Plaintiff, CITY OF FRESNO, a municipal corporation, psi, Administered by RISICO CLAIMS MANAGEMENT, formerly AMERICAN ALL-RISK LOSS ADMINISTRATORS, (hereinafter “CITY”), complains of Defendants, and each of them, and for a cause of action, alleges as follows:

1.         Defendant, NORRIS SHANE COBB, II (hereinafter “COBB”) is an individual residing in the City of Fresno, County of Fresno, and State of California.

2.         The true names or capacities, whether individual, corporate, associate, or otherwise of Defendants, DOES 1 through 50, inclusive, are unknown to Plaintiff who therefore sues said Defendants by said fictitious names, and leave of court will be asked to amend this complaint to show their true names and capacities when the same have been ascertained.

3.         That at all times herein mentioned, Defendants, and each of them, were the agents, servants and employees of the other named Defendants and were acting at all times herein mentioned within the scope of their agency and employment and with the knowledge and consent of their principals and employers.

4.         That at all times herein mentioned, Plaintiff was and now is a municipal corporation organized and existing under and by virtue of the laws of one of the States of the United States and is permissibly self-insured for workers’ compensation liability and is legally obligated to discharge any liability for workers’ compensation benefits imposed by the Workers= Compensation laws of the State of California.

5.         That at all times herein mentioned, FRESNO POLICE DEPARTMENT, functioning as an Agency for the CITY, was the employer of Scott Payn.

6.         RISICO CLAIMS MANAGEMENT, formerly AMERICAN ALL-RISK LOSS ADMINISTRATORS, is a Corporation duly organized and existing under and by virtue of the laws of the State of California and is a third-party administrator that administers the claims of the CITY OF FRESNO and in particular administered the workers’ compensation claim of Scott Payn at all times herein.

7.         That on or about July 28, 2012, Defendant COBB undertook the acts which form the basis of this Complaint in Fresno, California.

FIRST CAUSE OF ACTION

INTENTIONAL BATTERY BY COBB

8.         Plaintiffs incorporate paragraphs 1 through 7 above as though fully set forth herein.

9.         That on or about July 28, 2012, Officer Scott Payn was on duty in the course and scope of employment with the FRESNO POLICE DEPARTMENT, at or near 1634 W. Saginaw in Fresno, California, and there approached Defendant COBB in an attempt to detain and question him about a burglary at 1634 W. Saginaw Avenue, Fresno, California.  At that time COBB intentionally physically battered Officer Payn by tackling him and fighting him.  The physical battering by Defendant COBB caused bodily harm to Officer Payn.

10.       That at all time herein mentioned 1634 W. Saginaw Avenue was located in the City of Fresno, in the County of Fresno, in the State of California.

11.       That as a direct and proximate result of COBB’s intentional conduct, Officer Scott Payn suffered bodily injuries requiring medical treatment.

12.       That as a proximate result of COBB’s intentional conduct, Plaintiff, CITY, a municipal corporation, has been obligated to pay, pursuant to the Workers’ Compensation Act of the State of California, workers= compensation benefits to and on behalf of Officer Scott Payn in the amount of $37,170.33 and continuing.

13.       That Plaintiff is informed and believes and on such information and belief alleges that it will be required to pay further sums for medical care and treatment for an indefinite time in the future.          

14.       That as a proximate result of COBB’s intentional conduct, Plaintiff has suffered and will continue to suffer expenses, costs and attorneys’ fees.  Pursuant to Labor Code ‘ 3856, plaintiff prays for such attorneys’ fees, costs and expenses as allowed by law.

SECOND CAUSE OF ACTION

NEGLIGENCE BY COBB

15.       Plaintiff incorporates paragraphs 1 through 14 above as though fully set forth herein.

16.       That on or about July 28, 2012, as Officer Scott Payn, while on duty in the course and scope of employment with the FRESNO POLICE DEPARTMENT, at or near 1634 W. Saginaw Avenue, Fresno, California, was attempting to lawfully approach and question Defendant COBB, Defendant COBB so negligently conducted himself as to cause bodily harm to Officer Scott Payn.

           17.        That as a direct and proximate result of COBB’s negligent conduct, Officer Scott Payn suffered bodily injuries requiring medical treatment.

18.       That as a proximate result of COBB’s negligent and careless conduct, Plaintiff, CITY, a municipal corporation, has been obligated to pay, pursuant to the Workers’ Compensation Act of the State of California, workers= compensation benefits to and on behalf of Officer Scott Payn in the amount of $37,170.33 and continuing.

19.       That Plaintiff is informed and believes and on such information and belief alleges that it will be required to pay further sums for medical care and treatment for an indefinite time in the future.

20.       That as a proximate result of COBB=s negligent conduct, Plaintiff has suffered and will continue to suffer expenses, costs and attorneys’ fees.  Pursuant to Labor Code ‘ 3856, Plaintiff prays for such attorneys’ fees, costs and expenses as allowed by law.

THIRD CAUSE OF ACTION

NEGLIGENCE PER SE BY COBB

21.       Plaintiffs incorporate paragraphs 1 through 20 above as though fully set forth herein.

22.       That on or about July 28, 2012, as Officer Scott Payn, while on duty in the course and scope of employment with the FRESNO POLICE DEPARTMENT, at or near 1634 W. Saginaw in Fresno, California, was attempting to lawfully approach and question Defendant COBB.  Defendant COBB attempted to resist lawful arrest by Officer Scott Payn.

23.       That by resisting arrest, Defendant COBB violated California Penal Code ‘69, Resisting Executive Officers.

24.       The violation of Cal. Pen. Code ‘69 was the proximate cause of injuries sustained by Officer Scott Payn.

25.       The physical injury Officer Scott Payn sustained is one of the types of injuries that Cal. Pen. Code ‘69 is designed to prevent.

26.       Police Officers are the types of Executive Officers that are meant to be protected by Cal. Pen. Code 69 (People v. Buice, 230 Cal. App. 2d 324).

27.       That as a proximate result of COBB’s conduct, Plaintiff, CITY, a municipal corporation, has been obligated to pay, pursuant to the Workers’ Compensation Act of the State of California, workers’ compensation benefits to and on behalf of Officer Scott Payn in the amount of $37,170.33 and continuing.

28.       That Plaintiff is informed and believes and on such information and belief alleges that it will be required to pay further sums for medical care and treatment for an indefinite time in the future.

29.       That as a proximate result of COBB’s conduct, Plaintiff has suffered and will continue to suffer expenses, costs and attorneys’ fees.  Pursuant to Labor Code ‘ 3856, Plaintiff prays for such attorneys’ fees, costs and expenses as allowed by law.

30.       Plaintiff is informed and believes defendant COBB was convicted of a felony for violation of Penal Code ‘69.  As such, plaintiff seeks attorney’s fees under Code of Civil Procedure ‘1021.4.

WHEREFORE, Plaintiff prays judgment against Defendants for:

(1)        Workers’ Compensation benefits paid to or on behalf of Scott Payn in an amount currently of $37,170.33 and continuing, according to proof;

(2)        For future disability benefits and costs of medical care and treatment according to proof;

(3)        For costs of suit incurred herein;

(4)        For attorneys’ fees incurred herein; and

(5)        For such other and further relief as the Court may deem just and proper.

SUMMARY

NOTICE is hereby given that at its regularly scheduled meeting on November 14, 2017, the Fresno County Board of Supervisors adopted Ordinance No. 17-022, an Ordinance of the County of Fresno, State of California. 

SUMMARY OF ORDINANCE

The Proposed Ordinance would add the following Sections to Title 9, Chapter 9.04 of the Ordinance Code of the County of Fresno: (1) Section 9.04.055-Unlawful conduct in the care of animals, cruelty, making it unlawful for a person to permit any cruel acts upon an animal, (2) Section 9.04.115-Sale of Animals at Swap Meets, which requires the operator of swap meets and vendors to follow certain conditions regarding the sale of animals at swap meets, and (3) Section 9.04.135-Right to Euthanize, which allows the sheltermaster to euthanize, rather than hold, any dog that is suffering. The Proposed Ordinance would revise or update terminology in various Sections within Chapter 9.04-Dog Licensing and Control, 9.08-Pets or Novelties, 9.12-Estray-Impoundment, and 9.16-Rodents and Predatory Animals, and would (1) bring the ordinance code into compliance with California law; (2) add the definitions of “at large” animals, and “county business days”; (3) provide fee waivers at the Director of Public Health’s discretion; (4) reduce the number of dogs from five to four in requirement to obtain a kennel license; (5) revise the holding period in which dogs (both licensed and unlicensed) may be held in the shelter before being considered abandoned; and (6) change the penalty for a violation of any provision within Chapter 9.04 from an infraction to a misdemeanor.

SEQUOIA UNION ELEMENTARY SCHOOL DISTRICT

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Sequoia Union Elementary School District (District) invites all and will receive sealed Bids at the office of the Engineer, 209 South Locust Street, Visalia, California, 93291, up to the hour of 2:00 p.m. on the 6th day of December, 2017, for the construction of a water supply and distribution system including a 12,000 gallon hydropneumatic tank, water well pump and discharge piping, supply and distribution pipelines, valves, appurtenances and connections to existing facilities and electrical equipment and wiring(Work).

Contractors and Subcontractors must submit electronic certified payroll records, as provided under Labor Code §1776, to the Labor Commissioner. These records must be submitted on a weekly basis, or as required by statute, or by the DIR.

A time limit for the final completion of the Work of one hundred (100) calendar days has been set and liquidated damages shall be assessed according to the Contract Documents for each calendar day thereafter that the Work is not completed. 

A non-mandatory pre-bid conference will be held on November 28, 2017, at 10:00 a.m. at the District office, located at 23958 Avenue 324, Lemon Cove, CA 93244.
