Plaintiff, THE STATE OF CALIFORNIA, acting by and through the State Public Works Board, alleges that:

1.                  The State Public Works Board (“Board”) is, and at all times herein mentioned has been, by law vested with authority to exercise in the name of the State of California, with the consent of the California High-Speed Rail Authority, the power of eminent domain for the purpose of acquiring property necessary for high-speed train system purposes, a public use.

2.                  After notice pursuant to Code of Civil Procedure section 1245.235, at a meeting of the Board duly and regularly convened at Sacramento, California, on August 12, 2016, the Board, pursuant to Code of Civil Procedure sections 1245.210 through 1245.270, duly and regularly passed and adopted Resolution of Necessity No. 2016-0117, declaring that certain real property or an interest therein is necessary for high-speed train system purposes and is to be acquired by plaintiff pursuant to the Property Acquisition Law, commencing with Government Code sections 15853 and 15854, and that plaintiff is authorized to acquire that property in fee simple absolute unless a lesser estate is described herein for a proposed high-speed train system project.  The Board has found and determined and in its resolution declared:

(a)               The public interest and necessity require the project.

(b)              The project is planned or located in a manner that will be most compatible with the greatest public good and the least private injury.

(c)               The property sought to be acquired is necessary for the proposed project and is to be acquired by eminent domain pursuant to the Property Acquisition Law; and Code of Civil Procedure Section 1240.610 in that the property is required for a more necessary public use; and Code of Civil Procedure Section 1240.410 in that the property being acquired includes a remnant that would be of little market value.

(d)              The offer required by section 7267.2 of the Government Code has been made.

Amend various sections of the Fresno County Zoning Ordnance to permit Wholesale Limited, Minor, and Micro wineries as either by-right uses or uses subject to a discretionary land use permit in the R-R (Rural Residential), AL (Limited Agricultural) and AE (Exclusive Agricultural) Zone Districts per specific standards to be included in Section 855-N.37.  The uses will be limited by volume of production, tasting days, and tasting events.  Adopt the Negative Declaration prepared for Initial Study Application No. 7412 and approve Amendment to Text Application No. 377.

NOTICE IS HEREBY GIVEN that on June 14, 2018, at a regularly scheduled meeting at 10:30 a.m., the City Council of the City of Fresno (City) will hold a public hearing and shall adopt a Resolution to approve the Finance Agreement and Energy Services contract with Pacific Gas and Electric Company for implementation of certain energy related improvements.  The resolution, agreements, and supporting documents will be on the Council’s regular public agenda for public comment and discussion.  The City gives notice as follows:

a.            Fresno City Council shall hold a public meeting on June 14, 2018, for the purposes of taking public comment, adopting the findings and approving a Finance Agreement and related necessary loan documents with Pacific Gas and Electric Company to fund the implementation of certain energy conservation improvements to the City of Fresno facilities in accordance with California Government Code Section 4217.10 et seq.

b.            Fresno City Council shall hold a public hearing on June 14, 2018, for the purposes of presenting certain findings, taking public comment, and approving a Resolution adopting the findings and approving an Energy Services Contract with Pacific Gas and Electric Company for the implementation of certain energy related improvements to the City of Fresno facilities in accordance with California Government Code Section 4217.10 et seq.. The City of Fresno findings shall provide and Energy Services Contract shall require that the cost to the City of Fresno to implement energy related improvements will be less than the anticipated marginal cost to the City of Fresno of thermal, electrical, or other energy that would have been consumed by the City of Fresno in absent of purchasing the energy improvements.
