.87-acre parcel in the AE-20 (Exclusive Agriculture; 20-acre minimum parcel size) Zone District. The project site is located on the east side of N. Academy Avenue, approximately 217 feet north of the intersection of Academy and Shaw Avenues, and 3.9 miles east of the nearest city limits of the City of Clovis (APN: 308-400-19) (5054 N. Academy Avenue) (Sup. Dist. 5). Adopt the Negative Declaration prepared for Initial Study No. 8111 and take action on Classified Conditional Use Permit Application No. 3717 with Findings and Conditions.

The successful bidder shall also be required to enter into a written agreement on a form provided by the District.
Bids must be accompanied by a bidder’s bond or certified check for at least ten (10%) of the amount of the bid and payable to the District, which shall be given as a guarantee that the bidder will enter into a contract if awarded the work. Said bond or certified check will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the District.
COVID-19 guidelines and procedures for all construction sites and workers at all public works must be implemented at all times. Each Bidder and all Subcontractors will be required to abide by the California Department of Industrial Relations (DIR) Division of Occupational Safety & Health Publications Unit SAFETY AND HEALTH GUIDANCE COVID-19 INFECTION PREVENTION IN CONSTRUCTION guidelines, https://www.dir.ca.gov/dosh/coronavirus/COVID-19-Infection-Prevention-in-Construction.pdf . Contactors and Subcontractors will be required to stay updated on any changes to the DIR guidelines and to make sure they remain within compliance. In addition to DIR Guidelines SCCCD has implemented new Covid-19 Vaccine Compliance guidelines as of October 15, 2021.
Contractor certifies that Contractor and its trustees, shareholders, partners, officers, employees, agents, representatives, subcontractors, and students will not access SCCCD owned or operated indoor space for more than 15 minutes, unless the person accessing the indoor space is fully vaccinated against COVID-19. Contractor certifies that it has collected and maintains proof that all persons accessing SCCCD indoor space are fully vaccinated against COVID-19. Contractor will show proof of vaccination for any person who has accessed, or will access, SCCCD indoor space, upon SCCCD’s request. These requirements are effective as of October 15, 2021 including current modernization projects. Exceptions will be granted for new or existing projects when contractor, contractor employees, subcontractors, or other contractor representatives will not enter SCCCD District occupied facilities for longer than 15 minutes.
Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code §1725.5 (“DIR Registered Contractor”). A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness. Pursuant to Labor Code §1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors. If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.
The Work is subject to payment of Prevailing Wage Rates (PWRs). The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided. Pursuant to Labor Code §1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.
The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference. Contractor must pay for any labor described or classified in an amount not less than rates specified.
Consistent with Public Contract Code section 22300, the District shall, at the request and expense of the Contractor, permit the substitution of securities or the payment of funds equivalent to the amount of monies withheld as retention from progress payments.
The Board of Trustees reserves the right to reject any or all proposals, waive any informality in the receiving of bids, and consider quality, convenience, and reasonable qualifications as well as price in making awards.
