BLENDING PROJECT – OFFSITE PIPELINES – 2018

CUTLER PUBLIC UTILITY DISTRICT

NOTICE IS HEREBY GIVEN that the Board of Directors of the Cutler Public Utility District (District) invites all and will receive sealed Bids at the office of the Engineer, 209 South Locust Street, Visalia, California, up to the hour of 2:00 p.m. on the 14th day of November, 2018, for the construction of water pipelines, boring and casing valves, fitting, connections and appurtenances, excavation, backfill compaction and resurfacing (Work).

The award will be made to the lowest responsive, responsible Bidder in accordance with these Contract Documents, but the District reserves the right to reject any and all Bids and waive minor discrepancies in the Bid.

Copies of the Contract Documents are on file and may be examined at the office of the Engineers.  Plans and Specifications may be obtained from the office of the Engineers, Dennis R. Keller/James H. Wegley, Consulting Engineers, 209 South Locust Street, Visalia, California, 93291. A non-refundable charge of $65.00 will be required for each set of Plans and Specifications, which includes shipping.  Only contractors obtaining Plans and Specifications from the office of the Engineer or the District will be allowed to submit a sealed Bid. 

Work to be performed for the Blending Project – Offsite Pipelines – 2018 is partially financed through grant funds made available through the State of California’s Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006, Project No. P84C-5410001-001.

The successful Bidder shall produce the required Performance and Payment Bonds within fifteen (15) calendar days from the award of the Contract.  The successful Bidder will be required to furnish a faithful Performance Bond in an amount equal to one hundred (100) percent of the Contract price and a Payment Bond in an amount equal to one hundred (100) percent of the Contract price, said bonds to be obtained from a surety company satisfactory to the District and insurance coverage in defined coverages and amounts.

Attention of Bidders is particularly called to the requirements as to conditions of employment to be observed and minimum prevailing wage rates to be paid under the Contract, said items being contained in the Specifications.  In accordance with the provisions of California Labor Code §§ 1770, 1773, 1773.1, 1773.2, 1773.6 and 1773.7, the general prevailing rate of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in §1773.8, apprenticeship or other training programs authorized by §3093 and similar purposes applicable to the work to be done in the County of Tulare have been determined by the DIR Director. In accordance with California Labor Code §§1771.1 & 1771.4(a)(1), a Contractor or Subcontractor shall not be qualified to bid on, be listed in the Bid Proposal (subject to the requirements of §4104 of the Public Contract Code), or engage in the performance of any work under this Contract, unless currently registered and qualified to perform public work pursuant to §1725.5 of the Labor Code.  An unregistered Contractor may submit a Bid (as long as the Bid is authorized by §7029.1 of the Business and Professions Code or by §§10164 or 210103.5 of the Public Contract Code), provided the Contractor is registered to perform public work pursuant to §1725.5 of the Labor Code at the time the Contract is awarded.  Prior to award of the Bid, the Contractor or Subcontractor shall provide proof of said current registration with the DIR to perform public work for the Cutler Public Utility District.  This Work is subject to compliance monitoring and enforcement by the DIR.

Contractors and Subcontractors must submit electronic certified payroll records, as provided under Labor Code §1776, to the Labor Commissioner. These records must be submitted on a weekly basis or as required by statue or by the DIR.

PLEASE TAKE NOTICE THAT THE CITY OF FRESNO HAS ADOPTED A RESOLUTION OF THE CITY OF FRESNO DECLARING THE CITY COUNCIL’S INTENTION TO AWARD A NON-EXCLUSIVE FRANCHISE TO EZEKIEL NAZAROFF DBA BINCO IN PREPARATION FOR HOLDING A PUBLIC HEARING ON THE MATTER AND A FINAL VOTE TO AWARD THE FRANCHISE ON NOVEMBER 15, 2018 AT 10:00 A.M.

WHEREAS, pursuant to Article XIII of the Charter of the City of Fresno, proceedings for the establishment of non-exclusive roll-off collection franchises may be instituted by the legislative body by Resolution of Intention to adopt an Ordinance granting the franchises;

WHEREAS, this Council, as a legislative body of the City of Fresno (City), hereby determines that it is in the best interest of the City that this Council institute proceedings for the establishment of non-exclusive roll-off collection services franchises pursuant to the Charter in order to facilitate the placement of roll-off collection services contractors on the City of Fresno Department of Public Utilities’ Roll-Off Collection List;

WHEREAS, the contractors listed on Attachment 1 hereto are recommended as franchisees based on the qualitative and quantitative selection criteria that were established.

WHEREAS, this Resolution effectuates the terms and conditions set forth in the form of the Franchise Agreements executed by the City and the contractors; and

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows:

1.  The above recitals are true and correct.

2.  A non-exclusive Roll-Off franchise is proposed to be established under the terms of Article XIII, “Franchises,” of the City Charter.

3.  The City Council hereby finds and determines that the grant of non-exclusive Roll-Off franchise for Roll-Off collection services to the contractor identified on Attachment1, attached hereto and incorporated herein, is in the public interest.  The franchises granted herein are awarded, from the date of final passage of the franchise Ordinance until June 30, 2021, provided that the provisions of this Resolution, Non-Exclusive Franchise Agreement, and the Code have been agreed to in writing by the Grantee and the Grantee has executed the Non-Exclusive Franchise Agreement and the City received and approved the insurance and documents required by such agreement.

4.  The grant of these non-exclusive franchises will be expressly subject to and in compliance with all terms and conditions of the Non-Exclusive Franchise Agreement.

5.  All Grantees shall during the term of their franchise pay to the City the franchise fee set forth from time-to-time by Council Resolution, as well as all other applicable taxes, fees and charges payable by the Contractors.

6.  The form of the Non-Exclusive Franchise Agreement attached hereto as Attachment2 is incorporated by reference and is hereby approved.  The Director of the Department of Public Utilities (Director) is authorized to execute the same on behalf of the City. The Director is further authorized to execute amendments to such Non-Exclusive Franchise Agreement consistent with the purpose and intent of the franchise ordinance, subject to review and approval by the City Attorney’s Office.

7.  A public hearing on the granting of these non-exclusive franchises shall be held at 10:00 a.m., or as soon thereafter as practical on Thursday, November 15, 2018, at the regular meeting of the City Council, Fresno City Hall, 2600 Fresno Street, Fresno, California 93721.  The hearing may be continued from time to time as permitted by the Code.

8.  At the time and place set forth in this Resolution for the public hearing, any interested person may appear and be heard, and the testimony of all interested persons for or against the granting of non-exclusive roll-off collection franchises will be heard and considered.  Any protest may be made either orally or in writing.  All written protests shall be filed with the City Clerk on or before the time fixed for the public hearing, and written protest may be withdrawn in writing at any time prior to the conclusion of the hearing.

On a motion by Council member Hammer, seconded by Council member Rodriguez, and by unanimous vote, the City Council of the City of Fowler introduced the following Ordinance: “Ordinance No. 2018-02, an Ordinance of the City Council of the City of Fowler adding section 3-5.12, to Chapter 5, of Title 3 of the Fowler Municipal Code pertaining to the imposition of an additional transaction and use tax.”

The Ordinance is conditioned upon voter approval on November 6, 2018, election of a local one percent (1%) sales tax.  If the tax is approved by the voters, section 3-5.12 of the Fowler Municipal Code will be codified reflecting the new tax. 

UNCODIFIED SALES TAX ORDINANCE

On a motion by Mayor Pro Tem Parra, seconded by Council member Hammer, and by unanimous vote, the City Council of the City of Fowler introduced the following Ordinance: “Uncodified Ordinance No. 2018-03, an Ordinance of the City Council of the City of Fowler imposing an additional transaction and use tax to be administered by the California Department of Tax and Fee Administration.”

The Ordinance is conditioned upon voter approval on November 6, 2018, election of a local one percent (1%) sales tax.  If the tax is approved by the voters, the ordinance will set forth the administrative provisions for collecting the tax.

FOR THE FIRE STATION NO. 6 PROJECT

NOTICE IS HEREBY GIVEN that the City of Clovis is seeking qualified professional architectural/engineering design services to design the No. 6 Fire Station in the Loma Vista Neighborhood. 

Proposals will be received in accordance with the Request for Proposals (RFP) on file with the City Clerk at the Clovis Civic Center, Clovis, CA. The RFP can be downloaded free of charge from the vendor portal of PlanetBids, Inc., which is accessible on the City of Clovis website. Scope of work, qualifications, evaluation criteria and consultant selection will be in accordance with the processes established in the RFP.

Proposals must be filed with the City prior to 3:00 p.m., Friday, November 20, 2018, as specified in the RFP.  Bids shall be submitted in sealed envelopes and marked as follows:

CITY OF CLOVIS SUMMARY OF ORDINANCE 18-24 OF THE CITY COUNCIL OF THE CITY OF CLOVIS MAKING TECHNICAL AND CONFORMING AMENDMENTS TO ARTICLE 2 OF CHAPTER 2.2 OF TITLE 2 OF THE CLOVIS MUNICIPAL CODE RELATING TO PERSONNEL SYSTEM

On October 15, 2018, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council adopted an ordinance making technical and conforming amendments to Article 2 of Chapter 2.2 of Title 2 of the Clovis Municipal Code relating to personnel system.  The purpose of the amendments are to establish specific procedures and regulations governing the personnel system of the City of Clovis, including but not limited to, appointments, examinations, classifications of positions and classes, compensation, benefits, probation, discipline, promotions, demotions, separation of service and other provisions required by law.

Proposed Flood Hazard Determinations for the City of Clovis and Unincorporated Areas of Fresno County, California, and Case No. 18-09-0724P. The Department of Homeland Security’s Federal Emergency Management Agency (FEMA) solicits technical information or comments on proposed flood hazard determinations for the Flood Insurance Rate Map (FIRM), and where applicable, the Flood Insurance Study (FIS) report for your community.  These flood hazard determinations may include the addition or modification of Base Flood Elevations, base flood depths, Special Flood Hazard Area boundaries or zone designations, or the regulatory floodway.  The FIRM and, if applicable, the FIS report have been revised to reflect these flood hazard determinations through issuance of a Letter of Map Revision (LOMR), in accordance with Title 44, Part 65 of the Code of Federal Regulations.
