FIRST AMENDED COMPLAINT FOR DAMAGES FOR VIOLATION OF FRESNO MUNICIPAL CODE

Plaintiffs, City of Fresno and People of the State of California allege:

1.  Plaintiff, City of Fresno (City) is, and at all times herein mentioned was, a charter municipal corporation, duly organized and existing under and by virtue of the Constitution of the State of California.

2.  The City is authorized to bring a civil action for public nuisance abatement when a nuisance exists within the City in the name of the “People of the State of California”.  (CCP §731.) The Fresno Municipal Code makes it unlawful to own or control a property with a public nuisance.  (FMC §10-605.) Public nuisances include, but are not limited to rubbish, junk, abandoned cars, weeds, blighted vacant buildings and attractive nuisances.  (Civ. Code §§3479-3481; FMC §§10-605, 10-617.) When a nuisance exists, the City is permitted to obtain a judgment for damages, enjoin the continuance of the nuisance, or enter upon and correct it.  (CCP §731). 

3.  The Fresno Municipal Code also provides the City with several modalities to collect on unpaid abatement costs incurred by the City or penalties issued by it resulting from an ongoing public nuisance, including obtaining a personal judgment (FMC §1-510.)

4.  City is informed and believes and thereon alleges that Defendant, Margaret Easley, (and Does 1 through 10 inclusive, collectively Defendant) are, and at all times mentioned herein were, the record owners and operators of the real property, 1227 East Byrd Avenue, Fresno, California, APN 479-162-14 (the Subject Property).

5.  Defendants Does 1 through 10, inclusive, are sued herein under fictitious names.  Their true names and capacities are unknown to City.  When their true names and capacities are ascertained, City will amend this complaint by inserting their true names and capacities herein.  City is informed and believes and hereon alleges that each of the fictitiously named Defendants is responsible in some manner for the occurrences, conditions and or violations herein alleged.

6.  From 2015, through to the present, the City has inspected the Subject Property for building/municipal code violations numerous times and has consistently found it abandoned, containing ongoing and uncorrected public nuisances including broken windows and doors boarded with plywood in violation of the Fresno Municipal Code, oxidized painted exterior stucco surfaces, garage converted to a living space without permits or inspection, and overgrown vegetation. 

7.  From 2015, until the present, the City has noticed owner to correct the public nuisance, without affect.  The City has completed several inspections and issued a Notice and Order regarding the violations, which was not appealed.  The City has spoken with the Defendant to advise of the continuing violations and the City has been advised on numerous occasions the property would be taken care of, and the violations would be corrected.  Attached as Exhibit A is a true and correct copy of the Notice and Order to Remove Public Nuisance Violations issued on October 20, 2015.  Attached as Exhibit B is a true and correct copy of the First Administrative Citation issued on November 30, 2015.  Attached as Exhibit C is a true and correct copy of the invoice issued November 4, 2016, regarding the administrative costs incurred by the City on the Subject Property.

8.  As of March 16, 2018, the total unpaid amount owed by Defendants for the citations and the City’s code enforcement activities at the Subject Property is $33,038.84.  Attached as Exhibit D and incorporated herein by reference is a true and correct copy of the March 16, 2018, Demand for Payoff.

9.  The City continues its efforts on the Subject Property to compel the Defendant to abate the violations of the Fresno Municipal Code, and continues to incur administrative costs, abatement costs, and additional citations may be issued as the violations continue. 

10.  But despite noticing the owner, issuing citations, and periodically abating the public nuisances on the Subject Property, the property remains in constant violation of FMC.

11.  The Fresno Municipal Code provides that any person issued a citation has a right to appeal, but if no appeal is filed the citations shall be final and immediately payable.  (FMC §1-308.)

12.  As of the filing of this complaint, the aforementioned costs and penalties remain unpaid and Defendant has failed to take all necessary corrective actions to bring the Subject Property into compliance.

WHEREFORE, Plaintiffs prays as follows:

1.  That Defendants, and each of them, be ordered to pay any and all abatement costs, administrative costs, and administrative citations issued relating to Public Nuisances on the Property, and judgment be entered in an amount according to proof at the time of trial and or Court or Clerk’s default judgment, which as of March 16, 2018, totaled $33,038.84;

2.  That Plaintiff City recover costs of suit from Defendants and each of them and or their successors and assigns, including reasonable attorney fees.  (Gov’t Code §38773.5, FMC §1-510.);

3.  The court take judicial notice under Evid. Code §452(b) of the Fresno Municipal Code, including sections 1-308, 1-510, 10-605 and 10-617;

4.  For such other and further relief as the court deems proper.

THE CITY OF FRESNO IS INVITING FIRMS TO SUBMIT

“STATEMENTS OF QUALIFICATIONS” FOR:

ENERGY EFFICIENCY PROJECT

The City of Fresno Public Works Department, Facilities Management Division (City) invites qualified Building Energy Solution firms to submit Statements of Qualifications (SOQ) to review City of Fresno assets and implement energy savings in items such as control systems, energy distribution and energy supply (gas, electricity and renewable sources such as solar, wind etc.). The selected firm shall be responsible for complete turnkey services, including the energy savings analysis, project recommendations, design, construction and financing of the capital improvements. The selected firm must also be a comprehensive energy services specialist who will navigate the City of Fresno through the financing and implementation of customized energy efficiency projects, demonstrating quantifiable energy savings from them.  Once all SOQ’s are received the City will interview those firms who have been determined most qualified for the scope of work required. 

The locations of the energy efficiency project will include the Municipal Service Center and Fresno City Hall.

All request for information (RFI) and questions regarding this project shall be in writing via email to the Project Manager identified in this RFQ.  There is to be NO phone calls to the City for additional information or clarification.  The City shall reply to questions or RFI’s that the City deem necessary for the preparation of the Consultant’s RFQ.  Response to RFI’s and questions shall be posted on the City’s Bids-on-line. Notice is hereby given that the Board of Supervisors of the County of Fresno has set Tuesday, the 8th day of January 2019 at the hour of 9:00 A.M., or as soon thereafter as this matter may be heard, in the Board Room of said Board of Supervisors, Room 301, Hall of Records, 2281 Tulare Street, in the City of Fresno, as the time and place for holding a public hearing to consider the following matter:

Extension of an Interim Urgency Ordinance pursuant to Government Code Section 65858, made applicable to all Zoning Districts of the Fresno County, continuing a moratorium on the possession, planting, cultivation, harvesting, drying, or processing of nonmedical cannabis outdoors on the grounds of a private residence and the establishment or operation of a business engaged in commercial cannabis activity. Extension of the Interim Ordinance would be effective for a period of up an additional 10 months and 15 days (to December 5, 2019) unless earlier terminated.

THE CITY OF FRESNO IS INVITING RESPONDENTS

TO SUBMIT PROPOSALS FOR THE

WEST AREA SPECIFIC PLAN

ENVIRONMENTAL IMPACT REPORT & INFRASTRUCTURE FINANCING PLAN

The City of Fresno (City) desires to select qualified Respondent(s) to provide professional consulting services for preparation of an Environmental Impact Report (EIR) and Infrastructure Financing Plan (IFP). The EIR must be consistent with the California Environmental Quality Act (CEQA) [Public Resources Code 21000 et seq.] and the State CEQA Guidelines [California Code of Regulations, Section 15000 et seq.]. Qualified consultants are invited to submit a Proposal.

The City reserves the right to award a consultant contract to one firm to complete both the EIR and IFP, or it may award a consultant contract to two separate firms to complete the EIR and IFP.

All questions must be submitted on RFP Question form found in this RFP.  Questions must be submitted by January 11, 2019 at 5:00 p.m. and must reference the appropriate page and section. The City will not respond to questions received after the deadline. Questions must be directed to Rodney L. Horton, Planner, via email at Rodney.Horton@fresno.gov, or by calling (559) 621-8181, or by visiting the City of Fresno, Development and Resource Management office, located at 2600 Fresno Street, Room 3065, Fresno, CA 93721.

Proposals are to include all labor, material, tools, equipment, and incidentals to perform the work, as described in this RFP. 

Proposals are due no later than 3 p.m. (PST) on February 4, 2019, to the address noted above. The City of Fresno reserves the right to reject any and all Proposals.
