This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check. If the Secretary is the high bidder, he need not pay the bid amount in cash. The successful bidder will pay all conveyancing fees, all real estate and other taxes that are due on or after the delivery of the remainder of the payment and all other costs associated with the transfer of title. CITY OF FRESNO

COMMUNITY FACILITIES DISTRICT NO. 9

ANNEXATION NO. 23

Notice is hereby given that on February 15, 2019, the City Council of the City of Fresno (“City”) adopted Resolution 2019-021 to annex the territory known as Assessor’s Parcel Number 501-153-05S and 501-153-06S to the City of Fresno Community Facilities District No. 9 (“CFD No. 9”) and to authorize the levy of Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”).  Under this City Law and Resolution 2019-021, the City gives notice as follows:

The text of Resolution 2019-021, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Resolution 2019-021 is summarized as follows:

a.            As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 9, the boundaries of which are shown on the map on file with the City Clerk.

b.            The purpose of CFD No. 9 is to provide services and maintenance for certain regulatory required public improvements that are constructed or installed on public property, dedicated rights-of-way or easements on the perimeter of commercial, industrial and multi-family subdivisions.  These improvements include, without limitation, landscaping and irrigation systems, street trees, median hardscaping, local street curbs, gutters, sidewalks, street paving, street name signage and street lights, trails and trail amenities (“Services”).

c.            The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 9 under the rate and method of apportionment described in Resolution 2019-021 and Exhibit C thereto.  The special tax requires the approval of two-thirds of the qualified electors of CFD No. 9 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.

d.            The Special Tax, if approved, will be used to finance all or a portion of the Services.

e.            The Director of Public Works or his designee of the City is directed to cause to be prepared a written report for CFD No. 9, Annexation No. 23 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 9 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.

f.             As set forth below, the City will hold a public hearing on the annexation of Assessor’s Parcel Number 501-153-05S and 501-153-06S to CFD No. 9 with its Services and Special Tax.

g.            The time and place established under Resolution 2019-021 for the public hearing required under City Law are Thursday, March 21, 2019, at the hour of 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.

            At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 9, the extent of CFD No. 9 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 9, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 9 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 9 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 9, or against levying a specified Special Tax, those types of facilities or the specified special tax will be eliminated from the proceedings to annex to CFD No. 9.

            The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 9.

MITIGATED NEGATIVE DECLARATION

March 13, 2019       

NOTICE IS HEREBY GIVEN that the City of Fowler has prepared an Initial Study and proposes a Mitigated Negative Declaration in accordance with the California Environmental Quality Act (CEQA) for the project described below. The Initial Study and related materials are available for review at the Fowler Planning Department at 128 S. 5th Street, Fowler, CA 93625. 

Sunshine Raisin Corporation has proposed to subdivide approximately 30 acres of fallow agricultural land at the northeast corner of Adams Avenue and Armstrong Avenue into 80 lots for single-family residential development. The lots range between 10,000 and 16,000 square feet in size. There is a designated remainder parcel of slightly less than 6,000 square feet abutting Armstrong Avenue. The Project proposes six interior local streets generally forming a grid pattern, with cul-de-sacs proposed at locations where through-streets are not possible or practical. The interior circulation system will connect to the City’s existing collector street system at Armstrong Avenue to the west and Adams Avenue to the south; it also proposes a connection to potential future development to the north.

The public review period for the Initial Study and proposed Mitigated Negative Declaration will begin on March 13, 2019 and will end at 5:00 pm on April 1, 2019.

The Initial Study/Mitigated Negative Declaration and the proposed Project, including any comments received, will be reviewed by the Planning Commission during a public hearing at a regular meeting to be held at 6:30 p.m. on April 4, 2019.  Following its consideration of the Initial Study/Mitigate Negative Declaration and the proposed Project, the Planning Commission will make a recommendation to the City Council.  The City Council will consider the recommendation of the Planning Commission regarding the Initial Study/Mitigated Negative Declaration and the proposed Project at a regular meeting to be held at 7:00 p.m. on or after April 23, 2019.  All meetings will occur in the City Council Chambers at Fowler City Hall, 128 S. 5th Street, Fowler, CA 93625.

Poso Resource Conservation District

The Poso Resource Conservation District was formed in 1957 pursuant to the Resource Conservation District Law Public Resources Code sec. 9151 et seq. The District’s service area encompasses 67,905 acres and its sphere of influence (SOI) encompass 1,342,718. The District is located in northwest Fresno County and is contiguous to Madera County on the north and to the Firebaugh Resource Conservation District to the south. A portion of the District is located within Merced County.

Firebaugh Resource Conservation District

The Firebaugh Resource Conservation District was formed in 1951 pursuant to the Resource Conservation District Law Public Resources Code sec. 9151 et seq. The District’s service area encompasses 87,938 aces and its SOI encompasses approximately 1,342,718 acres. The District is located in northeast Fresno County and is contiguous to the north of Madera County and Poso Resource Conservation District, to the west of Merced County and Panoche Resource Conservation District, to the south of the Westside Resource Conservation District, and to the east of Tranquility Resource Conservation District. 

Silver Creek Drainage District

The Silver Creek Drainage District was formed in 1982 pursuant to County Drainage District Act of 1903 Water Code (sec. 5600 et seq.). The District’s service area encompasses 49,873 acres (77.9) square miles and the SOI encompasses 155,864 acres including the unincorporated area surrounding the City of Mendota and south and west of the City of Firebaugh.

County Service Area 18 (Calwa)

CSA No. 18 (Calwa) was formed in 1966 pursuant to County Service Area Law (Government Code sections 25210-25217) as a single-purpose District to provide street lighting within the unincorporated community of Calwa. CSA 18 is located in southeast Fresno and is bounded by Church Avenue to the north, the Jensen Avenue bypass to the south, Cedar Avenue to the east, and Orange Avenue to the west. The District’s service area encompasses 119 acres.  The Fresno LAFCo deleted the CSA 18 SOI in 2017 in anticipation of the District’s dissolution. 

Description of project: The project consists of the dissolution of CSA 18, Silver Creek Drainage District, Poso Resource Conservation District, and Firebaugh Resource Conservation District in accordance with SB 448. After the effective date of the dissolution the districts shall be dissolved, disincorporated and extinguished, their existence shall be terminated and all of their corporate powers shall cease.  No development is proposed.  The initial study assesses the environmental impacts associated with the dissolutions and concluded the project will not have any direct or indirect significant effects.  Copies of the initial study and proposed negative declaration are available for viewing and downloading at www.fresnolafco.org under the Documents for Public Review tab.

Hearing date: It is anticipated the Commission will consider staff’s recommendation to adopt a negative declaration for the project as part of a regular meeting calendared for April 3, 2019. The public hearing to consider this item will be held at 1:30 p.m., or soon thereafter, on April 3, 2019, in Room 301, Hall of Records, Tulare and “M” Streets, Fresno.  All interested parties are invited to attend this hearing and present testimony on these matters.

Each Bidder submitting a proposal to complete the work, labor, materials and/or services (“Work”) subject to this procurement must be a Department of Industrial Relations (DIR) registered contractor pursuant to Labor Code §1725.5 (“DIR Registered Contractor”).  A Bidder who is not a DIR Registered Contractor when submitting a proposal for the Work is deemed “not qualified” and the proposal of such a Bidder will be rejected for non-responsiveness.  Pursuant to Labor Code §1725.5, all Subcontractors identified in a Bidder’s Subcontractors’ List shall be DIR Registered Contractors.  If awarded the Contract for the Work, at all times during performance of the Work, the Bidder and all Subcontractors, of any tier, shall be DIR Registered Contractors.

The Work is subject to payment of Prevailing Wage Rates (PWRs).  The Contractor and all Subcontractors of every tier shall pay laborers performing any portion of the Work not less than the PWR established for the labor provided.  Pursuant to Labor Code §1771.4(a)(4), PWR monitoring and enforcement shall be by the Department of Industrial Relations.

The Director of the Department of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate per diem wages, rate for legal holidays and overtime work, and employee payments for health and welfare, vacation, pension and similar purposes applicable to the work to be performed. Said wages and rates are on file in the District Office and are incorporated herein by reference.
