A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF FRESNO INITIATING ANNUAL ASSESSMENT PROCEEDINGS UNDER CHAPTER 3 OF THE LANDSCAPING AND LIGHTING ACT OF 1972 IN THE TENAYA PARK ASSESSMENT DISTRICT FOR COUNTY SERVICE AREA NO. 2 AND APPOINTING AN ASSESSMENT ENGINEER TO PREPARE AND FILE AN ENGINEER’S REPORT.

WHEREAS, the County provides park maintenance services, in County Service Area No. 2  – Tenaya Estates (CSA 2), for the park known as Tenaya Park;

WHEREAS, Government Code section 25215.3 authorizes the Board of Supervisors (Board), on behalf of CSA 2, to impose a benefit assessment in CSA 2 under the Landscaping and Lighting Act of 1972 (Streets and Highways Code, Division 15, Part 2, beginning with Section 22500) for park maintenance; and

WHEREAS, the Board, by Resolution 14-230 on June 17, 2014, formed the Tenaya Park Assessment District, whose boundaries are coextensive with those of CSA 2 the location and boundaries of which are shown on the map attached to this resolution as Exhibit A; and

WHEREAS, the “improvements” for purposes of Streets and Highways Code section 22525 are generally described as the maintenance of Tenaya Park, which includes landscaping and irrigation systems, lighting and electrical systems, and recreational improvements including playground equipment; and

WHEREAS, before adopting this Resolution, the Board considered all testimony and documentary evidence, and gave all persons a full and fair opportunity to be heard with respect to any matter relating to the subject of this Resolution, both in favor and against it, and any matter relevant to these proceedings, all of which was done in the interest of the public, and the Board is fully informed of all matters referred to in this resolution.

NOW, THEREFORE, the Board of Supervisors of the County of Fresno does hereby find, determine, and resolve as follows:

Section 1.       The above recitals are all true and correct.

Section 2.       The Board hereby proposes to proceed under Chapter 3 of the Landscaping and Lighting Act of 1972 to levy and collect in the Tenaya Park Assessment District, for CSA 2, an assessment of the total cost of the maintenance and operation expenses of Tenaya Park for the 2018-19 fiscal year.

Section 3.       In connection with the proceedings that are the subject of this resolution, the Board hereby appoints and designates Steven E. White, P.E., Director, Department of Public Works and Planning, County of Fresno, registered under the Professional Engineers Act (Division 3, Chapter 7 of the California Business and Professions Code, beginning with Section 6700), as the Assessment Engineer (Assessment Engineer).

Section 4.       The Assessment Engineer is hereby ordered to prepare and, no later than May 08, 2018, file with the Clerk of the Board a written report (Engineer’s Report) with regard to an assessment of the total cost of maintenance for Tenaya Park for the 2018-19 fiscal year. The Engineer’s Report shall comply with the requirements of Streets and Highways Code, Division 15, Part 2, Chapter 1, Article 4, beginning with section 22565, and Section 4 of Article XIIID of the California Constitution.

Section 9.       The Board hereby finds and determines that it took all of the foregoing actions and made all of the foregoing findings in full compliance with the law, including, without limitation, the Landscape and Lighting Act of 1972, Article XIIID of the California Constitution, and any other law referred to in this resolution.  All proceedings referred to in this resolution have been taken with respect to CSA 2.

Section 11.     This Resolution shall take effect immediately upon its adoption.

Section 12.     The Clerk of the Board shall certify to the adoption of this Resolution and shall cause a certified copy of this Resolution to be filed in the office of the Clerk.

A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF FRESNO DECLARING ITS INTENTION TO LEVY AN ANNUAL ASSESSMENT UNDER CHAPTER 3 OF THE LANDSCAPING AND LIGHTING ACT OF 1972 IN THE TENAYA PARK ASSESSMENT DISTRICT FOR COUNTY SERVICE AREA NO. 2 AND SETTING A PUBLIC HEARING ON THE PROPOSED ASSESSMENT.

WHEREAS, the County provides park maintenance services, in County Service Area No. 2  – Tenaya Estates (CSA 2), for the park known as Tenaya Park;

WHEREAS, the Board has received and approved an engineer’s report, dated May 08, 2018, and prepared by a registered professional engineer certified by the State of California, supporting an assessment in Tenaya Park Assessment District for operation and maintenance of Tenaya Park in CSA 2 in the 2018-19 fiscal year (Engineer’s Report); and

WHEREAS, the Engineer’s Report contains a full and detailed description of the improvements, the boundaries of the assessment district, and the proposed assessments upon assessable lots and parcels of land within the Tenaya Park Assessment District; and

WHEREAS, the Engineer’s Report is on file with the Clerk of the Board; and

WHEREAS, before adopting this Resolution, the Board considered all testimony and documentary evidence, and gave all persons a full and fair opportunity to be heard with respect to any matter relating to the subject of this Resolution, both in favor and against it, and any matter relevant to these proceedings, all of which was done in the interest of the public, and the Board is fully informed of all matters referred to in this resolution.

NOW, THEREFORE, THE BOARD OF SUPERVISORS OF THE COUNTY OF FRESNO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:

Section 1.       The above recitals are all true and correct.

Section 2.       The Board hereby declares its intention to levy and collect an assessment in the Tenaya Park Assessment District, under Chapter 3 of the Landscaping and Lighting Act of 1972, for operation and maintenance of Tenaya Park for the 2018-19 fiscal year. The assessment is not proposed to increase from the previous year, under the definition of “increase” provided by Streets and highways Code section 22630.5, Government Code section 54954.6, subdivision (a)(1)(D), and Government Code section 53750, subdivision (h)(1).

Section 3.       A public hearing of the Board is hereby set for June 12, 2018, at 9:00 A.M., or as soon after as practicable, in the Board Room of the Fresno County Board of Supervisors, Room 301, Hall of Records, 2281 Tulare Street, Fresno, California, 93721, for hearing all objections and protests to the annual assessment, the amount assessed against each parcel, and related matters as set forth in the Engineer’s Report (collectively, Public Hearing).  The Public Hearing shall be held under Sections 22629 through 22631 of the California Streets and Highways Code.  The Public Hearing may be continued from time to time by the Board without further notice, except that it may not be continued to a date after August 10 without prior consent of the County Auditor-Controller/Treasurer-Tax Collector.

Section 4        The Board hereby authorizes and directs the Clerk of the Board to cause notice of the filing of the Engineer’s report, and of the time, date, and place of the Public Hearing to be published under Government Code section 6061, one time, no more than 10 days before the Public Hearing.

Section 5.       Property owners wishing to preserve the opportunity to file a lawsuit challenging the assessment, if levied, must file a written protest and state therein the specific grounds of protest.  Any grounds of protest not stated in a written protest filed prior to the close of the public hearing of protests are deemed waived in any subsequent lawsuit and may not be raised in such lawsuit.

Section 6.       The validity of the assessment announced by the Board of Supervisors shall not be contested in any action or proceeding unless the action or proceeding is commenced within thirty days after the assessment is announced and adopted (Fresno County Ordinance Code Section 4.28.040).

Section 7.       The Board hereby finds and determines that it took all of the foregoing actions and made all of the foregoing findings in full compliance with the law, including, without limitation, Landscaping and Lighting Act of 1972, Article XIIID of the California Constitution, and any other law referred to in this resolution. All proceedings referred to in this resolution have been taken with respect to the Tenaya Park Assessment District for CSA 2.

LATON NORTH RECHARGE PROJECT 

in FRESNO COUNTY

For

LAGUNA IRRIGATION DISTRICT 

NOTICE OF INTENT TO ADOPT AND CONSIDERATION OF MITIGATED NEGATIVE DECLARATION

Laguna Irrigation District has completed the Draft Initial Study/Mitigated Negative Declaration (IS/MND) for a proposed groundwater recharge basin project located in Fresno County, CA. The Draft IS/MND found the proposed project would not have a significant effect on the environment, as mitigation measures have been included which will reduce potential impacts to less-than-significant effects, and that an Environmental Impact Report is therefore not required under the provisions of the California Environmental Quality Act of 1970 as amended (CEQA).

Project Location: The 130-acre project site is located in an unincorporated area of Fresno County, California, approximately 7.5 miles south of the City of Selma and 1 mile north-west of the Fresno County border. The site is currently operated as a stone fruit orchard and is designated for agricultural use by the Fresno County General Plan and Fresno County Zoning Code.

Project Description: The proposed project will involve the construction of a groundwater recharge basin and maintenance of an existing inlet structure to accommodate an additional 36” mainline pipe. The proposed groundwater recharge basin is to be composed of 5 cells totaling approximately 130 acres. The cells will be approximately 25 feet deep and each cell will be bordered by a 12’ drive path. The total capacity of the groundwater recharge basin will be approximately 2895 acre-feet. Repairs to the existing inlet structure are proposed to include new control gates with trash racks and to accommodate an additional 36” mainline pipe. The additional 36” mainline pipe will extend approximately 650 feet alongside an existing 36” mainline pipe and connect to an existing canal, which will convey water to the proposed groundwater recharge basin.

NOTICE IS HEREBY GIVEN, pursuant to the provisions of Section 15072 of Title 14 of the California Code of Regulations, that Laguna Irrigation District proposes to adopt a Mitigated Negative Declaration for the Cole Slough Recharge Project. The Draft IS/MND is being circulated for a 30-day review period. Persons responding are urged to submit their comments in writing. Written comments should be delivered to Laguna Irrigation District, 5065 19 ½ Avenue, Riverdale, CA 93656 prior to June 18, 2018.

A public hearing will be held on June 18, 2018 at 10:00 A.M. for the purposed of considering public comments regarding the Draft IS/MND. Both written comments and oral testimony from the public hearing will be incorporated into the final IS/MND to be adopted by the Laguna Irrigation District. Unless substantial modifications are needed, the Draft IS/MND plus an addendum may serve as the final document.

Project Item No. A is in substantial conformance with the environmental analysis performed for Rezone Amendment R2008-07A2, Conditional Use Permit CUP2017-11 & Site Plan Review SPR2017-14.  No major revisions will be required with the adopted Mitigated Negative Declaration to accommodate the proposed project, therefore, subject to CEQA Sections 15162 and 15182 no further environmental review is required for this project.

Project Item No. B is exempt from the California Environmental Quality Act (CEQA) pursuant to a Class 32 categorical exemption.  Class 32 consists of in-fill development less than 5 acres in size meeting the conditions described in CEQA Guidelines Section 15332.  A Notice of Exemption has been completed during the preliminary review and is kept for public review with the project file during the processing of the project application.  Staff will file the Notice of Exemption with the County Clerk if the project is approved. 

In conjunction with the project, staff completed the following documents that are currently available for public review:

1.  California Environmental Quality Act Determination Narrative.

2.  Timmy/Nees Senior Assisted Living Project Proposal; Reasonable Accommodation Procedures.

Copies of these documents are available for pick up at the City of Clovis Planning Division, 1033 Fifth Street, Clovis, California, Monday through Friday, between 8:00 a.m. and 3:00 p.m.

Project Item No. C is in substantial conformance with the environmental impact report performed for General Plan.  No major revisions will be required with the adopted Environmental Impact Report to accommodate the proposed project, therefore, subject to CEQA Sections 15162 and 15182 no further environmental review is required for this project.
