COMES NOW, Plaintiff, INFINITY INSURANCE COMPANY (hereinafter referred to as “INFINITY”), and alleges as follows:
THE PARTIES
1.       INFINITY, at all times herein mentioned was and is now, a corporation under the laws of the State of Indiana with its principal place of business in Birmingham, Alabama.
2.       INFINITY is authorized to conduct, and is conducting, the business of insurance in the State of California.
3.       Defendant, JOHNNY GONZALES, individually, and dba BEEKINS BUILDING MAINTENANCE, and Defendant, SHAUN GONZALES, reside at 757 South Burgan Avenue, Fresno, California, and are residents of the County of Fresno, State of California.
GENERAL ALLEGATIONS
4.       The INFINITY insured is Defendant JOHNNY GONZALES dba BEEKINS BUILDING MAINTENANCE.
Defendant, JOHNNY GONZALES dba BEEKINS BUILDING MAINTENANCE, purchased a policy of insurance from Plaintiff, Infinity Insurance Company, Policy Number 504-61000-4845-001.
5.       Only Defendant, JOHNNY GONZALES, and Minerva Gonzalez, are listed as insured drivers on the
Declaration Page under the Infinity policy.
6.       Defendant, JOHNNY GONZALES dba BEEKINS BUILDING MAINTENANCE, was, at all times herein
mentioned, a named insured under INFINITY Policy Number 504-61000-4845-001 for the policy period of December 11, 2015, to December 11, 2016.
7.       Defendant, SHAUN GONZALES, was not therein a listed driver on the INFINITY Policy Number
504-61000-4845-001 for the policy period of December 11, 2015 to December 11, 2016.
8.       A 1999 Ford Econoline E250, was a listed vehicle upon the Declaration Page of the INFINITY
Policy Number 504-61000-4845-001 for the policy period of December 11, 2015, to December 11, 2016.
9.       On or about June 18, 2016, Defendant, SHAUN GONZALES, was traveling through Los Angeles
County. Defendant, SHAUN GONZALES, is Defendant JOHNNY GONZALES’ son, and they lived together.
10.   At the time of the accident, Defendant, JOHNNY GONZALES, hired Defendant, SHAUN GONZALES
to perform work as an employee for BEEKINS while he was traveling through Los Angeles County.
Defendant, JOHNNY GONZALES, had rented, through Enterprise, a 2015 Chrysler 200S. The vehicle was not listed on the Infinity policy as an insured vehicle.
11.   Defendant SHAUN GONZALES, was traveling eastbound on Century Boulevard, in the 2015
Chrysler 200S rented from Enterprise Rental Car, in the County of Los Angeles, when he approached its intersection with Van Ness Avenue. At this time, Marcus Sykes was traveling westbound on Century Boulevard and approached its intersection with Van Ness Avenue. Mr. Sykes turned into the left land and onto Van Ness Avenue. The traffic light facing Defendant, SHAUN GONZALES, changed from green to yellow when he proceeded through the intersection and Defendant, SHAUN GONZALES, clipped the front of Mr. Sykes vehicle as Mr. Sykes was attempting to complete his left hand turn.
12.   As a result of the accident, Defendant, SHAUN GONZALES, lost control of his vehicle and collided
With a traffic light pole. Both Defendant, SHAUN GONZALES, and Marcus Sykes, sustained bodily infuries and were transported by ambulance to Harbor – UCLA Medical Center.
13.   On July 13, 2016, INFINITY opened a claim submitted by insured, Defendant, JOHNNY GONZALES
Number 20002757085, to review and investigate the June 18, 2016, accident involving Defendant,
SHAUN GONZALES.
14.   On December 23, 2016, INFINITY served Defendant, JOHNNY GONZALES, with a Notice for an
Examination Under Oath scheduled for January 9, 2017. Defendant, JOHNNY GONZALES, failed to appear
For the scheduled Examination Under Oath and INFINITY made a record of the nonappearance.
15.   On January 27, 2017, INFINITY served Defendant, JOHNNY GONZALES, with an Amended Notice
for an Examination Under Oath scheduled for February 13, 2017. Defendant, Johnny Gonzales, failed to appear for the scheduled Examination Under Oath and INFINITY made a record of the nonappearance.
16.   INFINITY, in a further good faith attempt to investigate and resolve the claim, served Defendant,
JOHNNY GONZALES, with a Second Amended Notice for an Examination Under Oath scheduled for February 28, 2017. Defendant, JOHNNY GONZALES, failed to appear for the scheduled Examination Under Oath and INFINITY made a record of the nonappearance.
17.   INFINITY issued the Infinity policy for a term, December 11, 2015, to December 11, 2016, to
Defendant, JOHNNY GONZALES. The Infinity policy is a commercial auto policy with $1,000,000.00
combined total for bodily injury liability coverage and property damage liability coverage per occurrence or accident, with an effective policy period of December 11, 2015, to December 11, 2016.
18.   Defendant, JOHNNY GONZALES, has claimed that the Infinity policy’s commercial auto coverage
applies to Defendant SHAUN GONZALES’ accident of June 18, 2016. INFINITY contends that the Infinity policy does not apply because Defendant, JOHNNY GONZALES, has failed to cooperate with INFINITY to investigate the claim. INFINITY further contends that Defendant SHAUN GONZALES’ use of the unlisted rental vehicle as an employee and unnamed driver on the policy precludes coverage for policy benefits arising out of the June 18, 2016, motor vehicle accident involving Defendant, SHAUN GONZALES.
FIRST CAUSE OF ACTION FOR DECLARATORY RELIEF
19.   INFINITY hereby incorporates each and every allegation contained in paragraphs 1 through 18 as
though fully set forth herein. INFINITY brings this action pursuant to Code of Civil Procedure 1060 to determine the rights and duties of the parties herein relative to the INFINITY policy.
20.   The Infinity policy provides commercial auto coverage, in pertinent part, as follows:
“In the event of an auto accident or loss, you and any person claiming coverage under this policy must:
2. Cooperate with us in any matter concerning a claim or suit.
5. Provide any written proof of loss under oath that we require.
9. Submit to statements or examinations under oath and review, sign and return the transcript to us-as we may reasonably require.
10. Allow us to take signed or recorded statements when and as often as we may reasonably require.
We may examine any insured under oath, while not in the presence of any other insured, about any matter relating to this insurance or claim, including an insured’s books and financial records.”
21.   Cooperation clauses serve an important role to the discover process. Without any cooperation
and assistance, the insurer is severely handicapped and may in some instances be absolutely precluded from advancing any defense. The cooperation provision allows the insurer to possess itself of all knowledge and information to enable the insurer to decide upon its obligations and protect itself against false claims. When an insured violates a cooperation clause, the insurer’s performance is excused if its ability to provide a defense has been substantially prejudiced.
22.   On three separate occasions, December 23, 2016, January 27, 2017, and February 13, 2017,
INFINITY had served Defendant, JOHNNY GONZALES, with a Notice of Examination Under Oath. At each of the scheduled Examinations Under Oath, Defendant, JOHNNY GONZALES, had failed to cooperate and appear or produce any records requested. INFINITY made a record of the nonappearance.  Defendant, JOHNNY GONZALES, has failed to cooperate in his claim presentation as required by law and contractually pursuant to the Infinity policy.
23.   The Infinity policy requires that Defendant, JOHNNY GONZALES, submit to an Examination
Under Oath, and to provide records relating to the claim.
24.   Defendant JOHNNY GONZALES’ failure to appear for three separately scheduled Examinations
Under Oath and cooperate with INFINITY’s investigation of the claim, violates the insured’s duty to cooperate under the Infinity policy. As a result of Defendant JOHNNY GONZALES’ failure to cooperate, the commercial auto coverage policy benefits afforded by the Infinity policy should be excused. The failure to cooperate severely prejudiced Infinity’s ability to investigate and defend.
SECOND CAUSE OF ACTION FOR DECLARATORY RELIEF
25.   INFINITY hereby re-alleges the allegations contained in paragraphs 1 through 24 as though
fully set forth herein.
26.   The Infinity policy provides commercial auto coverage as follows:
A. We will pay damages, except punitive or exemplary damages, for which an insured is legally liable because of bodily injury or property damage because of an accident up to the limites stated on the Declaration Page. “Insured” means you or any person named as a driver on the Declarations Page while driving your insured auto.
B. The Infinity policy contains a business use exclusion to the commercial auto policy which states:
We do not cover loss: “To your insured auto while being operated by a: a) relative or resident, if you are an individual; or b) an employee of yours; or c) any other regular user of your insured auto.”
27. INFINITY’s commercial auto coverage applies to listed drivers on the Declarations Page while driving an insured auto. In the present case, Defendant JOHNNY GONZALES’ Declarations Page fails to name Defendant, SHAUN GONZALES, as an insured driver when he was operating the rental vehicle at the time of the accident.
28. The Infinity policy also has a business use exclusion. At the time of the accident, Defendant, SHAUN GONZALES, was acting as an employee for Defendant, JOHNNY GONZALES, and using the vehicle involved in the accident as a work vehicle for Defendant JOHNNY GONZALES’ business, BEEKINS.
29. Defendant, SHAUN GONZALES, is related to Defendant, JOHNNY GONZALES, as he is his son. At the time of the accident, Defendant, JOHNNY GONZALES, wanted Defendant, SHAUN GONZALES, to perform work as an employee for BEEKINS while he was in Los Angeles County.
30. An actual controversy has arisen and now exists between INFINITY and Defendant, JOHNNY GONZALES, concerning the parties’ respective rights and duties under the Infinity policy. INFINITY contends that the Infinity Policy does not provide coverage for any of the claims of Defendant, JOHNNY GONZALES, or Defendant, SHAUN GONZALES. Defendant, JOHNNY GONZALES, presumably disputes these contentions and presumably contends that the Infinity Policy covers any and all claims arising out of that certain motor vehicle accident which occurred on June 18, 2016.
31. INFINITY desires a judicial determination of its rights and duties under Infinity Policy Number 504-61000-4845-001 issued to Defendant, JOHNNY GONZALES, for the policy period of December 11, 2015 to December 11, 2016 as to whether the policy provides coverage for Defendant, JOHNNY GONZALES, or Defendant, SHAUN GONZALES, arising out of that certain accident which occurred on June 18, 2016. This Petition for a declaration of rights and duties of the parties is necessary and appropriate at this time in view of the controversy between Plaintiff and Defendants, and each of them, as described above.
WHEREFORE, INFINITY prays as follows:
1. That the Court declare and adjudicate the rights and duties of the respective parties hereto concerning the controversy referred to above;
2. That the Court’s declaration and adjudication be that Infinity Policy Number 504-61000-4845-001 does not provide for Defendant, JOHNNY GONZALES, or Defendant, SHAUN GONZALES, arising out of that certain accident which occurred on June 18, 2016, and otherwise does not require INFINITY to indemnify, defend or otherwise provide policy benefits;
3. For costs of suit incurred herein; and
4. For such other and further relief as the Court deems just and proper.

COMPLAINT FOR DAMAGES FOR VIOLATION OF FRESNO MUNICIPAL CODE

Defendants,
Plaintiffs City of Fresno and People of the State of California allege:
            1.         Plaintiff City of Fresno (“City”) is, and at all times herein mentioned was, a charter municipal corporation, duly organized and existing under and by virtue of the Constitution of the State of California.
            2.         The City is authorized to bring a civil action for public nuisance abatement when a nuisance exists within the City in the name of the “People of the State of California”.  (CCP §731.)    The Fresno Municipal Code makes it unlawful to own or control a property with a public nuisance.  (FMC §10-605.)  Public nuisances include, but are not limited to rubbish, junk, abandoned cars, weeds, blighted vacant buildings and attractive nuisances.  (Civ. Code §§3479-3481; FMC §§10-605, 10-617.)  When a nuisance exists, the City is permitted to obtain a judgment for damages, enjoin the continuance of the nuisance, or enter upon and correct it.  (CCP §731). 
3.         The Fresno Municipal Code also provides the City with several modalities to collect on unpaid abatement costs incurred by the City or penalties issued by it resulting from an ongoing public nuisance, including obtaining a personal judgment (FMC §1-510.) 
            4.         City is informed and believes and thereon alleges that Defendant Margaret Easley (and Does 1 through 10 inclusive, collectively “Defendant”) are, and at all times mentioned herein were, the record owners and operators of the real property, 1227 East Byrd Avenue, Fresno, California, APN 479-162-14 (the “Subject Property”).
            5.         Defendants Does 1 through 10, inclusive, are sued herein under fictitious names.  Their true names and capacities are unknown to City.  When their true names and capacities are ascertained, City will amend this complaint by inserting their true names and capacities herein.  City is informed and believes and hereon alleges that each of the fictitiously named Defendants is responsible in some manner for the occurrences, conditions and or violations herein alleged.
6.         From 2015, through to the present, the City has inspected the Subject Property for building/municipal code violations numerous times and has consistently found it abandoned, containing ongoing and uncorrected public nuisances including broken windows and doors boarded with plywood in violation of the Fresno Municipal Code, oxidized painted exterior stucco surfaces, garage converted to a living space without permits or inspection, and overgrown vegetation. 
7.         From 2015, until the present, the City has noticed owner to correct the public nuisance, without affect.  The City has completed several inspections and issued a Notice and Order regarding the violations, which was not appealed.  The City has spoken with the Defendant to advise of the continuing violations and the City has been advised on numerous occasions the property would be taken care of, and the violations would be corrected.  Attached as Exhibit A is a true and correct copy of the Notice and Order to Remove Public Nuisance Violations issued on October 20, 2015.  Attached as Exhibit B is a true and correct copy of the First Administrative Citation issued on November 30, 2015.  Attached as Exhibit C is a true and correct copy of the invoice issued November 4, 2016, regarding the administrative costs incurred by the City on the Subject Property.
8.         The City continues its efforts on the Subject Property to compel the Defendant to abate the violations of the Fresno Municipal Code, and continues to incur administrative costs, abatement costs, and additional citations may be issued as the violations continue. 
9.         But despite noticing the owner, issuing citations, and periodically abating the public nuisances on the Subject Property, the property remains in constant violation of FMC.
10.       The Fresno Municipal Code provides that any person issued a citation has a right to appeal, but if no appeal is filed the citations shall be final and immediately payable.  (FMC §1-308.)
            11.       As of the filing of this complaint, the aforementioned costs and penalties remain unpaid and Defendant has failed to take all necessary corrective actions to bring the Subject Property into compliance.
            WHEREFORE, Plaintiffs prays as follows:
            1.         That Defendants, and each of them, be ordered to pay any and all abatement costs, administrative costs, and administrative citations issued relating to Public Nuisances on the Property, and judgment be entered in an amount according to proof at the time of trial and or Court or Clerk’s default judgment;
            2.         That Plaintiff City recover costs of suit from Defendants and each of them and or their successors and assigns, including reasonable attorney fees.  (Gov’t Code §38773.5, FMC §1-510.);  
            3.         The court take judicial notice under Evid. Code §452(b) of the Fresno Municipal Code, including sections 1-308, 1-510, 10-605 and 10-617;
            4.         For such other and further relief as the court deems proper.

            Action Number AF2017-0001: $4,965.00 US Currency was seized on March 9, 2017 at 25 Shaw Ave., Clovis, CA by officers of the Clovis Police Department for violation of Health and Safety Code Sections 11350 and 11359.

Action Number AF2017-0002:  $6,075.00 US Currency was seized on May 4, 2017 at Thorne/Home Ave – 944 N. Vann Ness Ave., Fresno, CA by officers of the California Highway Patrol and the Fresno Police Department for violation of Health and Safety Code Sections 11738.

Action Number AF2017-0003: $14,806.00 US Currency was seized on March 16, 2017 at Bullard/Willow Ave., Clovis, CA by officers of the Clovis Police Department for violation of Health and Safety Code Sections 11359 and 11360.

Action Number AF2017-0004: $4,842.00 US Currency was seized on June 2, 2017 at 1799 Bullard Ave., Clovis, CA by officers of the Clovis Police Department for violation of Health and Safety Code Sections 11378, 11379, and 11352.

Action Number AF2017-0005: $2,465.00 US Currency was seized on July 20, 2017 at 2306 S. Lotus Ave., Fresno, CA by officers of the California Highway Patrol along with the Freson Police Department for violation of Health and Safety Code Sections 11378.

Action Number AF2017-0006: $15,186.00 US Currency was seized on July 15, 2017 at 15015 Jayne St, Huron in Fresno County, by officers of the Coalinga Police Department for violation of Health and Safety Code Sections 11378.

Action Number AF2016-0005: $25,150.00 US Currency was seized on March 31, 2016 at Interstate 5 South and Manning Ave., in Fresno County, by officers of the Fresno County Sheriff’s Department for violation of Health and Safety Code Sections 11359 and 11360(a).                                             
You have thirty (30) days from the date of the first publication of this Notice to file a verified claim, unless you have received actual notice.  The claim must state the nature and extent of any interest you hold in this property, must be verified, and must be filed with the Clerk of the Superior Court, 1100 Van Ness, 2nd Floor, Room 200, Fresno, California 93721, or the property will be forfeited to the State.  An endorsed copy of the claim must be served on the District Attorney, 2220 Tulare Street, Suite 1000, Fresno, California 93721, within thirty (30) days of the filing of your claim.  Claim forms can be obtained from the Clerk of the Court.
