NOTICE IS HEREBY GIVEN that on Thursday, September 6, 2018, at 6:30 p.m. or as soon thereafter as the matter can be heard, the Fowler Planning Commission will hold a public hearing at the City Hall Council Chambers at 128 S. 5th Street, Fowler, California to consider the following application:

Conditional Use Permit (CUP) No. 18-04 (Jack In The Box): Robert Martinez (applicant) proposes to develop two commercial buildings with attached drive-through facilities and associated parking lots and a marquee sign. The parcel is zoned C-H (Highway Commercial) and planned for General Commercial land uses by the City of Fowler General Plan. It is located within the Highway Beautification (HB) Overlay District.  The site is located on the southeast corner of South 10th Street and vacated Fowler Avenue (APN 343-201-08) and contains approximately 1.56 acres. 

Drive-through facilities are subject to a conditional use permit according to Section 9-5.1305 of the Fowler Zoning Ordinance. Marquee signs measuring greater than 500 square feet in area within the HB Overlay District are subject to a conditional use permit according to Sections 9-5.1905 and 9-5.1907 of the Fowler Zoning Ordinance. Because of their unusual characteristics, conditional uses require special consideration so that they may be located properly with respect to objectives of the zoning ordinance and potential effects on surrounding properties. The Commission is empowered to grant or deny applications for CUPs and to impose reasonable conditions upon the granting of such permits.  

Environmental Finding. The CUP is categorically exempt from CEQA under Class 32 Categorical Exemption – In-fill Development Projects. Class 32 consists of projects characterized as in-fill development meeting the following conditions: (a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations; (b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses; (c) The project site has no value as habitat for endangered, rare or threatened species; (d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality; and (e) The site can be adequately served by all required utilities and public services. 

The decision of the Planning Commission is final unless appealed to the City Council. The Commission requests your participation and the public is welcome to speak at the hearing. If you challenge any action in court, you may be limited to only those issues raised at the public hearing, or in written correspondence delivered to the Community Development Department at, or prior to, the public hearing.

Any changes to, or clarification of, the project plans and specifications shall be in the form of a written addendum issued to planholders of record.  Questions that prompt a change or clarification shall be included in the addendum with the subsequent answer.

Any oral explanation or interpretations given to this project are not binding.

Bids shall be submitted in a sealed envelope addressed to the District and labeled with the name of the bidder, the name of the project and the statement ‘Do Not Open Until The Time Of Bid Opening.’

Bid security in the amount of ten (10) percent of the amount of the bid, and in the form of a bid bond issued by an admitted surety insurer licensed by the California Department of Insurance, cash, cashier’s check or certified check shall accompany the bid.  Bid security shall be made in favor of the Pinedale County Water District.

No contract will be awarded to a contractor who has not been licensed in accordance with the provisions of the Contractors State License Law, California Business and Professions Code, Division 5, Chapter 9, as amended, or whose bid is not on the proposal form included in the contract document.  A valid California Contractor’s License, Class A (General Engineering), is required for this project.

No contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5.  No contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5.

The work performed under this contract is subject to compliance monitoring and enforcement by the Department of Industrial Relations.  This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages, which under Labor Code Section 1773.1 are deemed to include employer payments for health and welfare, pension, vacation, travel time, and subsistence pay, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done.  Said wage determinations are on file with the Secretary of the Board of Directors and are incorporated herein by reference.  Said wages are available at the State of California Department of Industrial Relations Website.

Bids are required for the entire work described herein.  Bids will be compared on the basis of the total of bid items. The successful bidder shall furnish a faithful performance bond in the amount of 100 percent of the contract amount and a payment bond in the amount of 100 percent of the contract amount. Each bond specified in this Notice (bid bond, faithful performance bond and payment bond) shall meet the requirements of all applicable statutes, including but not limited to those specified in Public Contract Code section 20129 and Civil Code section 3248. 

Each bond specified in this Notice shall be issued by a surety company designated as an admitted surety insurer in good standing with and authorized to transact business in this state by the California Department of Insurance, and acceptable to the Pinedale County Water District.  Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance. Additionally, the Pinedale County Water District, in its discretion, when determining the sufficiency of a proposed surety company, may require the surety company to provide additional information supported by documentation.  The District generally requires such information and documentation whenever the proposed surety company has either a Best’s Key Rating Guide of less than B+ or a financial size designation of less than VIII.  Provided, however, that the District expressly reserves its right to require all information and documentation to which the District is legally entitled from any proposed surety company.

Pursuant to Public Contract Code section 22300, substitution of securities for any moneys withheld by the Pinedale County Water District to ensure performance under the contract shall be permitted.

The Board of Directors reserves the right to reject any or all bids.

REQUEST FOR BIDS

In general, the Work consists of the construction of a Structural Concrete turnout with deck from the Fresno Slough (James By-Pass), volume of concrete approximately 550 cubic yards, installation of 3 fifty-four-inch diameter culvert crossings at the James Irrigation District’s (JID) concrete lined Lassen Canal, and the installation of 4 seventy-two-inch diameter culvert crossings at the JID’s concrete lined Coalinga Canal, near Helm CA. 1) Sealed bids will be received by the KINGS RIVER CONSERVATION DISTRICT prior to 2:00:00 p.m. (local time) on September 12, 2018 at 4886 East Jensen Avenue, Fresno, Ca 93725, and following said deadline all bids will be publicly opened and read.  Bids shall be submitted in a sealed envelope with the name of the bidder, the bidder’s state registration number, the name of the project and the statement “Do Not Open Until the Time of Bid Opening.” Bids received after said deadline or without the required registration number will be returned unopened to the bidder. 2) A mandatory pre-bid meeting and project site tour will be held on August 20, 2018 beginning at 10:00 am at the intersection of State Route 145 (McMullin Grade) and Floral Avenue, in Fresno County.  Contractors shall personally examine the project site prior to bidding.
