Bid security in the amount of ten (10) percent of the amount of the bid, and in the form of a bid bond issued by an admitted surety insurer licensed by the California Department of Insurance, cash, cashier’s check or certified check shall accompany the bid.  Bid security shall be made in favor of the City of Kingsburg.

No contract will be awarded to a contractor who has not been licensed in accordance with the provisions of the Contractors State License Law, California Business and Professions Code, Division 5, Chapter 9, as amended, or whose bid is not on the proposal form included in the contract document.  A valid California Contractor’s License, Class A, General Engineering, is required for this project.

A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5. It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded.

The City of Kingsburg has established a participation goal for Disadvantaged Business Enterprises (DBEs) of 4%.

The City of Kingsburg hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprise, Minority Business Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done.  Said wage determinations are on file with the City Clerk and are incorporated herein by reference.

Minimum wage rates for this project have been determined by the Secretary of Labor.  If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates predetermined by the Director of the Department of Industrial Relations of the State of California for similar classifications of labor, the contractor and his subcontractors shall pay not less than the higher wage rate.

Bids are required for the entire work described herein.  Bids will be compared on the basis of the total of bid items.

The successful bidder shall furnish a faithful performance bond in the amount of 100 percent of the contract amount and a payment bond in the amount of 100 percent of the contract amount.  Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Kingsburg.  Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance and that the City of Kingsburg will not accept a surety company with a Best’s rating of less than B.

Pursuant to Public Contract Code Section 22300, substitution of securities for any moneys withheld by the City of Kingsburg to ensure performance under the contract shall be permitted.

The City Council reserves the right to reject any or all bids.

NOTICE INVITING BIDS

NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to, installation of 81,000± square yards of rubberized cape seal in various local streets in the City of Clovis. The rubberized cape seal involves an application of rubberized asphalt chip seal and an application of Type II slurry seal at each location. The chip seal binder may contain 100% recycled California waste tires at a minimum of 15% (minimum 300 lbs. per ton) by weight in the asphalt binder. This project also involves installation of 210,000± square yards of Type II Slurry Seal to additional streets within the City boundary. See the scope of work in the Construction Specifications for details.

A complete listing of bid quantities is contained in the bid proposal form. Bids will be received for the complete work in accordance with the plans and specifications on file with the City Clerk at the Clovis Civic Center, Clovis, CA. Plans and specifications, forms of proposal, contract and special provisions can be downloaded free of charge from the vendor portal of PlanetBids, Inc., which is also accessible on the City of Clovis website.

Bids must be filed with the City Clerk at the Clovis Civic Center prior to 2:00 p.m., Tuesday, March 20, 2018, at which time the City Clerk will open said bids. Bids shall be submitted in sealed envelopes and marked:

Bid Proposal: Rubberized Cape Seal 2018

No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer. Each bid must be accompanied by a certified or cashier’s check or bidder’s bond, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid. Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract. A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded. Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Clovis. Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance. Pursuant to Public Contract Code Section 22300, substitution of securities for any monies withheld by the City of Clovis to ensure performance under the contract shall be permitted.  In accordance with the provisions of Chapter 13 (commencing with Section 4590), Division 5, Title 1 of the Government Code of the State of California, securities may be substituted for monies withheld on the project.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done. Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612.  A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.

All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form. The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”. Bidders for this project must possess a valid Class A, C12 or C32 License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal. A bidder, or a subcontractor listed in his bid proposal, must possess a valid Class C27 or C61D49 License. Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract. All representations made on the proposal are made under penalty of perjury.

The City of Clovis reserves the right to reject any or all bids, to waive any informalities or minor irregularities in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interest of the City of Clovis.

NOTICE IS HEREBY GIVEN that sealed bids will be received by the City Clerk of the City of Clovis for furnishing all labor, materials, services and equipment, and performing all work necessary as specified for, but not be limited to, installation 13,500 square yards of Type I slurry seal for Clovis Old Town Trail, which is an existing asphalt-concrete pavement 12 feet in width by 3 inches in thickness over compacted subgrade, and approximately 2 miles from Shaw Avenue to Herndon Avenue. The work shall also involve site preparation, crack sealing, removal of traffic striping and reinstallation of thermoplastic striping. Light equipment must be used to avoid damages to the existing paved trail.
