REQUEST FOR BIDS

The City of Mendota is soliciting bids for the 2018 Pavement Seal Project.

In general, the Work consists of dig-outs and repairs of sections of asphalt pavement, grinding and overlay of sections of asphalt pavement, reconstruction of curb ramps, crack sealing, slurry sealing, and restriping of several streets in the City of Mendota.

Sealed bids will be received by the City of Mendota prior to 10:00 a.m. PDT on Thursday, April 19, 2018 at City Hall, located at 643 Quince Street, Mendota, CA 95630, and following said deadline all bids will be publicly opened and read.  Bids shall be submitted in a sealed envelope with the name of the bidder, the bidder’s state registration number, the name of the project and the statement “Do Not Open Until the Time of Bid Opening.” Bids received after said deadline or without the required registration number will be returned unopened to the bidder.

1.    No pre-bid meeting will be held for this project.  Contractors shall personally examine the project site prior to bidding. Requests for information shall be directed to the Project Engineer, no later than 12:00 p.m. on Friday, April 13, 2018.

2.    A full set of Bidding Documents is available for examination at the Mendota City Hall, 643 Quince Street, Mendota, CA 93630 and the offices of the City Engineer.

3.    Sets of plans and specifications for bidding are available from the City Engineer, Provost & Pritchard Consulting Group, at 286 W. Cromwell Ave, Fresno, CA, 93711. 5.    Prevailing Wage Rates: Pursuant to Section 1770, California Labor Code, the successful Bidder shall pay not less than the prevailing rate of per diem wages as determined by the Director of California Department of Industrial Relations. A copy of such prevailing rate is on file at the offices of the City of Dinuba, which copy will be made available for examination during business hours to any party on request: Prevailing wage rate information is also available on the internet at the following website address: http://www.dir.ca.gov/dlsr/PWD.

6.    This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.

7.    Bidders shall furnish a Bid Security with their Bidder’s Proposal in the amount of 10% of the base bid amount.

8.    The City of Mendota reserves the right after opening Bids to reject any or all Bids, to waive any informality or non-responsiveness in a Bid, or to make award to the lowest responsive, responsible Bidder and reject all other Bids, as it may best serve the interest of the the City of Mendota.

9.    Contractor’s License Classification: In accordance with the provisions of California Public Contract Code, Section 3300, the City of Mendota has determined that bidder shall possess a valid Class A Contractor’s License issued by the State of California at the time of Bid award and for the duration of the contract. The General Contractor or the General Contractor’s Subcontractors performing the associated work are required to possess a Class Contractor’s License appropriate to their role in the project. Failure to possess the specified licenses shall render the Bid as non-responsive and shall act as a bar to award of the contract to any bidder not possessing said license at the time of Bid award.

NOTICE IS HEREBY GIVEN that the Board of said District invites and will receive sealed proposals (bids) up to the hour of 2:00 p.m. on April 17, 2018, for the furnishing to said District of all transportation, labor, materials, tools, equipment, services, permits, utilities, and other items necessary to construct said work.  At said time, said proposals will be publicly opened and read aloud at the office of the District Engineer:

Bids shall conform to and be responsive to the Contract Documents for the project that is bidding.  Copies of the Contract Documents for the project are on file and may be examined in the office of AECOM Technical Services, Inc.

A nonmandatory prebid job walk is scheduled for April 3, 2018 at 10:00 a.m. at the District office, 10649 E. Morro Drive, Del Rey, CA 93616 (559) 888-2272.

Copies may be obtained at the office of AECOM Technical Services, Inc. by depositing $35 per set, nonrefundable.  If shipped via UPS ground, an additional $10 per set shall be paid. Electronic (pdf) copies may be obtained free of charge.

Each bid shall be submitted on a form furnished as part of the Contract Documents and must be accompanied by cash, a cashier’s check, a certified check, or a bidder’s bond executed by an admitted surety insurer, or substitute pursuant to Section 995.710 of the Code of Civil Procedure, in an amount not less than 10% of the amount of the bid, made payable to the order of or for the benefit of the District.  The security of unsuccessful bidders will be returned by the District no later than 60 days following the date of award.  Each bid shall be sealed and delivered to the District at the location designated in this notice for the opening of proposals at or before the time in this notice provided.  The check or bond or substitute shall be given as security that the bidder will enter into a contract with the District and furnish the required payment and performance bonds, or substitutes in lieu thereof, and certificates of insurance and endorsements if awarded the work, and will be declared forfeited if the bidder refuses to timely enter into said contract or furnish the required bonds or substitutes, or certificates of insurance and endorsements if his bid is accepted.  A performance bond and a labor and materials bond, each in the amount of 100% of the contract amount, shall be required.

The Board hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

Minimum wage rates for this project, as predetermined by the Secretary of Labor, are set forth in the Federal Requirements section.  If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates determined by the Director of the Department of Industrial Relations of the State of California for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done.  Said wages are on file with the Department of Industrial Relations and the Clerk of the Fresno County Board of Supervisors and are incorporated herein by reference. The work shall be performed in compliance with California Labor Code Sections 1771, 1774-1776, 1777.5, 1813, and 1815.

The work to be performed under this contract is on a project assisted under a program providing direct Federal financial assistance from the Department of Housing and Urban Development, Community Development Block Grant Program, and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 USC 1701u.  Section 3 requires that, to the greatest extent feasible, opportunities for training and employment be given to low and moderate income persons residing within the project area and that the contracts for work in connection with the project be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the area of the project.  Regulations for implementing the Section 3 clause are contained in 24 CFR 135, as amended, and as specified in the project specifications. 

No contractor or subcontractor may be listed on a bid proposal for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 (with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)).

No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.

This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

All pages of the Preliminary (Anticipated) Statement of Work Force Needs form, also contained in the project specifications, will be required to be completed and submitted prior to award. All pages of the Final (Completion) Statement of Work Force Needs form shall also be required to be completed and submitted upon completion of construction. Compliance with the Apprentice Certification Guidelines required by HUD is also required for this project.

Pursuant to Public Contract Code Section 22300, equivalent securities may be substituted for monies withheld to ensure performance of the contract.  The District reserves the right to solely determine the adequacy of the securities being proposed by the Contractor and the value of those securities.  The District shall also be entitled to charge an administrative fee, as determined by District in its sole discretion, for substituting equivalent securities for retention amounts.  The District’s decisions with respect to the administration of the provisions of Section 22300 shall be final and shall include, but not be limited to, determinations of what securities are equivalent, the value of the securities, the negotiability of the securities, the costs of administration and the determination of whether or not the administration should be accomplished by an independent agency or by the District.  The District shall be entitled, at any time, to request the deposit of additional securities of a value designated by District, in District’s sole discretion, to satisfy this requirement.  If the District does not receive satisfactory securities within twelve (12) consecutive days of the date of the written request, District shall be entitled to withhold amounts due Contractor until securities of satisfactory value to District have been received.

The Contractor’s license classification(s) required for this project are as follows:

Class A

Contractors are not required to be licensed at the time of bid but must be licensed prior to execution of Agreement per Public Contract Code 10164.

These classifications are provided for information purposes only.  The Engineer does not warrant that all classifications required for the project are listed.

It is the District’s intent that “plans,” as used in Public Contract Code Section 3300, is defined as the construction contract documents, which include both the drawings and the specifications.

The Board reserves the right to select the schedule(s) under which the bids are to be compared and contract(s) awarded, to reject any and all bids, and to waive any and all irregularities in any bid.

Each bidder is required to sign the attached forms and submit them with his bid.
