No bid will be considered unless it is made on a bid proposal form furnished by the City Engineer.  Each bid must be accompanied by a certified or cashier’s check or bidder’s bond, made payable to the City of Clovis, for an amount equal to at least ten percent (10%) of the amount bid.  Such guarantee will be forfeited should the bidder to whom the contract is awarded fail to enter into the contract.  A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to whom the contract is awarded.  Said bonds shall be issued by a surety company who is an admitted surety insurer authorized by the California Department of Insurance to transact business in this state, and acceptable to the City of Clovis.  Bidders are cautioned that representations made by surety companies will be verified with the California Department of Insurance.  Pursuant to Public Contract Code Section 22300, substitution of securities for any monies withheld by the City of Clovis to ensure performance under the contract shall be permitted.  In accordance with the provisions of Chapter 13 (commencing with Section 4590), Division 5, Title 1 of the Government Code of the State of California, securities may be substituted for monies withheld on the project.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the General Prevailing Rates and wages and employer payments for health and welfare pension, vacation, travel time and subsistence pay, as provided for in Section 1773, apprenticeship or other training programs authorized by section 3093, and similar purposes applicable to the work to be done.  Said wages are available from the Internet web site of the California Department of Industrial Relations at http://www.dir.ca.gov/DLSR/PWD and also available at the City Clerk Office, Clovis Civic Center, 1033 Fifth Street, Clovis, CA 93612.  A copy of the above-mentioned wage rates shall be posted by the Contractor at the job site where it will be available to any interested party.

All bids are to be compared on the basis of the City Engineer’s estimate of the quantities of work to be done as shown in the bid proposal form.  The Contractor must be licensed in accordance with the provisions of the Business and Professions Code, Division 3, Chapter 9 “Contractor”.  Bidders for this project must possess a valid Class A or C34 License prior to award of the contract and will be requested to indicate the license expiration date, and the license number on the bid proposal if available.  Award consideration will take place at the earliest available Council meeting or as the City Manager has been authorized to award and execute the contract.  All representations made on the proposal are made under penalty of perjury.

The City of Clovis reserves the right to reject any or all bids, to waive any informalities or minor irregularities in the bids received, or to award the contract to the lowest responsible bidder as may serve the best interest of the City of Clovis.

THE CITY OF FRESNO IS INVITING CONSULTANTS TO

SUBMIT STATEMENTS OF QUALIFICATIONS FOR

BICYCLE FACILITIES ON-CALL ENGINEERING SERVICES

I.  Introduction

The City of Fresno, Public Works Department is requesting Statements of Qualifications (SOQ) from qualified consulting firms to provide on-call traffic and civil engineering services for on-street bicycle facilities.

II.  Project Description

The City of Fresno Public Works Department seeks to continue the implementation of on-street bicycle facilities such as Class II bike lanes and Class IV separated bikeways. For these bicycle facility and related projects, the Department is seeking the services of one or two on-call firms to provide assistance. The Department anticipates the use of task orders authorizing design work for specific project locations, out of the overall contract amount.

III.  Scope of Services

Services may generally include:

§ Prepare conceptual drawings and striping plans utilizing aerial photos and field reviews as necessary.

§ Prepare cost estimates for project concepts.

§ Analyze corridors and intersections for traffic operations associated with existing and proposed lane configurations.

IV.  SOQ Requirements

If your firm is interested in this project, please submit four (4) copies of your Statement of Qualifications that includes the following:

Cover letter;Overview of the firm and any proposed sub-consultants;Summary of the company’s experience and performance on similar projects completed in the last five years, including references;Resumes for the Project Manager and key staff involved in the day to day operation, including education, relevant past project experience, and description of their assignment on this project; and,A listing of client references associated with completed projects.

At this time, a consultant fee shall not be included in the submittal package.

The SOQ should be precise and not exceed twenty-five (25) pages. The twenty- five (25) pages include cover letter and table of contents.

VI.  Consultant Selection

Consultant selection for award of a contract shall be in accordance with City’s consultant selection policy, qualitative analysis and Consultant Evaluation form.  The City reserves the right to make the selection of a consultant based on any or all factors of value, whether quantitatively identifiable or not, including, but not limited to, the anticipated initiative and ability of the consultant to perform the services set forth herein.

The screening of the Consultant’s SOQ shall be based on categories as identified on the Consultant Evaluation Form.  Consultants who score the highest, based on the criteria on the Consultant Evaluation Form, will be selected. 

This solicitation for SOQ’s does not commit the City of Fresno to enter into a contract or to pay any costs incurred in the preparation of the SOQ.  The City of Fresno reserves the right to accept or reject any SOQ’s, and to negotiate with any qualified consultant, or to cancel in part or in its entirety this solicitation for SOQ’s.

Professional Liability Insurance

Professional liability insurance (errors and omissions) with limit of liability of not less than $1,000,000 per occurrence and $2,000,000 aggregate, and commercial general liability of not less than $1,000,000 per occurrence and $2,000,000 aggregate will be required for this project.  The City’s standard contract will be used, which includes; a conflict of interest statement, and completion of a statement of economic interest.  Copies of the City’s Standard Contract, Local Preference, and Consultant Selection Polices are available on request.

Regulated Communication in City Procurement Process Ordinance

The Regulated Communications in City Procurement Process Ordinance (Article 6, Chapter 4 of the Fresno Municipal Code) became effective April 29, 2004.  With certain specified exceptions, the Ordinance provides that no Respondent, Bidder, Proposer (as the case may be) shall initiate, engage in, or continue any communication to or with any City elected official concerning or touching upon any matter which is the subject of this competitive procurement process.

Any Respondent, Bidder, Proposer or elected official (as the case may be) who initiates, engages in, continues in, or receives any regulated communication shall file the written disclosure required by the Regulated Communications in City Procurement Process Ordinance.

Any Respondent, Bidder, or Proposer violating the Regulated Communications in City Procurement Process Ordinance may be disqualified from participating in this procurement process and/or determined to be non-responsible.  Additionally, the City may set aside the award of a contract, prior to its execution, to a party found to have violated the Ordinance.

Debarment

A Proposer who has been determined by the Council to be non-responsible may be debarred from bidding or proposing upon or being awarded any contract with the City, or from being a subcontractor or supplier at any tier upon such contract, in accordance with the procedures in Resolution 2003-130 adopted by Council on April29, 2003.  The initial period of any such debarment shall not be less than one year or more than three years.  A Proposer may request a hearing, in accordance with Resolution 2003-130, upon receipt of a notice of proposed debarment from the City Manager or his/her designee.  A copy of the Resolution may be obtained from the City Clerk’s Office, 2600 Fresno Street, Fresno, California 93721.

VII.  Request for Information

All requests for information (RFI) and questions regarding this project shall be in writing via email or FAX to the Project Manager identified in this SOQ.  There is to be NO phone calls to the City for additional information or clarification. The City shall reply to each question or RFI that the City deems necessary for the preparation of the Consultant’s SOQ.  Response to each RFI or questions shall be done via email and posted on the City’s PlanetBids website.  The email list that shall be utilized for distribution of each response shall be the City of Fresno Public Works Master Consultant List.  The City does not guarantee the email list is complete and accurate.  It is the responsibility of the Consultant to ensure proper email address is on record with the City of Fresno.  Failure to abide by this provision shall deem that Consultant non-responsive and the SOQ will not be considered.  The deadline for submitting all RFI and questions is February 27, 2019.
