NOTICE OF PUBLIC HEARING

REGARDING ANNEXATION OF TERRITORY TO CITY OF FRESNO

COMMUNITY FACILITIES DISTRICT NO. 9

ANNEXATION NO. 36

Notice is hereby given that on November 8, 2018, the City Council of the City of Fresno (“City”) adopted Council Resolution No. 2018-254 to annex Assessor’s Parcel Number 404-500-20 and 404-500-21 to the City of Fresno Community Facilities District No. 9 (“CFD No. 9”) and to authorize the levy of Special Tax under the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”).  Under this City Law and Council Resolution No. 2018-254, the City gives notice as follows:

The text of Council Resolution No. 2018-254, including exhibits thereto, as adopted by the City is on file with the City Clerk and reference is made thereto for the particular provisions thereof.  The text of Council Resolution No. 2018-254 is summarized as follows:

a.  As permitted by City Law, the City is undertaking proceedings to annex additional territory to CFD No. 9, the boundaries of which are shown on the map on file with the City Clerk.

b.  The purpose of CFD No. 9 is to provide services and maintenance for certain regulatory required public improvements that are constructed or installed on public property, dedicated rights-of-way or easements on the perimeter of commercial, industrial and multi-family subdivisions.  These improvements include, without limitation, landscaping and irrigation systems, street trees, median hardscaping, local street curbs, gutters, sidewalks, street paving, street name signage and street lights, trails and trail amenities (“Services”).

c.  The method of financing the Services is through the imposition and levy of a special tax (“Special Tax”) to be apportioned on the properties in CFD No. 9 under the rate and method of apportionment described in Council Resolution No. 2018-254 and Exhibit C thereto.  The special tax requires the approval of two-thirds of the qualified electors of CFD No. 9 at a special election called for that purpose by the City, with each voter having one vote for each acre, or portion of an acre, owned.

d.  The Special Tax, if approved, will be used to finance all or a portion of the Services.

e.  The Director of Public Works or his designee of the City is directed to cause to be prepared a written report for CFD No. 9, Annexation No. 36 (“District Report”) that shows the Services by type and required to adequately meet the needs of CFD No. 9 and the estimated costs of the Services.  The District Report will be made a permanent part of the record of the public hearing specified below.  Reference is made to the District Report as filed with the City Clerk.

f.  As set forth below, the City will hold a public hearing on the annexation of Assessor’s Parcel Number 404-500-20 and 404-500-21 to CFD No. 9 with its Services and Special Tax.

g.  The time and place established under Council Resolution No. 2018-254 for the public hearing required under City Law are Thursday, December 13, 2018, at the hour of 10:00 a.m. or as soon as possible thereafter in the Council Chambers of the City of Fresno, 2600 Fresno Street, Fresno, California.

At the hearing, the testimony of all interested persons or taxpayers for or against the proposed annexation to CFD No. 9, the extent of CFD No. 9 or the furnishing of the Services will be heard.  Any person interested may file a protest in writing as provided by City Law.  If fifty percent or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be annexed to CFD No. 9, or the owners of one-half or more of the area of land in the territory proposed to be annexed to CFD No. 9 and not exempt from the Special Tax, file written protests against the annexation and the protests are not withdrawn to reduce the value of the protests to less than a majority, the City will take no further action to annex to CFD No. 9 or levy the Special Taxes for a period of one-year from the date of the decision of the City, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of facilities within CFD No. 9, or against levying a specified Special Tax, those types of facilities or the specified special tax will be eliminated from the proceedings to annex to CFD No. 9.

The proposed voting procedure will be by mailed ballot among the property owners within the territory proposed to be annexed to CFD No. 9.

Description of Work: The work includes, in general, Base Bid – includes roadway excavation, placement of concrete pad, HMA and aggregate base, grind and overlay with pavement fabric, installation of driveway approach, sidewalk, ADA compliant ramps, signage and striping, 30-inch HDPE storm drain main, 60-inch storm drain manhole and modify existing storm drain manholes. Schedule A – includes installation of 8 and 10-inch C900 water main, 4 and 1-inch water services, 8-inch ductile iron Class 150 water main, fire hydrant and appurtenances. Schedule B – includes removal and disposal of existing 8-inch sewer main, installation of 8 and 10-inch SDR-35 sewer main, 48-inch sanitary sewer manholes and epoxy existing sewer manholes.  The time to complete the work is before the expiration of Seventy (70) CONSECUTIVE WORKING DAYS beginning on the day specified in the Notice to Proceed.

The City of Reedley hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantage Business Enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

The DBE contract goal is 5 percent.

The prevailing wage rates as determined by the Director of Industrial Relations of the State of California shall apply to this project.  In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for Section 1773.8 of the California Labor Code, apprenticeship or other training programs authorized by Section 3093 of said code, and similar purposes applicable to the work to be done.  Said wages are on file with the City of Reedley and County of Fresno and are incorporated herein by reference.  By submission of a bid, bidder stipulates and agrees to abide by the provisions of the Labor Code related to payment of prevailing wage or promptly pay a penalty of $50.00 per day per worker paid less than prevailing wage pursuant to the provisions of Labor Code Section 1775.  A work day shall not exceed eight hours labor per day or forty (40) hours labor per week.  The successful bidder shall keep an accurate record of employees’ hours worked by calendar day and week.

Minimum wage rates for this project, as predetermined by the Secretary of Labor, are set forth herein in the Bid and Contract Documents and incorporated as part of the special provisions.  These wage rates may be examined at the City of Reedley where the project plans, special provisions, bid and contract documents may be seen.  If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates determined by the Director of the Department of Industrial Relations of the State of California for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate.

In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pensions, vacation, travel time and subsistence pay provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done.  Said wages are on file with the Clerk of the Fresno Board of Supervisors, the City of Reedley and are incorporated herein by reference.

The work to be performed under this contract is on a project assisted under a program providing direct Federal financial assistance from the Department of Housing and Urban Development, Community Development Block Grant Program, and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 USC 1701u.  Section 3 requires that to the greatest extent feasible opportunities for training and employment be given to low and moderate income persons residing within the project area and that the contracts for work in connection with the project be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the area of the project.  Regulations for implementing the Section 3 clause are contained in 24 CFR 135, as amended, and as specified in the project specifications.

All pages of the Preliminary (Anticipated) Statement of Work Force Needs form, also contained in the project specifications, will be required to be completed and submitted prior to award.  All pages of the Final (Completion) Statement of Work Force needs form shall also be required to be completed and submitted upon completion of construction.

Bids must be filed with the Reedley City Engineer, 1733 Ninth Street, Reedley, no later than 3:00 p.m., Thursday, December 20, 2018, at which time the Office of the Engineering Department, City Engineer of the City of Reedley will open said bids.  Bids must be submitted in a sealed envelope and marked on the outside of the envelope “BID – REEDLEY CITY STREET IMPROVEMENTS (PHASE VIII), RECONSTRUCTION ON DINUBA AVENE FROM SOUTHERN PACIFIC RAILROAD TO EAST AVENUE AND EAST AVENUE FROM DINUBA TO LINCOLN AVENUE CDBG PROJECT NO. 17571”, together with the name and address of the bidder.  The bids will be opened and read publicly at that time. 

Each bid must be accompanied by either a cashier’s check, certified check or bidder’s bond in a sum equal to at least ten (10%) percent of the total amount bid inclusive of all awarded bid scheduled items.  Checks or bonds must be made payable to the City of Reedley; such securities shall be a guarantee that the bidder, if his bid is accepted, will enter into a satisfactory contract and furnish a good and sufficient bond for faithful performance thereof and for payment of labor and material costs in accordance with the requirements of the plans and specifications.

No contract will be awarded to a Contractor who has not been licensed in accordance with the provisions of Chapter 791, Statutes of 1929, as amended, or whose bid is not on the proposal form included in the contract documents. An appropriate and valid California Contractor’s License is required for award and not for bidding on the project. A Class A, General Engineering Contractor’s license is required.

No contractor or subcontractor may be listed on a bid proposal for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)].

No Contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.

This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

Interpretations: All questions about the meaning or intent of the Contract Documents shall be directed to the office of the City Engineer in writing. Interpretations or clarifications considered necessary by the City Engineer in response to such questions will be resolved by the issuance of addenda delivered to all parties listed on the plan holders list. Questions or requests for information received less than 3 business days prior to the date of opening bids shall be considered nonresponsive and therefore not addressed. Only questions that have been resolved by formal written addenda shall be binding. Oral and other interpretations or clarifications will be without legal or contractual effect.

Bid Protests: Contractor shall follow the bid protest procedures outlined in Bid and Contract Documents book for any and all claims against the City in connection with the bid process for this project.

The City reserves the right to reject any or all bids, to waive any informality in bids received, or to award the contract to the lowest responsible bidder complying with these instructions as may serve the best interest of the City of Reedley.  The City reserves the right to award the contract to other than the lowest bidder if it appears that the best interests of the City of Reedley will be served thereby.

NEGATIVE DECLARATION

Notice is hereby given that the County of Fresno has prepared Initial Study Application (IS) No. 7460 pursuant to the requirements of the California Environmental Quality Act for the following proposed project:

INITIAL STUDY APPLICATION NO. 7460 and DIRECTOR REVIEW AND APPROVAL APPLICATION NO. 4544 filed by JORGE MADRIZ AND LETICIA MADRIZ RIOS, proposing to allow a truck and trailer storage and maintenance facility devoted exclusively for the transportation of agricultural products, supplies and equipment on a 4.9-acre parcel in the AE-20 (Exclusive Agricultural, 20-acre minimum parcel size) Zone District. The project site is located on the west side of Siskiyou Avenue, approximately 260 feet north of its intersection with Nielsen Avenue, approximately 2,915 feet north of the nearest city limits of the City of Kerman (549 N. NOTICE INVITING SEALED BIDS

COPPER AVENUE CROSSING REPLACEMENT PROJECT – 2018

GARFIELD WATER DISTRICT

NOTICE IS HEREBY GIVEN that the Board of Directors of the Garfield Water District (District) invites all and will receive sealed Bids at the office of the Engineer, 209 South Locust Street, Visalia, California, up to the hour of 2:00 p.m. on the 19th day of December, 2018, for the construction of a twenty-four (24) inch irrigation pipeline and appurtenances (Work). 

The award will be made to the lowest responsive, responsible Bidder in accordance with the Contract Documents, but the District reserves the right to reject any and all Bids and waive minor discrepancies in the Bid.

Copies of the Contract Documents are on file and may be examined at the office of the Engineers.  Plans and Specifications may be obtained from the office of the Engineers, Dennis R. Keller/James H. Wegley, Consulting Engineers, 209 South Locust Street, Visalia, California 93291.  A non-refundable charge of $50.00 will be required for each set of Plans and Specifications, which includes shipping.  Only contractors purchasing Plans and Specifications from the office of the Engineer will be allowed to submit a sealed Bid. 

The successful Bidder shall produce the required Performance and Payment Bonds within fifteen (15) calendar days from the award of the Contract.  The successful Bidder will be required to furnish a faithful Performance Bond in an amount equal to one hundred (100) percent of the Contract price and a Payment Bond in an amount equal to one hundred (100) percent of the Contract price, said bonds to be obtained from a surety company satisfactory to the District and insurance coverage in defined coverages and amounts.

Attention of Bidders is particularly called to the requirements as to conditions of employment to be observed and minimum prevailing wage rates to be paid under the Contract, said items being contained in the Specifications.  In accordance with the provisions of California Labor Code §§ 1770, 1773, 1773.1, 1773.2, 1773.6 and 1773.7, the general prevailing rate of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in §1773.8, apprenticeship or other training programs authorized by §3093 and similar purposes applicable to the work to be done in the County of Fresno have been determined by the DIR Director.  These wages rates appear in the DIR publication entitled General Prevailing Wage Rates and said wages are on file with the District and Engineer and are incorporated herein by reference.  Interested parties can obtain the current wage information by submitting their requests to the Department of Industrial Relations, Division of Labor Statistics and Research, P.O. Box 42603, San Francisco, CA 94142, or on the World Wide Web at: http://www.dir.ca.gov/dlsr/DPreWageDetermination.htm.  The rates at the time of the Bid advertisement date will remain in effect for the life of the Work in accordance with the California Code of Regulations, as modified and effective.

In accordance with California Labor Code §§1771.1 & 1771.4(a)(1), a Contractor or Subcontractor shall not be qualified to bid on, be listed in the Bid Proposal (subject to the requirements of §4104 of the Public Contract Code), or engage in the performance of any work under the Contract, unless currently registered and qualified to perform public work pursuant to §1725.5 of the Labor Code.  An unregistered Contractor may submit a Bid (as long as the Bid is authorized by §7029.1 of the Business and Professions Code or by §§10164 or 210103.5 of the Public Contract Code), provided the Contractor is registered to perform public work pursuant to §1725.5 of the Labor Code at the time the Contract is awarded.  Prior to award of the Bid, the Contractor or Subcontractor shall provide proof of said current registration with the DIR to perform public work to the District.  This Work is subject to compliance monitoring and enforcement by the DIR.

Contractors and Subcontractors must submit electronic certified payroll records, as provided under Labor Code §1776, to the Labor Commissioner. These records must be submitted on a weekly basis, or as required by statute, or by the DIR.

A time limit for the final completion of the Work of sixty (60) calendar days has been set and liquidated damages shall be assessed according to the Contract Documents for each calendar day thereafter that the Work is not completed.

A non-mandatory pre-Bid conference will be held on December 10, 2018, at 1:00 p.m. at the office of P-R Farms, Inc. located at 2917 Shepherd Avenue, Clovis, California.

Prospective Bidders shall be licensed contractors in the State of California and shall be skilled and regularly engaged in the general class or type of work called for under the Contract.  In accordance with the provisions of California Public Contract Code §3300, the District has determined that the Contractor shall possess a valid Class A (General Engineering) Contractor’s license.  Failure to possess said license at the time of award shall render the Bid non-responsive and shall act as a bar to award of a Contract to any Bidder not possessing said license.
