Plaintiff, CITY OF FRESNO, (“City”) a municipal corporation, complains of Defendants, and each of them, and for a cause of action, alleges as follows:

I.

INTRODUCTION

1.         The City is informed and believes and thereon alleges that Defendant BILLY CHARLES DANIEL FLETCHER, (“Fletcher”) is an individual residing in the City of Fresno, State of California.

2.         The true names or capacities, whether individual, corporate, associate, or otherwise of Defendants DOES 1 through 5, Inclusive, are unknown to City who therefore sues said Defendants by said fictitious names, and leave of court will be asked to amend this Complaint to show their true names and capacities when the same have been ascertained.

3.         At all times herein mentioned, Defendants, and each of them, were the agents, servants and employees of the other named Defendants and were acting at all times herein mentioned within the scope of their agency and employment and with the knowledge and consent of their principals and employers.

4.         At all times herein, Plaintiff, City was and now is a municipal corporation, duly organized and existing under and by virtue of the Constitution of the State of California and is permissibly self-insured for workers’ compensation liability and is legally obligated to discharge any liability for workers’ compensation benefits imposed by the workers’ compensation laws of the State of California.

5.        At all times herein mentioned, City, a municipal corporation, was the employer of Pearl Ramona Garcia (“Garcia”).

6.         At all times herein mentioned, the City was the registered owner of a 2005 Ford Ranger, California license plate #1195681.

7.         At all times herein mentioned, Defendant Fletcher was the registered owner of a 1994 Toyota Camry, California license plate #7GLH796.

FIRST CAUSE OF ACTION

(Negligence)

8.         City incorporates by reference, paragraphs 1 through 7 above as tough fully set forth herein.

9.         On or about March 23, 2015, at approximately 6:38 a.m., Garcia of the City, was operating a Ford Ranger, license plate number 1195681, and was west bound Herndon in the number three lane going through the intersection of Ingram on a green circular light when the other vehicle, driven by Defendant Billy Charles Daniel Fletcher, came from south bound Ingram and made a right hand turn into her, causing his vehicle to hit her vehicle.  After the collision, Fletcher fled the accident scene.  Garcia followed the vehicle all the way to Fruit just north of Herndon, when she saw the vehicle make a left hand turn into the apartment complex.  She said the vehicle never stopped for her nor did the driver attempt to speak to her.  She contacted law enforcement, who arrived shortly after at the apartment complex.  As Garcia and the officer were talking about the collision, Garcia identified Fletcher walking out from the driveway of the apartment complex.  The officer made contact with Fletcher inside the apartment complex, who admitted causing the accident and fleeing the scene. 

10.       At all times herein mentioned, Defendant Fletcher, negligently owned, operated and drove the Toyota Camry bearing the California License Plate #7GLH796, on or about Herndon and Ingram Avenues, so that he was driving too fast for road conditions in violation of Vehicle Code section 22350 and for making an unsafe turn in violation of Vehicle Code Section 22107 when his vehicle side-swiped the vehicle driven by Garcia.

11.       At all times herein mentioned, Herndon Avenue where it intersects with Ingram Avenue was a public street in the City and County of Fresno, State of California.

12.       As a proximate result of the negligence and carelessness of Defendant Fletcher, the 2005 Ford Ranger owned by Plaintiff City, bearing California license plate #1195681 sustained damage. 

13.       As a proximate result of the negligence and carelessness of Defendant Fletcher, Plaintiff City, incurred property damage in the amount of $1087.33, and loss of use of the vehicle for three days, calculated at $47.99 per day, total property damages amounting to $1,231.30.

14.       The City, made a legal tender to Fletcher and Fletcher’s insurance company, Geico Insurance Company. But the City received no response from Defendant Fletcher or his insurance company, Geico Insurance Company.

SECOND CAUSE OF ACTION

(Workers’ Compensation Subrogation)

15.       City incorporates by reference, paragraphs 1 through 14 above as tough fully set forth herein.

16.       At all times herein mentioned, Herndon Avenue where it intersects with Ingram Avenue was a public street in the City and County of Fresno, State of California.

17.       As a proximate result of the negligence and carelessness of Defendant Fletcher, Pearl Ramona Garcia, an employee for the City, sustained physical injuries to her person, requiring medical treatment.  Said injuries occurred at or near the intersection of Herndon and Ingram Avenues.  Said injuries arose out of and occurred in the course and scope of her employment with Department of Public Utilities for the City Of  Fresno.

18.       As a proximate result of said negligence and carelessness of Defendant Fletcher, and the resulting injuries sustained by Garcia, Plaintiff, City, has been obligated to pay, pursuant to the Workers’ Compensation Act of the State of California, the following workers’ compensation benefits on behalf of its employee, Garcia:  Medical: $4,226.32, Indemnity $365.21, Loss Allocated Expenses $4,222.32, for a present certain total of $12,773.67.  The City anticipates additional $32,697.50 indemnity costs of $32,697.50 for a total of $45,471.17.

            WHEREFORE, Plaintiff prays judgment against Defendants, and each of them, for:

1.  For property damage expenses (vehicle) in the amount of $1,087.33;

2.  For loss of use of the vehicle in the amount of $1,231.30;

3.         Workers’ compensation benefits paid, or to be paid to, or on behalf of Pearl Ramona Garcia, in the amount of $45,471.17;

4.         For other workers’ compensation benefits in an amount yet to be determined;

5.         For costs of suit incurred herein;

6.         For attorneys’ fees incurred herein;

7.         For interest on the above sums at the legal rate; and

8.         For such other and further relief as the Court may deem just and proper.

CITY OF FOWLER CITY COUNCIL MEETING

February 6th, 2018

NOTICE IS HEREBY GIVEN that on Tuesday, February 6th, 2018, at 7:00 p.m. or as soon thereafter as the matter can be heard, the Fowler City Council will hold a public hearing at the City Hall Council Chambers at 128 S. 5th Street, Fowler, California to consider the following application:

Site Plan Review Application (SPR) No. 13-02 (City of Fowler Fire station): The City of Fowler proposes to build a Fire station located at the south corner of South 5th Street and East Main Street. The site is zoned Form Based Code (FBC) and is approximately 0.3 acres (APN:343-212-01T).

Environmental Finding. The SPR is categorically exempt from CEQA under Class 32 Categorical Exemption – In-fill Development Projects. A Class 32 consists of projects characterized as in-fill development meeting the conditions described in this section. (a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations. (b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses. (c) The project site has no value as habitat for endangered, rare or threatened species. (d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality. (e) The site can be adequately served by all required utilities and public services. An Initial Study was also prepared to confirm that all Appendix G checklist items our considered as No Impact.

The Planning Commission has recommended approval on this matter during their regularly scheduled meeting of January 4th, 2018. The City Council requests your participation and the public is welcome to speak at the hearing. If you challenge any action in court, you may be limited to only those issues raised at the public hearing, or in written correspondence delivered to the Community Development Department at, or prior to, the public hearing.

The City of Fresno is soliciting proposals from qualified contractors holding a valid C-27 California Contractors License to provide necessary labor, equipment, and materials to perform landscape maintenance as specified.  This request is for a 5-year Contract with three 1-year extensions.
