Plaintiff has filed a civil complaint against you. You may contest the validity of the above matter by appearing and filing with the Court a written responsive pleading to the complaint not later than September 15, 2017, which is ten (10) days or more after the completion of the publication of this summons. Persons who contest the validity of the matter described below and in the complaint will not be subject to punitive action, such as wage garnishment or seizure of their real or personal property.
DETAILED SUMMARY OF THE MATTER THAT PLAINTIFF SEEKS TO VALIDATE:
The Department constructed and operates and maintains the State Water Project (Project). In recent years, the Department has undertaken to develop a comprehensive plan for the effective delivery of Project water across the Sacramento-San Joaquin Delta in conjunction with the conservation and rehabilitation of the environment and species in and around the Delta. Currently, Project water is conveyed across the Delta through the channels of the river delta formed by the confluence of the Sacramento and San Joaquin Rivers, as those channels have been modified over 150 years by the construction of levees, ship and other canals, flood protection channels, salinity gates and other facilities. The Department has approved the financing of the planning and design and, if and when appropriate, the acquisition and construction of conveyance facilities known as the “California WaterFix.” Broadly described, the California WaterFix would transport water from new intake points on the Sacramento River across the Delta by two underground tunnels running below the natural waterways of the Delta to export facilities at the southern edge of the Delta.
The Department is authorized to carry out its various duties and functions in relation to the Project by the Central Valley Project Act (Cal. Water Code §§ 11100 et seq.) (the “CVP Act”) and the Burns-Porter Act (Cal. Water Code §§ 12930 et seq.), among other authorities. The Department is authorized to construct units of the “project” as that term is defined by the CVP Act, and to issue revenue bonds to pay the capital costs of those units. Among its authorities, Section 11260 of the CVP Act authorizes the Department to include the California WaterFix as one or more of the units “provided for in this chapter[;]” Section 11454 of the CVP Act authorizes the Department to “do any and all things which in its judgment are necessary, convenient, or expedient for the accomplishment of the purposes and objects of this part[;]” and Section 11700 of the CVP Act authorizes the Department to issue revenue bonds “[f]or the purpose of providing money and funds to pay the cost and expense of carrying out any of the objects and purposes of this part.”
On July 21, 2017, the Department adopted resolutions authorizing, among other matters, the issuance of revenue bonds, in multiple series, the proceeds of which would be used to pay the costs of the planning, design, acquisition, and construction of the California WaterFix. On the same date, the Department filed its validation complaint pursuant to Code of Civil Procedure section 860 et seq. In its complaint, the Department alleges, among other things, that it is statutorily authorized to issue revenue bonds to finance the acquisition and construction of the California WaterFix and to pledge California WaterFix revenues to secure the payment of debt service on these bonds in the manner provided by the Department’s resolutions. In the authorizing resolutions, the Department found and determined that: (1) the preliminary cost estimate for California WaterFix, not including bond-related costs such as capitalized interest, costs of issuance and bond reserves, is $16 billion; (2) the estimated amount of such costs to be raised by the issuance of California WaterFix revenue bonds is $8.8 billion; (3) the probable amount of money, property, materials or labor, if any, to be contributed from other sources in aid of the California WaterFix is $7.2 billion; and (4) the principal amount of bonds estimated to be required to be issued by the Department for the California WaterFix is $11 billion.
The Department seeks in its validation action a judgment from the Court confirming the validity of the Department’s authorization of the issuance, sale, and delivery of the California WaterFix revenue bonds, the pledge of California WaterFix revenues to secure the payment of debt service on those bonds in the manner provided by the authorizing resolutions, and the resolutions and proceedings leading and related thereto, all as described in the validation complaint. The actual construction, operation, and maintenance of the California WaterFix is subject to statutory and regulatory requirements not at issue in the validation action, and the Department has not alleged in this action satisfaction of those requirements.

Sealed bids will be received by the City of Mendota prior to 10:00:00 a.m. (local time) on Friday, August 25th at City Hall, located at 643 Quince Street, Mendota, CA 95630, and following said deadline all bids will be publicly opened and read. Bids shall be submitted in a sealed envelope with the name of the bidder, the bidder’s state registration number, the name of the project and the statement “Do Not Open Until the Time of Bid Opening.” Bids received after said deadline will be returned unopened to the bidder.
1. A non-mandatory pre-bid meeting and project site tour will be held on Thursday, August 17th at 10:00 a.m. beginning at City Hall. Contractors shall personally examine the project site prior to bidding. Requests for information shall be directed to the Project Engineer, no later than 12:00 p.m. on Friday, August 18th.

6. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.
7. Bidders shall furnish a Bid Security with their Bidder’s Proposal in the amount of 10% of the base bid amount.
8. OWNER reserves the right after opening Bids to reject any or all Bids, to waive any informality or non-responsiveness in a Bid, or to make award to the lowest responsive, responsible Bidder and reject all other Bids, as it may best serve the interest of the OWNER.
9. Contractor’s License Classification: In accordance with the provisions of California Public Contract Code, Section 3300, City of Mendota has determined that CONTRACTOR shall possess a valid Class A Contractor’s License at the time of contract award for the duration of the contract, and shall be registered with the State Department of Industrial Relations at the time of contract award. Notice is hereby given that on July 20, 2017, the City Council of the City of Fresno (“City”) adopted Resolution 2017-184 to amend Final Tract Map No. 5717 of the City of Fresno Community Facilities District No. 9 (“CFD No. 9”), to change the types of public Services and the rate and method of apportioning the special tax and to levy a Changed Maximum Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”). Under this City Law and Resolution 2017-184, the City gives notice as follows:
The text of Resolution 2017-184, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof. The text of Resolution 2017-184 is summarized as follows:
a. As permitted by City Law, the City is undertaking proceedings to amend Final Tract Map No. 5717 of CFD No. 9, to change the types of Services and rate and method of apportionment of the special tax and Levy a changed Maximum Special Tax.
b. The purpose of CFD No. 9 is to provide services and maintenance for certain regulatory required public improvements that are constructed or installed on public property, dedicated rights-of-way or easements on the perimeter of commercial, industrial and multi-family subdivisions. These improvements include, without limitation, Major Street Median Island landscaping, trees and irrigation systems, median hardscaping, local street curbs, gutters, sidewalks, street paving, and street lights (“Services”).
c. The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 9 under the changed rate and method of apportionment described in Resolution 2017-184 and Exhibit C thereto. The special tax requires the approval of two-thirds of the qualified electors of CFD No. 9 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.
d. The Changed Maximum Special Tax, if approved, will be used to finance all or a portion of the Services.
e. The Director of Public Works or his designee of the City is directed to cause to be prepared an amended written report for the amendment of Final Tract Map No. 5717 of CFD No. 9 (“Amended District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 9 and the estimated costs of the Services. The Amended District Report will be made a permanent part of the record of the public hearing specified below. Reference is made to the Amended District Report as filed with the City Clerk.
f. As set forth below, the City will hold a public hearing on amending Final Tract Map No. 5717 of CFD No. 9 with its changed type of Services and Maximum Special Tax.
g. The time and place established under Resolution 2017-184 for the public hearing required under City Law are Thursday, August 24, 2017, at the hour of 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.
At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 9, the extent of CFD No. 9 or the furnishing of the Services will be heard. Any person interested may file a protest in writing as provided by City Law. If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 9, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 9 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 9 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 9, or against levying a specified Special Tax, those types of facilities or the specified special tax will be eliminated from the proceedings to annex to CFD No. 9.

On August 7, 2017, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council adopted an ordinance amending Chapter 8.12 of Title 8 of the Clovis Municipal Code pertaining to flood plain management regulations: (1) amending the ordinance to include references to the California building code, the California residential code; (2) adding definitions to the municipal code. The City of Clovis participates in the National Flood Insurance program as set forth by the Federal Emergency Management Agency and overseen at the state level by the California Department of Water Resources. The City of Clovis is required by these agencies to make reference to the California Building Code in the city’s Floodplain ordinance. There are no new substantive changes to the existing ordinance but the inclusion of the reference to the California Building Code and the California Residential Code.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLOVIS ADDING CHAPTER 31 TO TITLE 5 OF THE CLOVIS MUNICIPAL CODE PERTAINING TO PREVENTION OF CREDIT CARD FRAUD AT PUBLIC LODGING FACILITIES
On August 7, 2017, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council adopted an ordinance adding Chapter 31 to Title 5 of the Clovis Municipal Code pertaining to prevention of credit card fraud at public lodging facilities. The Police Department requested an addition to the Clovis Municipal Code to aid in the prevention of credit card fraud taking place at public lodging facilities. Currently there is no regulation as to what personal and payment information is provided or verified by a public lodging facility at the time of reservation or check in. With the uptick of identity theft and credit card fraud across the country, it has become necessary to put in place guidelines for public lodging facilities to adhere to in order to prevent fraud related crimes.

REQUESTS FOR PROPOSALS
(Education Code § 17406)
Notice is hereby given that Caruthers Unified School District (hereinafter referred to as “Owner”) has issued a Request for Sealed Proposals for Lease-Leaseback Construction Services (“RFP”) for the (1) construction and/or installation of new classroom buildings, (2) modernization of existing classroom facilities at Caruthers Elementary School, and (3) construction of a new central kitchen. The District intends to award contracts for these projects to one contractor determined to be the best value under the provisions of Education Code 17406 et seq.
The RFP is issued in accordance with Education Code section 17406. The award of an agreement for Lease-Leaseback Construction Services will be determined on a best value basis as detailed in the RFP. Copies of the RFP may be obtained from the District’s website: http://www.caruthers.k12.ca.us/, or by emailing dhaney@caruthers.k12.ca.us. Owner will receive sealed proposals in response to the RFP no later than September 5, 2017, at 3:00, p.m. on the clock designation by the Owner or its representative as the governing clock, at the District Office located at: 1 Tiller Ave, Caruthers, California.
An optional site walk will be held on August 29, 2017, at 2:00 p.m. at Caruthers Elementary School located at 13699 S. Quince, Caruthers, California. Whether or not Contractors attend the optional site walks, which will include the opportunity to inspect the site, may include dissemination of additional information in response to questions or otherwise, all Contractors will be deemed to have notice of all conditions and information which Contractors could have obtained by attending the optional site walks, including but not limited to any conditions in, at, and about the site, the building or buildings, if any, and any work that may have been done thereon.
Public works projects shall be subject to compliance monitoring and enforcement by the Department of Industrial Relations. A contractor or subcontractor shall not be qualified to submit a proposal or to be listed in a proposal subject to the requirements of Public Contract Code section 4104 unless currently registered and qualified under Labor Code section 1725.5 to perform public work as defined by Division 2, Part 7, Chapter 1 (§§1720 et seq.) of the Labor Code. A contractor or subcontractor shall not be qualified to enter into, or engage in the performance of, any contract of public work (as defined by Division 2, Part 7, Chapter 1 (§§1720 et seq.) of the Labor Code) unless currently registered and qualified under Labor Code section 1725.5 to perform public work.
The Owner will require the successful contractor to achieve the minimum goal of 3% DVBE (Disabled Veteran Business Enterprises) established in the RFP or to provide acceptable evidence of good faith efforts to do so.
Pursuant to the Contract Documents, the successful contractor will be required to furnish a Payment (Labor and Material) Bond for each Project in the amount of one hundred percent (100%) of the Total Sublease Amount, and a Faithful Performance Bond in the amount of one hundred percent (100%) of the Total Sublease Amount, said bonds to be secured from Admitted Surety insurers (an insurance organization authorized by the Insurance Commissioner to transact business of insurance in the State of California during this calendar year). The surety insurers must, unless otherwise agreed to by Owner in writing, at the time of issuance of the bonds, have a rating not lower than “A-” as rated by A.M. Best Company, Inc. or other independent rating companies. Owner reserves the right to approve or reject the surety insurers selected by the successful contractor and to require the successful contractor to obtain bonds from surety insurers satisfactory to the Owner. The contractor will be required to furnish insurance as set forth in the Contract Documents.
The successful contractor will be allowed to substitute securities or establish an escrow in lieu of retainage, pursuant to Public Contract Code Section 22300, and as described in the General Conditions.
The Owner will not consider or accept any proposals from contractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors. In accordance with Section 3300 of said Code, the contractor shall have a Class “B” license and shall maintain that license in good standing through completion of both Projects and all applicable warranty periods.
The Director of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate of per diem wages and rate for legal holidays and overtime work. The Contractor must pay for any labor therein described or classified in an amount not less than the rates specified. Copies of the required rates are on file at the Owner’s business office and are available to any interested party on request.
